Mayor Voss presided. Council mem- bers present: Beer, Frieden, Magers, Rabe, Wainwright.Absent: None. Others present:Jeff Iben,Joe Kell, Shane Schrader, Dick Ransom, Shane Wicks, Cathy Bayne,Ron Dusil,Dave Yanecek, Dan Zamastil. Magers moved to approve the agenda and Clerk's financial statements, seconded by Beer.Roll call vote:Ayes:Beer, Frieden, Magers, Rabe,Wainwright.Nays: None.Motion carried. Rabe moved to approve and place on file the minutes of the regular Council meeting dated January 13,2009,and the special Council meeting dated January 27, 2009,seconded by Frieden.Roll call vote:Ayes:Beer, Frieden,Magers, Rabe,Wainwright.Nays:None.Motion carried. The Sheriffs report was given by Deputy Egli and the Call for Service log was submitted and discussed. Cathy Bayne reported that the sidewalk is sinking at the Library and that a teen advisory group has been created. The Fire Department had no news. The Maintenance Department reported that they had to clean out the ditch on East Southview Road during the thaw because it was full of ice and snow. Dis- cussion was held on adding a deadline extension to Temporary Occupancy permits for certain circumstances.An Ordinance amendment will be on the agenda at the next scheduled meeting for consideration.Until the proposed Ordinance takes effect,Council approved a deadline extension for all Temporary Occupan- cies that are currently on file. JoAnn Beer reported that the Parks department is planning to finish some projects,including using the rest of the grant money for trees in the new park.They will be looking into fundraising options for new playground equipment. The Visioning Committee had no news. Discussion was held on the bond sale.Council agreed on the 12-year debt schedule,and set a date for the bond sale of February 24,2009. Discussion was held on the bids received for the detention basin improvements at Commercial Court.Mayor Voss reported that he received a call from Dan Bushman of Bushman Excavating, Inc., who indicated that Bushman Excavating had kept their bid below $25,000 to avoid the performance bond, which is re- quired in the bid documents and is based on Engineer's estimate. Magers moved to award the project to Schrader Excavating.The motion died due to lack of a second. After further discussion, Magers moved to award the project to Schrader Excavating, seconded by Wainwright. Roll call vote: Ayes: Beer, Frieden, Magers, Rabe,Wainwright.Nays:None.Motion carried. Magers introduced the following Resolution and moved its adoption,seconded by Wainwright.Roll call vote:Ayes:Beer, Frieden, Magers, Rabe,Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-02-06 entitled, "RESOLUTION TO AC- CEPT BID FOR THE DETENTION BASIN IMPROVEMENTS AT COMMERCIAL COURT". Passed and approved this 10"day of February,2009. Wainwright moved to approve the claims list dated February 10,2009, seconded by Rabe.Roll call vote:Ayes:Beer, Frieden, Magers, Rabe,Wainwright.Nays: None.Motion carried. Joe Kell discussed the Fairfax Youth Sports Association.They are planning another pancake breakfast in April.They are also planning to start a T-ball league. There will be an informational meeting on March 3. Clerk reported that valuations were finally available from the County, so a budget session will be held during the special meeting February 17, 2009, at 6:00 PM. FAIRFAX CITY COUNCIL SPECIAL MEETING FEBRUARY 17,2009 A special meeting of the Fairfax City Council was held on February 17, 2009,at Fairfax City Hall at 6:00 PM. Mayor Voss presided.Council members present: Beer, Frieden, Rabe, Wainwright. Absent: Magers. Others present: Kevin Arensdorf, Shane Schrader, Dick Ransom Shane Wicks, Cathy Bayne, Mike Sankot, Nancy Flickinger,Dave Yanecek. The agenda was amended to add the following items: Public Hearing- 6:00 PM: Plans, specifications, form of contract, and estimated cost for East Drainage Way Project on East Cemetery Road (Notice of this hearing was published as required by law,but inadvertently left off the agenda.) Consider Resolution adopting plans, specifications,form of contract,and estimated cost for the East Drainage Way Project on East Cemetery Road Wainwright moved to approve the agenda,as amended,seconded by Rabe.Roll call vote:Ayes:Beer, Frieden,Rabe,Wainwright Nays:None.Motion carried. Mayor Voss announced that this was the time and place for a public hearing on the matter of plans,specifications,form of contract,and estimated cost for the East Drainage Way Project on East Cemetery Road. Notice of this hearing was published in The Cedar Rapids Gazette on January 31,2009. There being no further comments or objections,Mayor Voss closed the public hearing. Wainwright introduced the following Resolution and moved its adoption, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Rabe, Wainwright. Nays: None. Motion carried.Whereupon the Mayor declared the following duly adopted: Resolution 2009-02-07 entitled, "A RESOLUTION ADOPTING PLANS,SPECIFICATIONS, FORM OF CONTRACT,AND ESTIMATED COST FOR EAST DRAINAGE WAY PROJECT ON EAST CEME- TERY ROAD." Passed and approved this 17"day of February,2009. Wainwright moved to waive the irregularity relating to the bid bond in the bid submitted by Schrader Excavating, Inc., seconded by Frieden. Roll call vote: Ayes:Beer, Frieden, Rabe,Wainwright.Nays:None.Motion carried.