SPECIAL CITY COUNCIL MEETING
May 24, 2022
A special ineeting of the Fairfax City Council was held May 24, 2022. Mayor Frieden
called the ineeting to order at 6:06 PM. Councilmembers present: Toln Nurre, Mike Daly, Kate
Pacha, Nick Volk, and Mariai�ne Wainwright. Randy Scholer and Philip Burian of Siinmons
Perrine Moyer Bergman PLC were also present.
Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion can-ied.
Motioned by Daly, seconded by Pacha to approve to go into closed session according to Iowa
Code 21.5 1 C to discuss strategy with counsel in inatters that are presently in litigation or where
liti�atioi7 is iinminent where its disclosure would be likely to prejudice oi• disadvailtage the
position of the City of Fairfax in that litigation. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Wainwi•ight to end the closed session. Roll call vote: Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion cari�ied.
As recommended by the City Attorney, thei•e was a motion by Daly, seconded by Volk to not
file a report with the Court regardiilg Mr. Blazek, because Mr. Blazek has lniniinally colnplied
with the Court's order to abate the acculnulated tire nuisance, and that the case as it relates to Mr.
Hopkins and Shirley Share Trust be dismissed without prejudice, reserving a11 right to future
enforcement actions if necessary. Ayes: Nune, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Daly, seconded by Pacha to approve to go into closed session according to Iowa
Code 21.5 1 C to discuss strategy with counsel in inatters that are presently in litigation or where
litigation is imininent where its disclosure would be likely to prejudice or disadvantage the
position of the City of Fairfax in that litigation. Roll call vote: Ayes: Nur-�-e, Daly, Paclla, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Nurre to end the closed session. Roll call vote: Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Randy Scholer suggested to have Shane Wicks review the specifications subinitted with the
Commercial Sign Pennit and take no action at this time.
Motioned by Pacha, seconded by Daly to adjourn the meeting. Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion can-ied.
Mayor Frieden adjourned the meeting at approximately 7:11 PM.
