Once these metals and chemicals are exposed to the environment they can leach out and enter our water supply. Absent: None. Others present: Scott Drzycimski, Dick Ransom, Shane Wicks, Cathy Bayne, Dave Yanecek. Rabe moved to approve the agenda and the Clerk's financial statements, seconded by Beer. Roll call vote:Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays:None.Motion carried. Frieden moved to approve and place on file the minutes of the regular Council meeting dated December 9, 2008, and the special Council meeting dated December 10,2008,seconded by Beer.Roll call vote:Ayes:Beer,Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried. Beer moved to accept and place on file the minutes of the Planning&Zoning Commission dated December 8,2008,seconded by Rabe.Roll call vote:Ayes: Beer,Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried. The Sheriffs report was given by Deputy Brady and the Call for Service log was submitted and discussed. Cathy Bayne submitted end of year statistics and reported on the library activity. Dave Yanecek reported that the fire department has had a few calls, but been relatively quiet.The maintenance department has been busy plowing snow. Parks has been quiet, starting to plan for spring.Visioning had a successful fundraiser with the Holiday House Walk.They are also starting to plan for spring. Mayor Voss announced that this was the time and place for a public hearing on the matter of granting franchise to Interstate Power and Light Company. Notice of this hearing was published in The Cedar Rapids Gazette on January 5,2009. There being no further comments or objections,Mayor Voss closed the public hearing at 7:07 PM. Magers introduced Ordinance No. 81, AN ORDINANCE GRANTING TO INTERSTATE POWER AND LIGHT COMPANY ("COMPANY"), ITS SUCCESSORS AND ASSIGNS, THE RIGHT AND FRANCHISE TO ACQUIRE, CONSTRUCT, ERECT, MAIN- TAIN AND OPERATE IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA,WORKS AND PLANTS FOR THE MANUFACTURE AND GENERATION OF ELECTRICITY AND A DISTRIBUTION SYSTEM FOR ELECTRIC LIGHT, HEAT AND POWER AND THE RIGHT TO ERECT AND MAINTAIN THE NECESSARY POLES, LINES, WIRES, CONDUITS AND OTHER APPLIANCES FOR THE DISTRI- BUTION OF ELECTRIC CURRENT ALONG, UNDER AND UPON THE STREETS,AVENUES,ALLEYS AND PUBLIC PLACES IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA,TO SUPPLY INDIVIDUALS, CORPORATIONS, COMMUNITIES AND MUNICIPALITIES BOTH INSIDE AND OUTSIDE OF SAID CITY WITH ELECTRIC LIGHT, HEAT AND POWER FOR THE PERIOD OF TWENTY-FIVE (25)YEARS,GRANTING TO SAID COMPANY THE RIGHT OF EMINENT DOMAIN. Motion carried. Wainwright moved to approve the American Legion liquor license renewal, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wain- wright.Nays:None.Motion carried. Magers moved to renew Wellmark health insurance with a $1500 deductible and 20%copay, seconded by Beer. Roll call vote:Ayes: Beer, Magers, Rabe, Wainwright.Nays:Frieden.Motion carried. Dick Ransom, City Engineer, led a discussion on the Capital Improvements Planning Committee report and discussed the funding request list for City pro- jects for Infrastructure Stimulus Package. Wainwright introduced the following Resolution and moved its adoption, seconded by Magers. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe,Wain- wright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-01-01 entitled, "RESOLUTION AUTHORIZING ENGINEERING SERVICES TO PROCEED WITH PRELIMINARY INVESTIGATIONS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR PHASE I OF THE WATER MAIN REPLACEMENT PROJECT IN FAIRFAX PROPER". Passed and approved this 13"day of January,2009. No action was taken on Agenda items 14 and 15 regarding Resolution 2008-57. No action was taken on Agenda items 16 and 17 regarding Resolution 2008-58. No action was taken on Agenda items 18 and 19 regarding Resolution 2008-59. Frieden introduced the following Resolution and moved its adoption, seconded by Beer. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-01-02 entitled, "A RESOLUTION AP- PROVING THE CONTRACT FOR LAW ENFORCEMENT SERVICES WITH LINN COUNTY AND THE LINN COUNTY SHERIFF FOR FISCAL YEAR 2009-2010".Passed and approved this 13"day of January,2009. Whereupon the Mayor declared the following duly adopted: Resolution 2009-01-03 entitled, "A RESOLUTION AU- THORIZING ASSESSMENT OF A LIEN AGAINST THE PROPERTY FOR NONPAYMENT OF CITY UTILITIES." Passed and approved this 13"day of January,2009. Discussion was held on unsafe house and race track issues.City will continue to work closely with attorney on these issues. Discussion was held on the tree ordinance.Dave Yanecek and Dick Ransom will look into this. Discussion was held on potential repairs needed on Horizon Avenue because the road is sinking in parts. F AIRF AX FIRE&RESCUE PROL DLA"SER-\'ING FAIRFA NVALFORD&THE SI_RROL NDING AREA With the start of 3009 upon us,it is important to look back at the accomplishments of our Fairfax Fire Department. In the rear 3008,we went on 167 total calls—30 of which were fire related, 80 medical calls, 33 car accidents, 13 storm watches, and 33 miscellaneous calls which include mutual aids,false alarms,disregards,etc. Of the 167 calls,we are proud to say we report no loss of life or injur,. Since we are in the nudst of our coldest season,we felt it was important to remind our neighbors of a few helpful tips to ensure your safe- ty this winter: 1.After starting your vehicle,be sure to back your vehicle out of your garage. Carbon Monoxide is a yen-harmful&even deadly toxin to your family&pets. 2.N\lien using electric blankets and/or space heaters, be sure to shut them off when leaving your house. Many of these items may have safety features to shut them off autornatically,but it is better to use these when vou are in your home than to rely on these features. 3. Slow Down! We all know winter can bring snow,ice,&overall slick roads. Please be sure to allow more time for driving, to ensure the safety-of your farmly,as well as others on the road. 4. Be aware of your surrounchngs. Snow plows&snowmobiles go hand in hand with winter—be sure you are on the look out for these yelucles, as snow plows move at sower speeds, and snowmobile paths cross over many roles in our area, especially in Walford. 5. Keep a safety-kit in your vehicle. Many safety kits include blankets,matches, flashlight,gloves,hat special medicines,first aid kit,small shovel,and bottled water. We are happy to be a part of Fairfax/Walford and our department is always finding ways to better grow our neighbor's knowledge.We would like to open a portion of our monthly article up to a Question&Answer.
