HomeMy WebLinkAbout08-08-2023 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING August 8, 2023 A regular meeting of the Fairfax City Council was held August 8, 2023. Mayor Beer called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Kate Pacha, and Marianne Wainwright. Nick Volk was absent. Motioned by Pacha, seconded by Daly to approve the consent agenda. Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer read a proclamation about Linn County’s 17th Annual Stand Down to be held on September 7, 2023. Library Director Cathy Bayne gave a review of the Summer Reading Program participation numbers. Fire Chief Mike Sankot reported they have had 180 calls for service so far in 2023. He discussed lower numbers for USA Days, a structure fire on Burger Lane, and a possible building project. A Linn County Deputy Sheriff reviewed the list of calls. He asked if the City had received complaints about peddlers. Speeding on Southview was discussed. Building Administrator Chris Philipp reviewed his report. He stated he has spoken to the insurance company about the burned house, they have 60 days to do something. Plans are to start the sidewalk assessment on August 21. Public Works Supervisor Lynn Miller reported Prairie Road Builders are done with their street work. The electrical upgrades are done at The Complex and staff will get trained on Friday. He has been working on a tree grant for Heartland Heights Park. The playground equipment for this new park is here and will be installed soon. Water/Waste Water Supervisor Kevin Stensland discussed a lab error, which created a violation in our sample testing. A notice will be sent to all residents. The City will start using the Hygienics Lab as our new lab. Brian Merta reported the well rehab is 99% done. They are waiting for one more part. He has been working locating curb stops and inputting into the GIS system. The service truck will be here soon. Parks and Recreation Director Joe Kell reviewed his report and stated the Community Gardens has been a huge success. He has plans to make the area larger next year and include a smaller plot option. Mayor Beer reviewed her report and discussed the Convergen Energy meeting at Travero. Mayor Beer opened a public hearing concerning an application for voluntary annexation from Iowa Land and Building Company at 6:43 PM. The clerk’s office had one resident stop to discuss the topic. No one in the audience wished to speak. Mayor Beer closed the hearing at 6:44 PM. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-82 A RESOLUTION APPROVING THE VOLUNTARY ANNEXATION IN AN URBANIZED AREA FOR PROPERTY LOCATED EAST OF LEFEBURE ROAD AND NORTH OF 76TH AVENUE. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-82 duly adopted. Tom Arp made a statement about his family’s history with the City of Fairfax. Mayor Beer appointed Patrick Fitzgerald to the Library Board of Trustees to fill a vacant seat, with a term ending July 1, 2026. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2023-83 A RESOLUTION TO ACCEPT A PROPOSAL OF SERVICES FROM INNOVATIVE GROUNDWATER SOLUTIONS, LLC FOR GROUNDWATER MODELING IN THE SILURIAN AQUIFER. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-83 duly adopted. Motioned by Nurre, seconded by Daly to approve RESOLUTION NO. 2023-84 A RESOLUTION APPROVING A PLAT. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-84 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-85 A RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM EASTERN IOWA EXCAVATING & CONCRETE FOR THE 2023 HEARTLAND HEIGHTS NEIGHBORHOOD PARK PROJECT. Roll call vote: Ayes: Nurre, Daly, and Pacha. Nays: None. Abstain: Wainwright. Marianne Wainwright is abstaining because she works for LL Pelling, the company who did some of the work included with this pay application. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-85 duly adopted. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2023-86 A RESOLUTION TO APPROVE CHANGE ORDER NO. 5 FROM NELSON ELECTRIC CO. FOR THE 2023 CITY PARKS LIGHTING PROJECT. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-86 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-87 A RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM NELSON ELECTRIC CO. FOR THE 2023 CITY PARK LIGHTING PROJECT. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-87 duly adopted. Motioned by Daly, seconded by Wainwright to approve RESOLUTION NO. 2023-88 A RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-88 duly adopted. Motioned by Pacha, seconded by Wainwright to approve RESOLUTION NO. 2023-89 A RESOLUTION ESTABLISHING PARK FEES. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-89 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-90 A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY’S PROPOSED AMENDMENT #1 TO THE FISCAL YEAR 2023-2024 BUDGET. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Beer declared RESOLUTION 2023-90 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2023-91 A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS.
