CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
September 12, 2023
A regular meeting of the Fairfax City Council was held September 12, 2023. Mayor Beer
called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly,
Kate Pacha, Nick Volk, and Marianne Wainwright.
Motioned by Nurre, seconded by Pacha to approve the consent agenda. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Library Director Cathy Bayne mentioned dates for community meetings about a possible new
library project. They will be held on October 13 from 1:00 – 2:00 and October 19 from 7:00 –
8:00.
Fire Chief Mike Sankot reported they have had 210 calls in 2023. The department members
have been discussing building plans. They recently completed hose testing.
Building Administrator Chris Philipp discussed parking issues. He asked the City Council
about staff having the ability to write parking tickets. They asked information be placed in the
FACTS to remind residents of the parking regulations. Marianne Wainwright asked about the
ordinance the Planning and Zoning Commission is drafting. The topic of the ordinance is
limiting lots to one principal structure.
Brian Merta reported they are done flushing hydrants. The Ash trees have been removed.
They are working on seeding and setting up the new service truck.
Water and Waste Water Supervisor Kevin Stensland reported the tower is empty and ready
for the maintenance project. Well #1 is back up and running.
Parks and Recreation Director Joe Kell reviewed his report. The Heartland Heights Park
Grand Opening will be Friday, September 15 at 6:00 PM. The trail lights are on at Hawks
Ridge.
A Linn County Deputy Sheriff stopped to review the list of calls.
Mayor Jo Ann Beer reviewed her report. She gave information from Ely about a library
project and they are also using an Owl and Zoom to record their meetings.
Maggie Burger with Speer Financial review their annual TIF Report. Discussion was held
about projections for the bond market, which is currently at 3.50% – 3.75%.
Bruce Sevig and Shane Schrader discussed the status of the Heartland Heights Pond
Improvements. They would like an extension of the deadline for completion so they can
continue to sell lots. The City needs to do a walk through to view the outstanding items.
Motioned by Daly, seconded by Pacha to extend the deadline to complete the Heartland
Heights Pond Improvements until December 31, 2023. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Mayor Beer opened the public hearing regarding the FY24 Budget Amendment #1 at 6:35
PM. No comments have been submitted to City Hall. No one at the meeting had any questions
or comments. Mayor Beer closed the public hearing at 6:36 PM.
Motioned by Pacha, seconded by Daly to approve RESOLUTION 2023-93, A
RESOLUTION APPROVING THE CITY’S PROPOSED AMENDMENT #1 TO THE
FISCAL YEAR 2023-2024 BUDGET. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-93 duly
adopted.
Motioned by Volk, seconded by Wainwright to approve RESOLUTION 2023-94, A
RESOLUTION OBLIGATING FUNDS FROM THE URBAN RENEWAL TAX
REVENUE FUND FOR APPROPRIATION TO THE PAYMENT OF ANNUAL
APPROPRIATION TAX INCREMENT FINANCED OBLIGATIONS WHICH SHALL
COME DUE IN THE NEXT SUCCEEDING FISCAL YEAR. Roll call vote: Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-94 duly adopted.
Motioned by Nurre, seconded by Pacha to approve RESOLUTION 2023-95, A
RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT
OF DEBT INTEREST AND FEES DUE. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-95 duly
adopted.
Motioned by Daly, seconded by Pacha to approve RESOLUTION 2023-96, A
RESOLUTION APPROVING STREET FINANCE REPORT FOR FISCAL YEAR 2022-
2023. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion
carried. Mayor Beer declared RESOLUTION 2023-96 duly adopted.
Motioned by Wainwright, seconded by Pacha to approve the FY23 Annual Financial Report.

Motioned by Wainwright, seconded by Volk to approve the Purchase Order for The
Northway Corporation work on well #1. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
Discussion was held about park vandalism. Joe Kell will research information about security
cameras and bring some quote information to review.
Motioned by Wainwright, seconded by Pacha to waive the City of Fairfax permit
requirements for the Boulevard Grill food truck to operate at the Heartland Heights Park Grand
Opening event on September 15, 2023. Ayes: Daly, Pacha, Volk, and Wainwright. Nays:
Nurre. Motion carried.
Motioned by Nurre, seconded by Pacha to approve RESOLUTION 2023-97, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM NELSON ELECTRIC
CO. FOR THE 2023 CITY PARK LIGHTING PROJECT. Roll call vote: Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-97 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2023-98, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM MIDWEST
UNDERGROUND CONTRACTORS, INC. FOR THE 2023 WATER MAIN EXTENSION
UNDER PRAIRIE CREEK PROJECT. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-98 duly
adopted.

RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE SEEDING
SUBCONTRACTOR FOR THE 2023 WATER MAIN EXTENSION UNDER PRAIRIE
CREEK PROJECT TO COVER THE SEEDING WARRANTY PERIOD. Roll call vote:
Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer
declared RESOLUTION 2023-99 duly adopted.

RESOLUTION TO ACCEPT THE WORK PERFORMED BY MIDWEST
UNDERGROUND CONTRACTORS, APPROVE THE BALANCING CHANGE ORDER,
& APPROVE THE FINAL RETAINAGE PAY APPLICATION FOR THE 2023 WATER
MAIN EXTENSION UNDER PRAIRIE CREEK PROJECT. Roll call vote: Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-100 duly adopted.

RESOLUTION TO ACCEPT A PROPOSAL FOR GEOTECHNICAL SERVICES FOR
THE W. CEMETERY RD. BRIDGE REPLACEMENT PROJECT. Roll call vote: Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-101 duly adopted.
City Engineer Shane Wicks reviewed the Water Supply Treatment and Well No. 5
Preliminary Engineering Report. This is to be submitted to the IDNR.
Motioned by Pacha, seconded by Nurre to approve RESOLUTION 2023-102, A
RESOLUTION APPROVING THE SANITARY SEWER PLAN OF IMPROVEMENTS
FOR PUBLIC SANITARY SEWER EXTENSION TO PARCELS A & B OF PLAT OF
SURVEY #487 IN THE CITY OF FAIRFAX, IOWA. Roll call vote: Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-102 duly adopted.

RESOLUTION APPROVING A TEMPORARY CONSTRUCTION EASEMENT FOR
CONSTRUCTING SANITARY SEWER FACILITIES ON A PORTION OF PARCEL A,
PLAT OF SURVEY NO. 2079. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-103
duly adopted.

RESOLUTION TO ENTER INTO AN AGREEMENT WITH RONALD C. HILTON FOR
CONNECTION TO THE CITY OF FAIRFAX’S SANITARY SEWER SYSTEM AT
PARCEL A, PLAT OF SURVEY #487. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-106
duly adopted.

RESOLUTION TO ENTER INTO AN AGREEMENT WITH RONALD C. HILTON FOR
CONNECTION TO THE CITY OF FAIRFAX’S SANITARY SEWER SYSTEM AT
PARCEL B, PLAT OF SURVEY #487. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-107
duly adopted.
Discussion was held about the Hilton Sewer Project installing 10” pipe at the request of the
City of Fairfax to serve a larger area. Shane Wicks gave a cost estimate of approximately $7,500
to pay for the larger pipe cost difference.
Motioned by Nurre, seconded by Volk to reimburse the Hiltons for the price difference for
the upsized pipe from 8” to 10” diameter. The City will establish connection fees for future
extensions. Receipts will be needed for reimbursement. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Shane Wicks discussed the proposed speed limit ordinance change for Lefebure Road. Due
to the light pole standards, the speed limit must be 35 mph or less for the City to place street
lights in this area. Discussion was held about the actual placement of the four proposed street
lights. The proposed ordinance is amended to change the speed limit only south as far as the
street light pole placement.
Motioned by Daly, seconded by Volk to introduce and approve the first reading of
ORDINANCE NO. 86, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 63 SPEED REGULATIONS. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Discussion was held regarding the hiring process to replace Kevin Stensland, who is retiring
in January.
Motioned by Daly, seconded by Wainwright to have the hiring committee be: Nick Volk,
Mike Daly as the council alternate, Mayor Beer, Cynthia Stimson, Kevin Stensland, and Lynn
Miller. The job will be posted, in the FACTS, and in the Gazette. Applications will be received
until mid-October with a hiring recommendation to be ready by the November 14 meeting. Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.

RESOLUTION TO APPROVE A REVISED JOB DESCRIPTION. Roll call vote: Ayes:
Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-108 duly adopted.
A proposal from Kluesner Construction Inc. for crack sealing was reviewed.
Motioned by Volk, seconded by Pacha to approve Item #2 sealing of cracks on concrete
streets for $11,517.45. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Daly, seconded by Pacha to sell the 2007 Chevy Silverado ¾-ton pickup with
snowplow for $15,000. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Daly, seconded by Wainwright to approve the quote from Wade’s of
$11,600.00 for a Toro Z Master 6000 Series mower. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Pacha to approve RESOLUTION 2023-109, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON
AMENDING THE CITY OF FAIRFAX ZONING CODE. Roll call vote: Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2023-109 duly adopted.
