Mayor Beer called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Dan Wozniak, Nick Volk, and Marianne Wainwright. Motioned by Daly, seconded by Volk to approve the consent agenda. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. A Linn County Deputy Sheriff presented the list of calls. Mayor Beer opened a public hearing regarding the re-zoning of the Boland property at 6:03 PM. Chris Philipp gave a review of this request. The city clerk/treasurer reported one resident stopped at city hall and asked questions about this re-zoning. Mayor Beer closed the public hearing at 6:04 PM. Motioned by Daly, seconded by Volk to introduce and approve the first reading of ORDINANCE 113, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Wainwright to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 113. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Wozniak to give final approval of ORDINANCE 113, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer opened a public hearing regarding the re-zoning of City of Fairfax property at 6:05 PM. Motioned by Volk, seconded by Wainwright to introduce and approve the first reading of ORDINANCE 114, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp gave a review of this request. Mayor Beer closed the public hearing at 6:08 PM. Motioned by Daly, seconded by Volk to introduce and approve the first reading of ORDINANCE 115, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Nurre to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 115. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Volk to give final approval of ORDINANCE 115, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Nurre, seconded by Wainwright to approve RESOLUTION 2025-10, A RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY EMPLOYEES. Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: Daly. Motion carried. Mayor Beer declared RESOLUTION 2025-10 duly adopted. Discussion was held about the property owned by the bank next to the library. It was discussed this should be completed as soon as possible, using the library CD. Motioned by Wainwright, seconded by Nurre to have Dustin Stambaugh contact Fairfax State Savings Bank about the City of Fairfax purchasing the lot for the $132,000 with the bank handling the property split so the Legion may purchase part of the property. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: Wozniak. Motion carried. Fire Chief Mike Sankot discussed fire department payroll. He made some recommendations about changes for officer pay. Motioned by Volk, seconded by Wainwright to approve RESOLUTION 2025-11, A RESOLUTION APPROVING WAGES FOR THE FIRE DEPARTMENT CITY EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-11 duly adopted. Motioned by Nurre, seconded by Daly to approve RESOLUTION 2025-12, A RESOLUTION APPROVING A CHANGE ORDER FOR THE PURCHASE OF A FIRE TRUCK FROM DANKO EMERGENCY EQUIPMENT FOR THE CITY OF FAIRFAX FIRE DEPARTMENT. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-12 duly adopted. Chris Philipp explained Eric Von Sprecken is helping with the rental inspections. He is a master plumber. Chris asked for Eric to be allowed to obtain the Building Department certifications. Motioned by Daly, seconded by Nurre to approve Eric Von Sprecken to obtain needed Building Department certifications. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Nurre to approve RESOLUTION 2025-13, A RESOLUTION ENTERING INTO A 28E AGREEMENT FOR BUILDING OFFICIAL SERVICES WITH THE CITY OF PALO. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-13 duly adopted. Shane Wicks reminded the council the Well #4 Project will go out for bids February 12. They are due back by March 19. Review of the bids will be on the second March 25 special agenda. Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2025-14, A RESOLUTION TO PROVIDE FOR A NOTICE OF HEARING ON PROPOSED PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST FOR THE WATER SUPPLY WELL NO. 4 IMPROVEMENTS PROJECT, AND THE TAKING OF BIDS THEREFOR. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-14 duly adopted. Motioned by Wainwright, seconded by Wozniak to approve RESOLUTION 2025-15, A RESOLUTION APPROVING A PURCHASE AGREEMENT BETWEEN THE CITY OF FAIRFAX AND TAYLOR NIMTZ AND KATELYNN NIMTZ FOR THE WEST CEMETERY ROAD BRIDGE REPLACEMENT INTERSECTION IMPROVEMENTS PROJECT. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-15 duly adopted. Motioned by Volk, seconded by Wainwright to approve RESOLUTION 2025-16, A RESOLUTION UPDATING THE CITY OF FAIRFAX’S 125 PLAN. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-16 duly adopted. Discussion was held concerning several policy revisions. Changes to the proposed Agenda and Meeting Policy specifics was requested. The city administrator was directed to make only necessary changes to the policies to insert his role. This should simplify the changes at this time. No action was taken on agenda items 22 through 27. Discussion was held about the city attorney recommending an AI Policy. Currently only the city administrator uses AI. The proposed policy is to be modified by adding “confidential” to 10.2. Motioned by Daly, seconded by Wainwright to approve RESOLUTION 2025-17, A RESOLUTION ADOPTING THE CITY OF FAIRFAX POLICY ON THE RESPONSIBLE USE OF ARTIFICIAL INTELLIGENCE. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-17 duly adopted. Dustin Stambaugh discussed his desire to get direction from the City Council about his measurables. A special meeting will be set for later in February. Motioned by Volk, seconded by Daly to approve Purchase Order 2025-04 for $13,728.00 to purchase meters. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Volk, seconded by Daly to approve Proposal 25-20 from Prairie Road Builders, Inc. for their rates for 2025 seal coating and surface patching. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