(Upon further review by City Engineer,the bid was found to be non-responsive and subse- quently rejected.) Wainwright introduced the following Resolution and moved its adoption, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Rabe, Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-02-08 entitled, "RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE EAST DRAINAGE WAY PROJECT ON EAST CEMETERY ROAD." Passed and ap- proved this 17"day of February,2009. Wainwright introduced Ordinance No. 82, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA,2007,BY AMENDING PROVISIONS PERTAINING TO THE UNIFORM BUILDING CODE. Wainwright moved that the rule requiring that an ordinance be considered and voted upon for passage at two meetings prior to this meeting be suspended with respect to Ordinance No.82,seconded by Frieden.Roll call vote:Ayes:Beer,Frieden, Rabe,Wainwright.Nays:None.Motion carried. February 17,2009 Special Meeting,Cont. Wainwright moved that Ordinance No. 82, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2007, BY AMENDING THE PROVISIONS PERTAINING TO THE UNIFORM BUILDING CODE, be considered for the third time, placed upon its passage and adopted,seconded by Rabe.Roll call vote:Ayes:Beer,Frieden,Rabe,Wainwright.Nays:None.Motion carried. Ordinance No.82 is declared to have been adopted. Discussion was held on the FY 2009-2010 budget,and Council advised Financial Administrator to use the same rates as last year for the Fire Department and Library. Wainwright introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call vote:Ayes: Beer, Frieden, Rabe,Wainwright. Nays: None. Motion carried.Whereupon the Mayor declared the following duly adopted: Resolution 2009-02-09 entitled, "RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED FISCAL YEAR 2009-2010 BUDGET." Passed and approved this 17"day of February,2009. Discussion was held on a potential annexation by Joe Robson. Mayor Voss presided. Council members present: Beer, Frieden, Rabe, Wainwright. Absent: Magers. Others present: Larry Burger. Due to the absence of the Clerk, Nancy Flickinger recorded the minutes. Rabe moved to approve the agenda,seconded by Frieden.Roll call vote:Ayes:Beer,Frieden, Rabe,Wainwright.Nays:None.Motion carried. The Mayor announced that this was the time and place fixed by Council for the consideration of bids for the purchase of the City's$790,000 General Obliga- tion Corporate Purpose Notes,Series 2009. The Mayor announced that sealed bids were canvassed on behalf of the City on the 24"day of February,2009,and the following sealed bids were received: Bankers' Bank, Madison,Wisconsin—3.8204% Northland Securities, Minneapolis, Minnesota—4.0042% UMB Bank,n.a., Kansas City,Missouri—4.5012% Apple River State Bank,Apple River,Illinois—4.5163 Larry Burger, Speer Financial, Inc., state that upon examination, it is of their opinion that the bid of Bankers' Bank, Madison, Wisconsin, in association with Fairfax State Savings Bank, Fairfax, Iowa was the best bid received and it is also their opinion that the bid is favorable to the City and should be accepted.There- fore,he recommended that the Notes be awarded to that bidder at a price of$785,260,plus accrued interest,if any,being at a true interest rate of 3.8204%. After due consideration and discussion, Wainwright introduced the following Resolution and moved its adoption, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Rabe,Wainwright. Fairfax Code of Ordinances Reminder With Spring right around the corner, more Fairfax residents will likely be out enjoying the weather. And, many residents will be bringing their pets along with them. If you plan to take walks or visit our Parks with your pets, please keep the following in mind from the Code of Ordinances of the City of Fairfax, Chapter 55.22, section 2: "No owner or walker of any animal shall permit the animal to discharge feces upon any public or private property, other than the property of the owner of the animal. The owner or walker shall be deemed to permit the animal's discharge of the feces if the owner does not immediately thereafter take steps to re- move and clean up the feces from the property." FIRE DEPARTMENT NEWS With living in Fairfax and Walford, trains are a part of our every day life. Earlier this month, I witnessed a car speed up in order to beat a train through the crossing in town. Fairfax Fire Department has been on several train vs. car accidents since our existence. The car in any of these cases has yet to win. It takes a train at least a '/2 mile to get stopped when going at the average speed at which they travel through Fairfax. When driving, walking, or riding a bike, never cross the railroad tracks when the red lights are flash- ing. These lights are there for our safety & it is against the law to pass through them when they are flashing. Another danger of the railroad tracks are kids playing on or around them. Last year, we were paged out to a near miss in Fairfax, where the train engineer thought he hit a child that was playing on the tracks. He brought his train to a hault 3/4 of a mile down the tracks, to find out the child was able to get out of the way at the last possible second. Please take the time to educate your children of the dangers of the railroad tracks and the rules of the red lights. Last but not least, as many of you have noticed, the Crandic tracks, running south of Fairfax & through Wal- ford are being used more now than they have in the past several years. These tracks do not have crossing arms that come down when trains are present. We as a community must pay close attention when we are approaching these crossings, especially in areas such as Lefebure Road, where traffic speeds are a bit faster. In educating our kids, as well as refreshing our own minds, we can help to eliminate more train vs. car acci- dents in the future. Now, for your questions we received last month! Q: How many members are on the Fairfax/Walford Fire Department? A: We currently have 42 members on the Fairfax Fire Dept, including 4 Junior Firefighters. I I members re- side in Walford with the rest in Faifax or the surrounding areas. Q: How many trucks does the Fairfax Fire Department have? A: At Fairfax Station I (in Fairfax), we have 5 trucks- I pumper, I pumper/tanker, I medical truck, I rescue truck, and I grass buggy. At the Fairfax Station 2 (in Walford), we have 3 trucks- I pumper, I tanker, and I medical truck. Thank you for your questions this month.
