Home My WebLink About12-12-2023 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING December 12, 2023 A regular meeting of the Fairfax City Council was held December 12, 2023. Mayor Beer called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright. Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Williams presented the monthly report. Library Director Cathy Bayne stated they have been busy. Marianne Wainwright asked about the roof leaking. She asked Cathy to follow-up with the contractor about getting this fixed. Fire Chief Mike Sankot reported the fire department has had 298 calls in 2023. They have begun working on the specifications for their next truck. Building Administrator Chris Philipp reviewed his report. Public Works Supervisor Lynn Miller reported they have made the switch to winter readiness. They have been working on rebuilding the salt bunker, budget, and Christmas decorations. Water/Wastewater Supervisor Brian Merta discussed the water tower maintenance project and project planning. Parks and Recreation Director Joe Kell reviewed his report, noting the Movie in City Hall was not well attended. Mayor Jo Ann Beer reviewed her report. Bruce Sevig discussed the status of the pond project punch list. Motioned by Wainwright, seconded by Daly to extend the December 31, 2023, deadline for issuing building permits to have items completed at the Heartland Heights Pond Project to June 30, 2024. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Dean Zelle presented information about the City’s employee benefit insurance policies. Motioned by Pacha, seconded by Volk to renew the current policies and continue the current pay structure with the City paying 100% for the employee and the employee paying the difference for any family member. Ayes: Nurre, Pacha, Volk, and Wainwright. Nays: Daly. Motion carried. Mayor Beer opened the public hearing regarding a re-zoning request from Iowa Land and Building Company for 170 acres which is the 2023 annexed property from AG-Agricultural to M1-Light Industrial at 6:34 PM. Chris Philipp gave information about the request. No oral or written comments have been received at city hall or during the meeting. Mike Sankot discussed some of the challenges of fire protection in industrial areas. Mayor Beer closed the public hearing at 6:45 PM. Motioned by Daly, seconded by Pacha to introduce and approve the first reading of ORDINANCE 88, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2017, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF THE FOLLOWING PARCELS. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer opened the public hearing regarding a Zoning Code change at 6:48 PM. Chris Philipp gave information about the change concerning the number of principle structures on one lot. A typo was noticed in the proposal. Discussion was held about some existing lots and how the grandfathering of their structures works. Mayor Beer closed the public hearing at 6:59 PM. Motioned by Daly, seconded by Pacha to introduce and approve the first reading of ORDINANCE 87, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING SECTION 1.08.C MORE THAN ONE PRINCIPAL STRUCTURE ON A LOT with the typo correction. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Nurre to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 87. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Pacha to give final approval of ORDINANCE 87, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING SECTION 1.08.C MORE THAN ONE PRINCIPAL STRUCTURE ON A LOT with the typo correction. Roll call vote: Ayes: Nurre, Daly, Pacha, and Wainwright. Nays: Volk. Motion carried. Jon Larson, with Hall and Hall Engineers, Inc., briefly discussed the 2024 Water Main Extension Under the Union Pacific Railroad Project. Motioned by Pacha, seconded by Daly to approve RESOLUTION 2023-128, A RESOLUTION TO FILE PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND OPINION OF PROBABLE COST; SET A TIME AND DATE FOR A PUBLIC HEARING; AND SET A TIME AND DATE TO RECEIVE BIDS FOR CONSTRUCTION OF THE 2024 WATER MAIN EXTENSION UNDER UNION PACIFIC RAILROAD PROJECT. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-128 duly adopted. Shane Wicks, with Hall and Hall Engineers, Inc., briefly discussed the Indemnification Agreement with Bellon-Africa Family Farms, LC. Motioned by Nurre, seconded by Pacha to approve RESOLUTION 2023-129, A RESOLUTION AUTHORIZING A LICENSE AND INDEMNIFICATION AGREEMENT BETWEEN THE CITY OF FAIRFAX AND BELLON-AFRICA FAMILY FARMS, L.C. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-129 duly adopted. Motioned by Nurre, seconded by Pacha to introduce and approve the first reading of ORDINANCE 89, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2017, BY AMENDING PROVISIONS PERTAINING TO SIDEWALK REGULATIONS. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Tom Nurre read a statement about the City’s history with the Arp property. Mayor Beer updated information about glass recycling. An ordinance is to be drafted and more information about how the glass must be processed will be presented next meeting. Information about IPAIT was discussed. Motioned by Wainwright, seconded by Pacha to allow investment into IPAIT, up to one third of the amount the City decides we can invest in bank CDs. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Pacha, seconded by Daly to approve RESOLUTION 2023-130, A RESOLUTION ADOPTING A POLICY FOR THE INVESTMENT OF PUBLIC FUNDS. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-130 duly adopted. Motioned by Pacha, seconded by Daly to approve RESOLUTION 2023-131, A RESOLUTION TO APPROVE NAMING DEPOSITORIES. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2023-131 duly adopted. Discussion was held about our website hosting. Metro Studios will be contacted for a proposal. Discussion was held about drafting a newsletter policy. One will be drafted, with attorney input, and presented at the next meeting. Motioned by Wainwright, seconded by Volk to appoint Jill Presler to the Fairfax Parks and Beautification Board for a term ending December 31, 2026. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Pacha, seconded by Daly to appoint Phil Hargrave to the Fairfax Parks and Beautification Board for a term ending December 31, 2026. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Volk to appoint Chris Brandstad to the Fairfax Planning and Zoning Commission for a term ending December 31, 2028. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Daly to appoint Kate Pacha to the Fairfax Board of Adjustment effective January 1, 2024 for a term ending December 31, 2028. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Abstain: Pacha. Kate Pacha abstained because she is the one being appointed. Motion carried. Mayor Beer appointed Marianne Wainwright Mayor Pro-tempore. Motioned by Daly, seconded by Pacha to appoint Randy Scholer with Simmons, Perrine, Moyer, and Bergman as the City’s attorney. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Pacha to appoint Cynthia Stimson as the Fairfax City Clerk/Treasurer. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Volk to appoint Mike Sankot as the Fairfax Fire and Rescue Department’s Fire Chief. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mike Sankot and Cynthia Stimson recited their oaths of office.
