Thanks for making Fairfax a pleasant place to live! c March 20,2008 To The Residents of the City of Fairfax: Finally, we have officially reached the first clay of spring.Unfortunately,the snow is a long way from being completely gone, It has been a long and difficult winter with the near-record snowfall, and it looks to be a trying spring for us all as the melting snow and spring rains are sure to cause flooding and drainage issues throughout the City and much of the State. I would like to take a moment to thank everyone for their patience and cooperation during this seemingly endless snowy winter. As a whole,the residents of the City of Fairfax did a fantastic job of keeping their vehicles off the roads and out of the way to allow our snow plows to get through and remove the snow. And,the City apologizes for the often unortho- dox measures that were taken to push and remove the snow, Desperate times call for desperate measures, I would also like to commend the Fairfax.City personnel for the exemplary job that they did in clearing the roads and keeping them clear. T know first hand how difficult it often was to stay ahead of not only the falling snow,but also of the drifts, Ron,Jeff,Dave,and.Dan put in a lot of long nights to ensure that the roads were safe for daily travel, So,as I mentioned,now that spring is here,there will no doubt be some new issues arising, The City is aware that the roads are riddled with potholes and we will work on getting those fixed as more and more of the snow melts and we see y g g drainage the waiter weather actually coming to an end,. Also we intend to deal with the aforementioned flooding and , issues as best we can, As Mayor, l would ask that you all recognize that this has been a very unusual year azul the difficulties facing all of'us are not routine. The City will continue to work hard dealing with these weather-related issues and I hope that the resi- dents will continue to have patience and cooperate when necessary. MET MARCH I I CITY OF FAIRFAX REGULAR COUNCIL MEETING MARCH 11,2808 The regular meeting of the Fairfax City Council was held Tuesday,March 11,2008,at Fairfax City Hall at 7:00 PM, Mayor Pro-tem Marianne Wainwright pre- sided. Council members present: Beer, Frieden, Magers„ (Rabe, Wainwright, Absent: Mayor Voss, Others present: Richard Berstler, Maggie Burger, Dustin Hinricks,Dick Ransom,Cathy Bayne,Ron Dusil,Nancy Flickinger,Mike Sankot,Dave Yanecek,Dan Zamastil. Frieden moved to approve the agenda and the Clerk's financial reports, seconded by Beer. Roll calf vote:Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays:None.Motion carried. Rabe moved to approve and place on file the minutes of the regular council meeting dated February 12,2008,seconded by Magers.Roll call vote:Ayes-Beer, Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried, Beer moved to approve and place on file the minutes of the special meeting dated February 20,2008,seconded by Frieden. Roll call vote:Ayes:Beer,Frieden, Magers,Rabe,Wainwright,Nays:Norte;Motion carried,. Magers moved to accept and place on file the minutes of the Planning&Zoning regular meeting dated February 19, 2008, seconded by Rabe. Roll call vote: Ayes:Beer,Frieden,Magers,Rabe,Wainwright, Nays:None. Motion carried. The Sheriff's report was given by Deputy Peshek and the Call for Service log was submitted and discussed, Mayor Pro-tem Wainwright announced that this was the time and place for a public hearing on the matter of the proposed Fiscal Year 2008-2009 Annual Budget. Notice of this Public Hearing was published in The Gazette on February 29,2008. There being no further comments or objections,Mayor Pro-tem Wainwright closed the public hearing at 7:04 PM. Magers introduced the following Resolution and mowed its adoption, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright, Nays: None. Motion carried. Whereupon the Mayor Pro-tem declared the following duly adopted, Resolution 2008-19 entitled, "RESOLUTION AP- PROVING CITY OF FAIRFAX ANNUAL BUDGET FOR FISCAL YEAR 2008-2009.1'Passed and approved this I I"'day of March,2008, Mayor Pro-tem Wainwright announced that this was the time and place for a public hearing on the matter of the proposed amendment to the Fiscal Year 2007-2008 Annual Budget. Notice of this Public Hearing was published in The Gazette on February 29,2008. There being