CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
February 14, 2023
A regular meeting of the Fairfax City Council was held February 14, 2023. Mayor Pro
Tempore Wainwright called the meeting to order at 6:00 PM. Councilmembers present were:
Tom Nurre, Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright.
Motioned by Pacha, seconded by Daly to approve the consent agenda. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Discussion was held regarding the variance granted to Dan Bushman.
A Linn County Deputy Sheriff presented the list of calls.
Cathy Bayne reported the ceiling is fixed, Monday will be a staff work day, and the Library
Board plans to tour the Marion Library on Thursday.
Lynn Miller reported the fire department has had 29 calls so far in 2023. They have been
working on training.
Chris reviewed the building department report. Discussion was held regarding Dan
Bushman’s property. The Fairfax Planning and Zoning Commission will be reviewing this topic
on Tuesday. City engineering and staff will work to get a full proper submittal to review for the
building permit application.
Lynn Miller said the maintenance department has a good supply of snow material, there was
a semi stuck on the railroad tracks, he attended an EMA drill, Leif has started his classes for his
first water certification, the tiller and snowblower are here, staff attended a work zone safety
class, and Jace Merta will not be returning as an employee this spring.
Kevin Stensland reported about the IDNR inspection. He and Brian Merta reviewed some
water source and well data.
Joe Kell reviewed his Parks and Recreation Department Report and mentioned the park
project bid was under the cost estimate. He and Tina will be attending a Job Fair on March 1.
Joe Horaney, Communications Director for the CR/LC Solid Waste Agency, gave a
presentation about the Solid Waste Agency.
Motioned by Volk, seconded by Nurre to approve RESOLUTION NO. 2023-07 A
RESOLUTION APPROVING AN AMENDMENT TO THE WASTE AND RECYCLING
COLLECTION AGREEMENT WITH REPUBLIC SERVICES, INC. Roll call vote: Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Pro Tempore
Wainwright declared RESOLUTION 2023-07 duly adopted.
Mayor Pro Tempore Wainwright opened a public hearing concerning the FY24 Max Levy at
6:56 PM. The city clerk/treasurer reviewed the status of several pending bills which may affect
property tax revenue for the City of Fairfax. City hall has not received any written or oral
comments. No one at the meeting wished to discuss the topic. Mayor Pro Tempore closed the
public hearing at 7:06 PM.
Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2023-08 A
RESOLUTION APPROVING THE MAXIMUM TAX DOLLARS FROM CERTAIN
LEVIES FOR THE CITY’S PROPOSED FISCAL YEAR 2023-2024 BUDGET. Roll call
vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Pro Tempore Wainwright declared RESOLUTION 2023-08 duly adopted.
Discussion was held about the date of the next meeting. It will be on Tuesday, March 21,
2023.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2023-09 A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY’S
PROPOSED FISCAL YEAR 2023-2024 BUDGET. Roll call vote: Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Pro Tempore Wainwright
declared RESOLUTION 2023-09 duly adopted.
Shane Wicks discussed the need for the Revised Final Plat for Sobaski’s Second Addition
Lot 2 and Lot 3. Their proposed building was going to go over the lot line.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-10 A
RESOLUTION APPROVING THE FINAL PLAT FOR SOBASKI’S THIRD ADDITION
IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA (A REPLAT OF LOTS 2 AND 3,
SOBASKI’S SECOND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY,
IOWA). Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2023-10 duly
adopted.
Motioned by Daly, seconded by Nurre to approve RESOLUTION NO. 2023-11 A
RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS FOR THE
PROPOSED IMPROVEMENTS ON LOT 1, SOBASKI’S THIRD ADDITION IN THE
CITY OF FAIRFAX, LINN COUNTY, IOWA with the conditions as listed from Hall and
Hall Engineers, Inc. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2023-11 duly
adopted.
Discussion was held regarding the Commercial Building Permit Application for 114
Williams Blvd. Chris Philipp discussed the difficult process.
Motioned by Daly, seconded by Pacha to approve the Commercial Building Permit
Application for 114 Williams Blvd from Sobaski Real Estate. Ayes: Daly, Pacha, and
Wainwright. Nays: Nurre and Volk. Motion carried.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-12 A
RESOLUTION ENTERING INTO A 28E AGREEMENT FOR BUILDING OFFICIAL
SERVICES WITH THE CITY OF PALO. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk,
and Wainwright. Nays: None. Motion carried. Mayor Pro Tempore Wainwright declared
RESOLUTION 2023-12 duly adopted.
Motioned by Daly, seconded by Nurre to introduce and approve the first reading of
ORDINANCE 82 AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 153, BUILDING CODE. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 82.
Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Pacha to give final approval to ORDINANCE 82 AN
ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 153, BUILDING CODE.
Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Volk, seconded by Daly to introduce and approve the first reading of
ORDINANCE NO. 83, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 106, COLLECTION OF SOLID WASTE. Roll call vote: Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Pacha, seconded by Nurre to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 83.
Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Final approval is to be placed on the March agenda.
Joe Kell reviewed the information about the payroll suggestions for the seasonal park
employees for 2023.
Motioned by Nurre, seconded by Pacha to approve the payroll suggestions for the seasonal
park employees for 2023. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried.
Discussion was held about a year-round part-time Parks and Recreation Assistant.
Motioned by Pacha, seconded by Daly to approve establishing a year-round part-time Parks
and Recreation Assistant position and to start the hiring process. Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Brian Merta reviewed information about a new dump truck. If ordered now it will be
available during FY25.
Motioned by Pacha, seconded by Nurre to order the Mack Granit 64 FR for approximately
$334,095.00 from GATR Truck Center. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
Lynn Miller presented proposal rates for seal coating.
Motioned by Nurre, seconded by Daly to approve the proposal from Prairie Road Builders
for $2.55/sy. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Discussion was held about the need for a new part-time maintenance department employee.
Motioned by Pacha, seconded by Volk to approve starting the hiring procedure to hire a new
part-time maintenance department employee. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
A letter from Johnson County was discussed. They will be doing a study of the Silurian
Aquifer and are asking for financial support from public entities using this aquifer.
Motioned by Daly, seconded by Nurre to approve sending $999.00 to Johnson County to
participate in this study. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None.

Motioned by Nurre, seconded by Pacha to approve RESOLUTION NO. 2023-13 A
RESOLUTION AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF
FAIRFAX AND IOWA DEPARTMENT OF TRANSPORTATION FOR USE OF
HIGHWAY RIGHT-OF-WAY FOR UTILITIES ACCOMMODATION. Roll call vote:
Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Pro
Tempore Wainwright declared RESOLUTION 2023-13 duly adopted.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2023-14 A
RESOLUTION TO ENTER INTO IOWA DOT AGREEMENT NO. 6-22-HBP-038 FOR
CITY BRIDGE FUNDING FOR THE RE-CONSTRUCTION OF FHWA BRIDGE NO.
503755. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2023-14 duly
adopted.
Discussion was held about Alliant Energy’s plans to annex ground that was designated to
come into the City of Fairfax to go into the City of Cedar Rapids instead. Dan Manning is to be
contacted and negotiations started.
Motioned by Nurre, seconded by Pacha to approve RESOLUTION NO. 2023-15 A
RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL. Roll call vote:
Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Pro
Tempore Wainwright declared RESOLUTION 2023-15 duly adopted.
Motioned by Pacha, seconded by Nurre to approve RESOLUTION NO. 2023-16 A
RESOLUTION ADOPTING A POLICY FOR THE INVESTMENT OF PUBLIC FUNDS.
Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Pro Tempore Wainwright declared RESOLUTION 2023-16 duly adopted.
Motioned by Daly, seconded by Wainwright to approve RESOLUTION NO. 2023-17 A
RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT
CITY EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2023-17 duly
adopted.
Motioned by Volk, seconded by Pacha to keep the City’s involvement and cost the same for
this year’s Annual City-Wide Garage Sale Day on May 20. Ayes: Nurre, Daly, Pacha, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Pacha to hold the Annual Clean-Up Day on June 17. Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Nurre, seconded by Pacha to send Tina Rosekrans to the Annual IIMC
Conference in Minneapolis in May of 2023. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
Mayor Frieden was on the telephone. He has submitted his letter of resignation effective
February 14, 2023. Bernie thanked the elected officials and staff for working with him. He was
thanked for his years of service.
Motioned by Daly, seconded by Pacha to fill the mayor vacancy by appointment at the next
city council meeting on March 21, 2023. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
The city clerk/treasurer reviewed the budget worksheet. City Council directed staff to plan
on the GO Bond for the projects discussed last meeting for a total of $1,300,000; for a zero
interest SRF loan for the water treatment planning and design; a regular SRF loan for the rest of
the costs of the new well; and leave the other $142,000 available in LOST unassigned at this
time.
Motioned by Pacha, seconded by Daly to approve the claims list dated February 14, 2023.
Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Dan Wozniak and Barb Conner asked the City Council to call for a special election to fill the
mayor vacancy.
Dan Bushman discussed his property.
The city clerk/treasurer informed the City Council the hero banners have been ordered and
showed a picture of the design.
Motioned by Pacha, seconded by Daly to adjourn the meeting. Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Mayor Pro Tempore Wainwright adjourned the meeting at approximately 9:59 PM.
