HomeMy WebLinkAbout07-22-2025 Council Minutes CITY OF FAIRFAX SPECIAL CITY COUNCIL MEETING July 22, 2025 A special meeting of the Fairfax City Council was held July 22, 2025, at the Fairfax City Hall. Mayor Jo Ann Beer called the meeting to order at 5:47 PM. Councilmembers present: Tom Nurre, Mike Daly, and Dan Wozniak. Nick Volk and Marianne Wainwright were absent. Motioned by Wozniak, seconded by Daly to approve the consent agenda. Ayes: Nurre, Daly, and Wozniak. Nays: None. Absent: Volk and Wainwright. Motion carried. Motioned by Daly, seconded by Nurre to approve RESOLUTION 2025-100, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON REVISING THE CITY OF FAIRFAX ZONING CODE. Roll call vote: Ayes: Nurre, Daly, and Wozniak. Nays: None. Volk and Wainwright were absent. Motion carried. Mayor Beer declared RESOLUTION 2025-100 duly adopted. Motioned by Daly, seconded by Nurre to approve RESOLUTION 2025-101, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON REVISING THE CITY OF FAIRFAX ZONING CODE. Roll call vote: Ayes: Nurre, Daly, and Wozniak. Nays: None. Volk and Wainwright were absent. Motion carried. Mayor Beer declared RESOLUTION 2025-101 duly adopted. Nick Volk entered at 5:50 PM. The City Council wishes to interview five applicants for the city administrator position. We have received written requests from all five to go into closed session for their interview. Motioned by Nurre, seconded by Wozniak to go into closed session according to Iowa Code 21.5 1. i. To evaluate the professional competency of an individual whose appointment, hiring, performance, or discharge is being considered when necessary to prevent needless and irreparable injury to that individual's reputation and that individual requests a closed session. Ayes: Nurre, Daly, Wozniak, and Volk. Nays: None. Wainwright was absent. Motion carried. The public was asked to leave the room. A resident thanked the City for the fireworks display while leaving. Marianne Wainwright entered at 5:56 PM. The City Council went into closed session immediately after. The public was allowed back into the room. Motioned by Daly, seconded by Wozniak to go back into open session at 9:00 PM. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held regarding activity at the data center area in Cedar Rapids. Approximately 40 dewatering wells have been drilled with no permits from the IDNR or Linn County Public Health. These wells are discharging into Prairie Creek. There has also been one deep well drilled with no permit from the IDNR or Linn County Public Health and two more are planned. All of these wells are on property zoned industrial. The City of Fairfax was told there would be no deep wells drilled for the data center projects. Brian Merta and Chris Philipp reviewed the process regarding this situation. They have done an excellent job of bringing this to everyone’s attention. They were instructed to continue to ask questions, make suggestions, and keep the City of Fairfax fully informed.