no further comments or objections,Mayor IPro-tern closed the public hearing at 7:05 PM. Magers Introduced the following Resolution and moved its adoption, seconded by Frieden: Roll call!vote:Ayes: Beer, Frieden, Magers, Rabe,Wainwright, Nays: None. Motion carried. Whereupon the Mayor Pro-tem declared the following duly adopted: Resolution No. 2008-20 entitled, "RESOLUTION AMENDING THE CURRENT BUDGET FOR FISCAL YEAR ENDING JUNE 30,2008."Passed and approved this I I'day of March,2008, Mayor Pro-tem Wainwright announced that this was the time and place for a public hearing on the matter of$800,000 refunding loan agreement, Notice of the Public Hearing was published in The Gazette on February 28,2008. There being no further comments or objections,Mayor Pro-tern Wainwright closed the public hearing at 7:08 PM, Magers Introduced the following Resolution and moved its adoption, seconded by Frieden, Roll call vote: Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays; None. Motion carried. Whereupon the Mayor Pro-tern declared the following duly adopted': Resolution No. 2008-21 entitled, "RESOLUTION TAKING ADDITIONAL ACTION TO ENTER INTO A LOAN AGREEMENT,"Passed and approved this I I"day of March,2008. Sale date was set for March 31,2008 at 11:00 AM with a special meeting to be held at 6:00 PM, Magers Introduced the following Resolution and moved its adoption, seconded by Frieden. Rail call vote:Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays:None.Motion carried.Whereupon the Mayor Pro-tem declared the following duly adopted: Resolution No. 2008-22 entitled,"A RESOLUTION AUTHORIZING THE TRANSFER OF TRUST AND AGENCY FUNDS TO THE WATER,FUND." Passed and approved this I I'h day of March, 2008. Dustin Hlndcks,Linn County Public Health,led a discussion on open burning and actions being taken at the State and Federal level that could affect the city in the future„ ICAP was not able to present an insurance quote,therefore it was the consensus of Council to accept the renewal of the present policy. Magers moved to approve Polar Bird Peppy's Inc. Peddlers Permit, seconded by Beer. Roll call vote:Ayes: Beer, Frieden, Magers, Rabe, Wainwright, Nays: None.Motion carried, Frieden moved to approve Stark Enterprises Site Plan,seconded by Wainwright,Ayes:Beer,Frieden,Magers,Rabe,Wainwright,Nays;None.Motion carried, Discussion was held on the naming of the new park.Park Committee was advised to present 2-3 names for Council to review and make a selection, Discussion was held on a new park tree planting event.. City workers will dig holes prior to the event during regular hours and then volunteers can plant the trees during the weekend event. Wainwright moved to approve the claims list dated March 11,2008,seconded by Magers,Roll call vote:Ayes:Beer,Frieden,Magers,Rabe,Wainwright,Nays: None.Motion carried. Other Items of discussion/reports—Library—They have a number of activities planned for Spring Break, Fire Department—Fire Chief Sankot discussed the need for a new gas meter.Council agreed for the City to pay for half.He also discussed needed repairs to the sidewalk along City Hall and the Fire Station. Further discussion will be held in April.Fire Chief Sankot also voiced his concern that there are no requirements for sprinkler heads in apartment buildings to be Inspected on a regular basis.This issue will be discussed further In April, Maintenance—Department reported that they are dealing with a number of water drainage issues and that there will be extensive work needed on the streets this Spring..Visioning—They are planning Spring planting around the North Entry sign.The Tea Party fundralser scheduled for April Is sold out,Other—Richard Berstler was present to discuss drainage issues between his property and that of the Star Bar,The City will review and see what can be done to remedy the situation. City Council)requested a report be made at the April meeting regarding the status of the City website. City Clerk reported that she will be out for about two weeks at the end of April and therefore May!issue of Fairfax Facts will be sent out late.Notice will be put in the April Issue. Council agreed to make Don Murphy responsible for scheduling use of the ballpark and collecting fees for use. Council would like to know what the fees are and have them published in the Newsletter for public knowledge.
