HomeMy WebLinkAbout08-09-2022 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING August 9, 2022 A regular meeting of the Fairfax City Council was held August 9, 2022. Mayor Frieden called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright. Motioned by Nurre, seconded by Pacha to approve the consent agenda. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. A Linn County Deputy Sheriff reviewed the list of calls. Chris Philipp reviewed his Building Department Report. He informed the City Council today the attorney sent a notice about a fence in a drainage easement. Kevin Stensland reported the following information. The Fairfax Road culvert is 50% torn th out and the road is now closed. 76 Avenue is open to Lefebure. The maintenance department has been pouring concrete and will be removing a tree this week. Heartland Heights had a private sewer service line backup due to contractor error. The new lines in Heartland Heights have passed some of the required tests and we are waiting on the others. The intern, Zach Helberg, has about one week left to work for the City of Fairfax. Joe Kell reviewed his Parks and Recreation Report. He reported the rock painting is complete and work has started on the Veterans’ Memorial. Mayor Frieden opened the Public Hearing regarding FY23 Budget Amendment #1 at 6:11 PM. No comments had been received and no one wished to speak. Mayor Frieden closed the Public Hearing at 6:12 PM. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2022-68 A RESOLUTION APPROVING THE CITY’S PROPOSED AMENDMENT #1 TO THE FISCAL YEAR 2022-2023 BUDGET. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-68 duly adopted. Shane Wicks discussed many topics regarding the ReGen Project. Motioned by Volk, seconded by Pacha to approve RESOLUTION NO. 2022-69 A RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS, DRAINAGE REPORT, AND SITE LIGHTING PLAN FOR THE PROPOSED IMPROVEMENTS FOR REGEN IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-69 duly adopted. Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2022-70 A RESOLUTION APPROVING THE SITE PLAN DEVELOPMENT AGREEMENT FOR THE REGEN DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-70 duly adopted. Motioned by Volk, seconded by Nurre to approve RESOLUTION NO. 2022-71 A RESOLUTION APPROVING THE PRIVATE WATER MAIN FACILITIES & WATER MAIN FACILITIES EASEMENT AGREEMENT FOR THE REGEN DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-71 duly adopted. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2022-72 A RESOLUTION APPROVING AN ACCESS EASEMENT FOR THE REGEN DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-72 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2022-73 A RESOLUTION APPROVING A PRIVATE STORM WATER MANAGEMENT EASEMENT FOR THE REGEN DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-73 duly adopted. Motioned by Daly, seconded by Nurre to approve RESOLUTION NO. 2022-74 A RESOLUTION APPROVING A PUBLIC UTILITY AND PRIVATE SANITARY SEWER FACILITIES EASEMENT FOR THE REGEN DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-74 duly adopted. Motioned by Volk, seconded by Pacha to approve RESOLUTION NO. 2022-75 A RESOLUTION APPROVING WATER MAIN FACILITIES EASEMENTS FOR THE REGEN DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-75 duly adopted. Chris Philipp recommended approval of the Commercial Building Permit for 2420 Lefebure Road. Motioned by Daly, seconded by Pacha to approve the Commercial Building Permit from Logistics Park Cedar Rapids, LLC. at 2420 Lefebure Road. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp recommended approval of the Commercial Building Permit for 54 East Cemetery Road. Motioned by Daly, seconded by Pacha to approve the Commercial Building Permit from Royale Pools at 54 East Cemetery Road. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Volk, seconded by Wainwright to approve RESOLUTION NO. 2022-76 A RESOLUTION TO ENTER INTO AN AGREEMENT WITH CORY AND CALLIE BERG FOR CONNECTION TO THE CITY OF FAIRFAX’S SANITARY SEWER SYSTEM AT 54 E. CEMETERY ROAD. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-76 duly adopted. Motioned by Volk, seconded by Wainwright to approve RESOLUTION NO. 2022-77 A RESOLUTION TO ENTER INTO AN AGREEMENT WITH CORY AND CALLIE BERG FOR CONNECTION TO THE CITY OF FAIRFAX’S WATER MAIN SYSTEM AT 54 E. CEMETERY ROAD. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-77 duly adopted. Shane Wicks discussed some contingent items concerning the Site Plan of Improvements for 54 East Cemetery Road. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2022-78 A RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS FOR THE ROYALE POOL REDEVELOPMENT AT 54 E. CEMETERY ROAD IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-78 duly adopted. Discussion was held about the Vanderbilt Improvement Project. No action will be taken at this time. This topic is to be on the next agenda. Lengthy discussion was held about sidewalk repairs in Fairfax. The area under review between Church Street and Linn Street needs street elevation changes and drainage improvements. Motioned by Pacha, seconded by Wainwright to allow Travis Otto, if he chooses, to remove the broken sidewalk along the Star Bar property, because of the street and drainage conditions at this time. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp stated Dan Gioimo has moved out of Fairfax, so someone needs to be appointed to his position. Motioned by Daly, seconded by Pacha to appoint Brian Stickley to the Fairfax Planning and Zoning Commission for a term ending December 31, 2022. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Lengthy discussion was held with members of the Fairfax Planning and Zoning Commission about their recommendation for a new North East Gateway Overlay District. Motioned by Nurre, seconded by Volk to introduce and approve the first reading of ORDINANCE 76, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE, 2017, BY AMENDING PROVISIONS PERTAINING TO THE DEFINITIONS, APPLICABILITY OF REGULATIONS, AND ADOPTING A NEW OFFICAL ZONING MAP. Roll call vote: Ayes: Nurre and Volk. Nays: Daly, Pacha, and Wainwright. Motion defeated. It was suggested two members of the City Council attend the September P&Z meeting to have more discussion about this topic. Joe Kell presented quotes and specifications about new Wayfinding Signage in Fairfax. The IDOT will place three brown signs on the highway at their costs and specifications. It was discussed to make our Wayfinding Signs meet the no lower than 7 feet specification and enlarge the lettering to the size of the lettering on the street name signs so they can be read from a vehicle. Motioned by Wainwright, seconded by Pacha to order Wayfinding Signage from CR Signs with the changes in the specifications as discussed tonight with a budget of no more than $2,200.00. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2022-79 A RESOLUTION AUTHORIZING AND DIRECTING THE CITY CLERK/TREASURER TO WRITE-OFF CERTAIN UTILITY ACCOUNTS AS UNCOLLECTIBLE.
