CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
July 11, 2023
A regular meeting of the Fairfax City Council was held July 11, 2023. Mayor Beer called the
meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Kate
Pacha, Nick Volk, and Marianne Wainwright.
Motioned by Pacha, seconded by Volk to go into closed session according to Iowa Code 21.5
paragraph 1. c. to discuss strategy with counsel in matters that are presently in litigation or where
litigation is imminent where its disclosure would be likely to prejudice or disadvantage the
position of the governmental body in that litigation. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: none. Motion carried.
People were asked to leave.
People were allowed back into the room at 6:56 PM.
Motioned by Daly, seconded by Pacha to end the closed session. Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: none. Motion carried.
Motioned by Daly, seconded by Pacha to reconvene the open session. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: none. Motion carried.
Discussion was held concerning the drainage on the Novak Electrical development site.
Laurie Dawley and Jordan Esbrook are attorneys at Shuttleworth & Ingersoll and were here
representing Regis and Barbara Arp. They showed pictures of the area and also discussed a
Stark Affidavit and a conflict-of-interest assertion.
Mike Daly stated he would be abstaining from voting on this topic due to the conflict-of-
interest assertion.
Motioned by Volk, seconded by Nurre to require Novak Electric go back to their original
design for site drainage, which follows SUDAS standards, because they were unable to obtain
the signatures as required by the City to make an exception to SUDAS. Ayes: Nurre, Pacha,
Volk, and Wainwright. Nays: None. Abstain: Daly. Motion carried.
Motioned by Daly, seconded by Pacha to go into closed session according to Iowa Code 21.5

Discussion was held concerning the Tom and Patricia Arp’s property. Laurie Dawley and
Jordan Esbrook are attorneys at Shuttleworth & Ingersoll and were here representing Tom and
Patricia Arp. They showed pictures of the area and stated their client is asking for dirt now and
then another year to see if the area settles more.
Motioned by Wainwright, seconded by Volk to extend the City’s previous agreement to
provide 10 loads of dirt as long as the agreement is signed by Tom and Patricia Arp by Friday,
July 14, and the City is allowed to place and spread the dirt during the fall of 2023. Ayes: Volk
and Wainwright. Nays: Nurre, Daly, and Pacha. Motion defeated.
Motioned by Pacha, seconded by Nurre to approve the consent agenda. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Anne Carter, Health Equity Program Manager at Linn County Public Health, gave a
presentation about Linn County Public Health’s 2022-2024 Community Health Improvement
Plan. Mental health, food security, equitable opportunities for physical activity, and prevention
of gun violence are the four top health issues of the 2022-2024 Community Health Improvement
Plan.

The Library Report is in the packet.
Lynn Miller stated USA Days went fairly well for the fire department. Due to the weather,
there were less people at the lunch stand. The fireworks were set off despite the rain.
Chris Philipp reviewed his Building Department Report. After further review, the zoning at
734 Main Street is correct.
Lynn Miller said the City-Wide Clean-up Day went well. The application for two free speed
signs has been submitted. He received an email about making the corner of Prairie Avenue and
Highway 151 no parking. He will be looking into this issue and place the topic on the next
agenda.
Kevin Stensland informed the City Council that one of the wells needed work, a resident had
a sewer backup which was their private service line, and his last day with the City of Fairfax will
be the January 2024 council meeting.
Joe Kell reported Erin has started working and is doing great. We have a new online
pickleball court reservation option. Soccer sign-ups are going well. July 22 is Fairfax
Community Night at the Kernels. KCRG will be featuring Fairfax in their Our Town Series the
week of July 17. Monday, July 17, they will be broadcasting live from Fairfax during their
morning show. There will be a flag raising at 5:15 am and an interview at 6:20. KCRG will be
back to cover the Fairfax Area Veterans’ Memorial Dedication at 9:00 that morning. This will
not be a live broadcast.
Mayor Beer reported the MPO will be meeting at Fairfax on Thursday afternoon. She has
been in contact with Mediacom about the pole problem. They told her they will have it fixed in
3-4 days.
Shane Wicks reported the City will be meeting with the Union Pacific about the crossing
improvements in August. This may mean the project will not happen until next spring.
Chris Philipp discussed the Commercial Sign Permit Application from Novak Electric. It is
for wall mounted signs and everything meets our code requirements.
Motioned by Pacha, seconded by Daly to approve the Commercial Sign Permit Application
from Novak Electric for the wall mounted signs. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Chris also discussed sidewalk inspection software he is recommending the City purchase.
The cost estimate for the initial walk of the sidewalks using the DeepWalk scanning software is
$3,500.
Motioned by Daly, seconded by Volk to purchase the DeepWalk scanning software for
sidewalk inspections for a maximum cost of $5,000. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Kevin discussed wanting to hire another Kirkwood intern for water and sewer training.
Motioned by Wainwright, seconded by Volk to hire Nathan Werning as a Kirkwood intern
for water and sewer training at $7.25 an hour. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2023-68 A
RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY
EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried. Mayor Beer declared RESOLUTION 2023-68 duly adopted.
Motioned by Volk, seconded by Pacha to approve RESOLUTION NO. 2023-69 A
RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM EASTERN IOWA
EXCAVATING & CONCRETE FOR THE 2023 HEARTLAND HEIGHTS
NEIGHBORHOOD PARK PROJECT. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-69 duly
adopted.

RESOLUTION TO APPROVE CHANGE ORDER NO. 2 FROM NELSON ELECTRIC

RESOLUTION 2023-70 duly adopted.

Daly. Motion carried. Mayor Beer declared RESOLUTION 2023-77 duly adopted.

RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT
BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. Roll
call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Beer declared RESOLUTION 2023-78 duly adopted.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-79 A
RESOLUTION GRANTING PROPERTY OWNERS THE RIGHT TO ESTABLISH AND
COLLECT SANITARY SEWER AND WATER MAIN CONNECTION FEES FOR
PUBLIC SANITARY SEWER AND WATER MAIN FACILITIES THAT THEY
EXTEND TO SERVE THEIR PROPERTY. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk,
and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-79
duly adopted.

RESOLUTION ESTABLISHING PARK FEES. Roll call vote: Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION
2023-80 duly adopted.
Discussion was held about removal of Ash Trees. A letter will be sent to the residents where
a tree will be removed in the ROW.
Motioned by Daly, seconded by Pacha to approve the quote from Frank’s Tree Service for
$12,278.25. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Pacha, seconded by Daly to pay-off the 2010 GO Bond early. The amount due
is $43,164.83 through July 17 for a savings of $4,807.67. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Nurre, seconded by Daly to approve RESOLUTION NO. 2023-81 A
RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS. Roll call vote: Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-81 duly adopted.

Mayor Beer thanked everyone for their work through this meeting.
The city clerk let the City Council know we received two laptop computers from the City of
Stockton. She reminded everyone of the Veterans’ Memorial Dedication on Monday with a
reception at the Legion after. She will be teaching budget on July 18 at MPI in Ames and Tina
will be taking her last class at the Municipal Profession Institute that same day. The clerk will be
attending the Municipal Professional Academy the following week.
