Absent: None. Others present: Scott Drzycimski, Monica & Kenny Patten, Dick Ransom, Cathy Bayne, Fire Chief Sankot,Ron Dusil,Dave Yanecek,and Dan Zamastil. Beer moved to approve the agenda and the Clerk's financial statements,seconded by Frieden. Roll call vote:Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays:None.Motion carried. Beer moved to approve and place on file the minutes of the regular Council meeting dated November 11,2008,seconded by Frieden.Roll call vote:Ayes:Beer, Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried. Cathy Bayne reported on the Library.Fire Chief Sankot reported that the Fire Department finished up their year with 155 calls.Maintenance Department reported on a water main break downtown on December 7.JoAnn Beer reported that the Parks Department is working on ideas for spring projects.The Visioning Committee is planning for the Holiday House Walk this coming Saturday,December 13. Mayor Voss announced that this was the time and place for a public hearing on the matter of Arp Voluntary Annexation&Zoning Classification. Notice of this hearing was published in The Cedar Rapids Gazette on November 20,2008. There being no further comments or objections,Mayor Voss closed the public hearing at 7:09 PM. Rabe moved to accept Planning& Zoning Recommendation 2008-02, RECOMMENDATION APPROVING ANNEXATION AND ZONING CLASSIFICATION, seconded by Magers.Roll call vote:Ayes:Beer,Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried. Magers moved to accept Planning&Zoning Recommendation 2008-03,A RECOMMENDATION AMENDING THE FAIRFAX ZONING ORDINANCE OF 2000 OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES,seconded by Beer. Wainwright introduced Ordinance No. 80, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2000, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY,NOW KNOWN AS PART OF THE NW'/4 OF THE SW'/4,SECTION 10,TOWNSHIP 82 NORTH,RANGE 8 WEST, LINN COUNTY,IOWA,AS AG(AGRICULTURAL DISTRICT). Wainwright moved that the rule requiring that an ordinance be considered and voted upon for passage at two meetings prior to this meeting be suspended with respect to Ordinance No.80,seconded by Frieden.Roll call vote:Ayes:Beer,Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried. Ordinance No.80 is declared to have been adopted. Mayor Voss announced that this was the time and place for a public hearing on the matter of granting franchise to Interstate Power and Light Company. Due to notice of this public hearing notice not meeting publication requirements,no official action can be taken. Magers moved to remove Ordinance No. 79 from the table, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None.Motion carried. Frieden moved to dismiss Ordinance No. 79, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING PROVISIONS PERTAINING TO LOAD AND WEIGHT RESTRICTIONS,seconded by Wainwright. Roll call vote:Ayes: Beer,Frieden,Magers, Rabe, Wainwright.Nays:None.Motion carried.Mayor Voss declared Ordinance No.79 failed adoption and will be dismissed. Rabe introduced the following Resolution and moved its adoption, seconded by Beer. Roll call vote:Ayes: Beer, Frieden, Magers, Rabe, Wainwright. Nays: None.Motion carried.Whereupon the Mayor declared the following duly adopted:Resolution 2008-61 entitled,"A RESOLUTION AUTHORIZING THE APPROV- AL OF AND PARTICIPATION IN AN AGREEMENT UNDER IOWA CODE CHAPTER 28E TO ESTABLISH AN AGENCY TO BE KNOWN AS THE IOWA CITIES E-PAYMENT AGGREGATION SYSTEM("iCash")".Passed and approved this 9th day of December,2008. Wainwright moved to approve von Essen Galerie liquor permit,seconded by Rabe. Roll call vote:Ayes: Beer, Frieden, Magers, Rabe,Wainwright. Nays: None. Motion carried. Discussion was held on purchasing the property adjacent to the City Hall/Fire Station.The owners were willing to give the City twenty-four(24)hours to consider, so a special meeting was called for 7:00 PM on December 10,2008 for further discussion. Wainwright moved to accept Prairie View Estates Outlot B Warranty Deed,seconded by Frieden. Roll call vote:Ayes:Beer, Frieden,Magers, Rabe,Wainwright. Nays:None.Motion carried. Capital Improvements Planning Committee had to cancel their meeting for December 8, 2008, due to weather. They will try to meet soon and bring a report to Council. Beer moved to approve the claims list,seconded by Frieden.Roll