Home My WebLink About06-14-2022 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING June 14, 2022 A regular meeting of the Fairfax City Council was held June 14, 2022. Mayor Frieden called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright. Motioned by Pacha, seconded by Daly to approve the consent agenda. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Darrell Walters with Signal 88 mentioned a problem with the water tower’s exterior light. He thanked the City for the chance to serve. Cathy Bayne stated they had 65 people at the library for the snake presentation. They have been very busy. They had a patron steal some books and other items. The Sheriff’s Department was contacted and they know the person by reviewing the security footage. Mike Sankot stated the fire department has had 178 calls in 2022. They are ready for USA Days. Chris Philipp discussed his building department report. August 16 is the date for on-site training for the Planning and Zoning and Board of Adjustment members, elected officials are welcome. Please RSVP by August 1. Lynn Miller reported they are getting ready for USA Days and mowing. Our new truck is in production. The Fairfax Road/Lefebure Road project is to start June 27. Kevin Stensland has finished interviewing engineering firms. He is recommending ISG to work with Hall and Hall Engineers on the well project. There was a water break on Bridgewood, but it is fixed and passed the tests. An intern will be starting July 5. ERTs are not expected until September. He will be making a presentation at Kirkwood. Joe Kell reviewed his report. Shane Wicks informed the City Council the overlay project will be starting at Travero, go south, then do the culvert, and the last phase will be the Fairfax Road portion. Maggie Burger, Speer Financial, reviewed the following bids received for our bond sale earlier today; she recommended the City award the bond to Northland Securities, Inc. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-55 duly adopted. Mayor Frieden opened a public hearing regarding adding a new single family residential bulk lot requirement to the Fairfax Zoning Code at 6:16 PM. No written or oral comments have been received at city hall. Chris Philipp discussed the P&Z’s recommendation. This lot size was requested by Iowa Lots. Mayor Frieden closed the public hearing at 6:23 PM. No action was taken on the proposed ordinance. A notice asking for input is to be sent to the Heartland Heights property owners. The Linn County Deputy Sheriff entered the meeting. The City informed him that young children (not licensed drivers) are driving golf carts on the city streets; this needs to stop. He was reminded about USA Days June 24 & 25. Mayor Frieden opened the public hearing regarding the BAF Overlay District at 6:27 PM. No written or oral comments have been received at city hall. Chris discussed the Property Donation Agreement and how this aligns with that. Frank Bellon worked with the P&Z to develop this Overlay District. The P&Z will have review responsibilities for building permits in this area. Mayor Frieden closed the public hearing at 6:29 PM. Motioned by Daly, seconded by Volk to introduce and approve the first reading of ORDINANCE NO. 72, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING A NEW BAF OVERLAY DISTRICT. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 72. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Pacha, seconded by Daly to give final approval to ORDINANCE NO. 72, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING A NEW BAF OVERLAY DISTRICT. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Becky Kramer discussed the condition of the sidewalk from the Star Bar, along Vanderbilt Street to the trail south of Linn Street. The City will look into getting the tree trimmed and ordering the sidewalk gets fixed. JoAnn Beer, Cindy Anderson, Marcus Soukup, Al Soukup, and Loren Mulherin spoke up against the tall flag pole and large flag at Fairfax State Savings Bank. They don’t like the noise or night lights. They feel it should not have been allowed to be placed here and it causes a nuisance. Joe Neuhaus spoke up about residents who have served our flag. Chris Philipp discussed the code wording. Marianne Wainwright stated she feels the noise and light may be a nuisance. The residents were encouraged to try to reach a compromise with Fairfax State Savings Bank. Chris Philipp stated the Commercial Sign Permit Application for 331 Vanderbilt Street meets the code. This is where the trailers are parked. Motioned by Wainwright, seconded by Nurre to approve the Commercial Sign Permit Application for 331 Vanderbilt Street. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held about the proposed ordinance to stop downspouts going into a French drain. The French drain is to drain the street. Motioned by Daly, seconded by Wainwright to introduce and approve the first reading of ORDINANCE NO. 75, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 153, BUILDING CODE. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. An article is to be placed in the FACTS about this proposed change. While the City Council is considering this ordinance, no permits to do this are to be issued. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2022-56 A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON REVISING THE CITY OF FAIRFAX ZONING CODE. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022- 56 duly adopted. Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2022-57 A RESOLUTION APPROVING A BOX CULVERT, STREAM CHANNEL, & STORM SEWER EASEMENT ON PROPERTY OWNED BY LOGISTICS PARK CEDAR RAPIDS LLC, LOCATED IN THE S.W. ¼ OF THE N.W. ¼ AND THE N.W. ¼ OF THE S.W. ¼, OF SECTION 15, TOWNSHIP 82 NORTH, RANGE 8 WEST OF THE FIFTH P.M. IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-57 duly adopted. Shane Wicks discussed the quotes received for the Hawks Ridge Trail Project. Two were received on time and one was late. Motioned by Wainwright, seconded by Pacha to approve the lowest quote, which was from Midwest Concrete, Inc. for $124,949.50. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held about the Commercial Sign Permit Application at 407 West Southview Road. Questions were raised about the drawing and placement. More information is needed from the IDOT. This topic will be placed on a special city council meeting on June 28. Mayor Frieden appointed Bruce Boldt, Amy Roach, and Yoshio Vo to the Fairfax Library Board of Trustees to six-year terms which end June 30, 2028. Lynn Miller discussed a price increase for a new mower from Wade’s Golf & Mow. Motioned by Wainwright, seconded by Volk to approve the price increase of $1,536.70 for a Toro 6000 mower from Wade’s Golf & Mow. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. The hiring committee interviewed three people for the new full-time Public Works I position. They are recommending hiring Leif Stensland for $20.00 an hour. It was stated Leif is Kevin Stensland’s son. Kevin will not be his supervisor. Motioned by Wainwright, seconded by Nurre to hire Leif Stensland as a full-time Public Works I maintenance department employee for $20.00 an hour. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2022-58 A RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-58 duly adopted. Signal 88 has notified the City of Fairfax they will be stopping patrolling in Fairfax as of June 30, 2022. Mayor and staff are to check for other options. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2022-59 A RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None.
