SPECIAL CITY COUNCIL MEETING
November 1, 2023
A special meeting of the Fairfax City Council was held November 1, 2023, at the Fairfax
City Hall. Mayor Jo Ann Beer called the meeting to order at 6:02 PM. Councilmembers present
were: Tom Nurre, Mike Daly, Nick Volk, and Marianne Wainwright. Kate Pacha was on the
telephone. Attorney Dan Manning, Sr. was also on the telephone.
Motioned by Daly, seconded hy Volk to go into a closed session according to Iowa Code
21.5 paragraph 1. c. to discuss strategy with counsel in matters that are presently in
litigation or where litigation is irnminent where its disclosure would be likely to prejudice
or disadvantage the position of the governmental body in that litigation. Ayes: Nurre, Daly,
Volk, and Wainwright. Nays: None. Pacha was waiting on the closed session phone call.
Motion carried.
Motioned by Daly, seconded by Volk to go back into open session. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
No action was taken on the UA23-27 Cedar Rapids Annexation.
Mayor Beer thanked everyone for the good discussion.
Motioned by Volk, seconded by Daly to adjourn the meeting. Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Mayor Beer adjourned the meeting at approximately 7:46 PM.