call vote:Ayes:Beer,Frieden,Magers,Rabe,Wainwright.Nays:None.Motion carried. There being no further business before the Council,Mayor Voss adjourned the meeting at 7:55 PM. FAIRFAX CITY COUNCIL SPECIAL MEETING WEDNESDAY,DECEMBER 10,2008 This Special Meeting was called to discuss purchase of property. A special meeting of the Fairfax City Council was held on December 10, 2008, at Fairfax City Hall at 7:00 PM. Mayor Voss presided. Council members present: Beer, Frieden, Magers,Rabe,Wainwright.Absent: None.Others present: Dick Ransom. Beer moved to approve the agenda,seconded by Magers.Roll call vote:Ayes: Beer, Frieden, Magers,Rabe,Wainwright. Nays: None. Motion carried. Discussion was held on purchasing the property adjacent to City Hall/Fire Station. Mayor Voss polled the Council and it was the consensus of council not to pursue purchase of the property,as follows:Ayes: Frieden,Wainwright. Nays: Beer, Magers,Rabe. There being no further business before the Council, Mayor Voss adjourned the meeting at 7:45 PM. Clausen, a partner with Dietz, Donald & Company, CPAs today released an audit report on the City of Fairfax, Iowa. The City's receipts totaled $3,447,468 for the year ended June 30, 2008, a 17 percent decrease from 2007. The receipts included $293,911 in property tax, $572,680 from tax increment financing collections, $584,689 from charges for service, $194,148 from operating grants, contributions and restricted interest, $32,524 from unrestricted interest on investments, $1,754,075 from bond and note proceeds and $15,441 from other gen- eral receipts. Disbursements for the year totaled $3,582,185, a 28 percent decrease from the prior year and included $167,781 for general government, $1,646,738 for debt service, and $328,941 for public works. Also, disburse- ments fro business type activities totaled $1,174,635. The significant decrease in receipts and disbursements is due primarily to nearly $1.5 Million less being dis- bursed for the new wastewater treatment plant in 2008 than 2007. Call Bob Wade at 846-3964 FAIRFAX FIRE & RESCUE PROUDLY SERVING FAIRFAX-WALFORD & SURROUNDING AREA 2008 is now coming to an end. Once again the fire department met its goal of not having any injuries or loss of life to our firefighters. Whether you are a paid professional or a volunteer, the fire services' goals are the same; to bring everyone home unhurt and alive. I, Bill Barry, for the past 15 years have had the privilege of being a member of the Fairfax Fire Department. At the end of the year I am leaving for personal reasons. I have watched our fire jurisdiction triple in size. We have gone from four apparatus to eight apparatus, from 18 members to 40 members. All of our members are Firefighter I certified and over half are medically trained. Each year the training requirements seem to grow, but our members don't complain. The fire fighters of past are the men who helped lay the foundation for what we stand on today. Their hard work and dedication will never be forgotten. Today's Fire Chief, Mike Sankot and his officers have set the bar high, not only for its members, but how to better serve the citizens of its fire jurisdiction in its time of need. Both of the Mayors and city council members from Fairfax and Walford are to be commended for the contin- ued support of needs of the fire department. For the past ten years, I have been writing the news letter for the fire department. Not only has it been a source of informing the public of what we have been doing as far as training accomplishments for our fire fighters, new members and current events, but also a tool for fund raising. You, the citizens, were overwhelm- ingly generous when we had our fund raiser for our first de-fibrillator and the thermo imaging camera. The news letter has also been a great tool for fire prevention. I know some of the articles written seem to be the same from year to year, but we all need to be reminded that fire prevention and safety awareness needs to practiced everyday of our lives. Webster's dictionary lists a volunteer as {one who enters into or offers himself for a service of his or her own free will.} A volunteer fireman's life is one big surprise. Sometimes we laugh, sometimes we cry. Having a spouse and family who understands when dinner is missed. Sometimes the happiest men work for free.
