CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
January 16, 2024
A regular meeting of the Fairfax City Council was held January 16, 2024. Mayor Beer called
the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Dan
Wozniak, Nick Volk, and Marianne Wainwright.
Motioned by Daly, seconded by Volk to approve the consent agenda. Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Library Director Cathy Bayne reported about gift wrapping and the roof problem.
Brian Merta reported the fire department had over 320 calls in 2023 and 21 so far in 2024.
They helped Atkins rescue people stranded during the storm and a medical call during the storm.
Building Administrator Chris Philipp reviewed his report.
Public Works Supervisor Lynn Miller reported they have responded to the snow events well
with only minor equipment breakdowns. They have hauled over 100 loads of snow and are not
done yet. Tom Nurre said they did a great job.
Water/Wastewater Supervisor Brian Merta discussed the larger water usage limits on our
permit, generators being serviced, and they are waiting for IDNR response about the pilot well
project.
Parks and Recreation Director Joe Kell reported 13 of the available 14 weekends in the
summer of 2024 are already scheduled with tournaments and sign-ups are now open.
Mayor Jo Ann Beer reviewed her report.
Motioned by Volk, seconded by Wainwright to appoint Jim Shimek to the Fairfax Board of
Adjustment for a term ending December 31, 2026. Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Nurre to appoint Kathleen Shea to the Fairfax Board of
Adjustment for a term ending December 31, 2026. Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Shana Stuart discussed her findings from the Fairfax Library Needs Assessment. The library
is a Class D and currently has 3,500 square feet. She is recommending a library with 9,505
square feet.
Jon Larson, with Hall and Hall Engineers, Inc., discussed the Water Tower Project status.
Motioned by Daly, seconded by Nurre to withhold payment at this time to MW Cole
Constructions due to the liquidated damages clause and Water Tower Project situation. Ayes:
Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Shane Wicks discussed exhibits about the East Cemetery Road Trail Project. The new
estimate of city participation is $339,000. The City Council does not want to move forward with
this project. They feel both the City’s and Linn County’s focus is on trails to the north. No
action was taken to request more funds. The MPO will be contacted about the grant award.
Motioned by Volk, seconded by Wainwright to introduce and approve the second reading of
ORDINANCE 88, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE CITY OF FAIRFAX, IOWA, 2017, BY AMENDING THE OFFICIAL ZONING
MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA,
BY DESIGNATING THE ZONING CLASSIFICATION OF THE FOLLOWING
PARCELS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None.
Motion carried.
Motioned by Daly, seconded by Nurre to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 88.
Roll call vote: Ayes: Nurre, Daly, and Volk. Nays: Wainwright and Wozniak. Motion
defeated. The third reading of this ordinance will be placed on the February agenda.
Motioned by Daly, seconded by Wainwright to approve RESOLUTION 2024-01, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON
AMENDING THE CITY OF FAIRFAX COMPREHENSIVE PLAN. Roll call vote: Ayes:
Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer
declared RESOLUTION 2024-01 duly adopted.
Motioned by Daly, seconded by Nurre to approve RESOLUTION 2024-02, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON
AMENDING THE CITY OF FAIRFAX ZONING CODE. Roll call vote: Ayes: Nurre,
Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2024-02 duly adopted.
Motioned by Daly, seconded by Volk to approve RESOLUTION 2024-03, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON WEST
CEMETERY BRIDGE PROJECT OPTIONS. Roll call vote: Ayes: Nurre, Daly, Wozniak,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION
2024-03 duly adopted.
Motioned by Nurre, seconded by Daly to approve RESOLUTION 2024-04, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON 2024
WATER MAIN EXTENSION UNDER UNION PACIFIC RAILROAD PROJECT. Roll
call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Beer declared RESOLUTION 2024-04 duly adopted.
Motioned by Daly, seconded by Volk to approve RESOLUTION 2024-05, A
RESOLUTION ENTERING INTO A PARTNERSHIP AGREEMENT WITH THE
FAIRFAX YOUTH SPORTS ASSOCIATION. Roll call vote: Ayes: Nurre, Daly, Wozniak,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION
2024-05 duly adopted.
Motioned by Nurre, seconded by Daly to approve RESOLUTION 2024-06, A
RESOLUTION TO APPROVE THE COMMUNITY ROOM POLICY. Roll call vote:
Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer
declared RESOLUTION 2024-06 duly adopted.
Motioned by Daly, seconded by Wainwright to approve RESOLUTION 2024-07, A
RESOLUTION TO APPROVE JOB DESCRIPTIONS. Roll call vote: Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2024-07 duly adopted.
Discussion was held about the seeder quotes. The cheapest one is over by South Dakota.
Motioned by Wainwright, seconded by Nurre to approve the quote of $9,900 from
Kromminga Motors in Monticello for a Brillion LSS-6 seeder. Buying more local makes it
closer to pick up and for any service issues. Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
A draft of a newsletter policy was reviewed. It is to be edited and re-sent to the attorney.
Any item that would not be allowed according to this policy during the drafting time shall be put
on hold or referred to the City Council.
Discussion was held about employee compensation.
Motioned by Daly, seconded by Wozniak to give the non-library and non-fire department
current employees a 2.50% plus 50 cents an hour raise effective 1-1-2024. Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Volk to approve RESOLUTION 2024-08, A
RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY
EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Beer declared RESOLUTION 2024-08 duly adopted.
Discussion was held about proposed changes to the payroll certification schedules for the
maintenance and parks departments. No changes were proposed for the building department or
city clerk’s office.
Motioned by Wainwright, seconded by Volk to approve the proposed payroll certification
schedules. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: Wozniak. Motion carried.
Discussion was held about establishing a new job title for Brandon Lefebure of Water and
Wastewater Lead Operator.
Motioned by Nurre, seconded by Wozniak to approve establishing a new job title and job
description for Brandon Lefebure. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried.
Brian Merta requested Dallas Chandler be allowed to obtain his Water Treatment II, Water
Distribution II, and Wastewater II certifications.
Motioned by Wainwright, seconded by Volk to approve Dallas Chandler obtaining the
certifications as requested. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None.
Motion carried.
Cynthia Stimson requested Tina Rosekrans be allowed to obtain her Certified Municipal
Clerk through IIMC.
Motioned by Volk, seconded by Daly to approve Tina Rosekrans to obtain her CMC. Ayes:
Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Discussion was held about the idea of establishing a city administrator position. Mayor Beer
reviewed an outline of topics. More information is to be gathered.
Shane Wicks reviewed the CIP list for FY25.
The city clerk/treasurer reviewed the levy information for the FY25 budget. The budget
schedule was reviewed. The regular March meeting will be switched to March 5. A reminder
was given about the budget special meeting on Monday, January 22.
Motioned by Daly, seconded by Volk to approve the claims list dated January 16, 2024.
Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Council asked about the status of light industrial district changes. Chris Philipp informed
them the Fairfax P&Z has reviewed this and will have a proposed ordinance for next meeting.
Mayor Beer thanked the staff for their work during the snow event, she read a statement from
a resident, and informed the Council about a scheduled meeting with Cedar Rapids to begin the
process of drafting a new annexation moratorium agreement.
The city clerk/treasurer reported 13 applications have been received and we hope to do
interviews next week.
Motioned by Daly, seconded by Volk to adjourn the meeting. Ayes: Nurre, Daly, Wozniak,
Wozniak, and Wainwright. Nays: None. Motion carried.
Mayor Beer adjourned the meeting at approximately 11:09 PM.
