CITY OF FAIRFAX REGULAR COUNCIL MEETING APRIL 14, 2009 The regular meeting of the Fairfax City Council was held Tuesday, April 14, 2009, at Fairfax City Hall at 7:00 PM. Mayor Voss presided. Council members present: Beer, Frieden, Rabe, Magers, Wainwright. Others present- Ron Dusil, Dave Yanecek, Dan Zamastil, Dick Ransom, Shane Wicks, Randy Scholer, Cathy Bayne, Don Norton, Jim Houser. Beer moved to approve the agenda and the Clerk's financial reports, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays: None. Motion carried. Frieden moved to approve and place on file the minutes of the regular council meeting dated March 10, 2009, seconded by Beer. Roll call vote, Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays:None. Motion carried. Mayor Voss announced that this was the time and place for a public hearing on the matter of the proposed amendment to the Fiscal Year 2008-2009 Annual Budget. Notice of this Public Hearing was published in The Gazette on April 2, 2009. There being no further comments or objections, Mayor Voss closed the public hearing at 7:05 PM. Magers introduced the following Resolution and moved its adoption, seconded by Rabe. Roll call vote: Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays: None. Motion carried. Whereupon the Mayor Voss declared the following duly adopted: Resolution 2009-15 entitled, 11RE'SOLUTION AMENDING THE CURRENT BUDGET FOR FISCAL YEAR ENDING KNE 30, 2009." Passed and approved this 14th day of April, 2009. The Sheriffs report was given by Deputy Egli and the Call for Service log was submitted and discussed. Don Norton, Fairfax Greenhouse, asked Council if there was anything they could do to control the dust on West Cemetery Road. Staff will look into this matter. Rabe moved to approve the Building Permit for Don Norton, Fairfax Greenhouse, seconded by Frieden. Roll call vote: Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays:None. Motion carried. Randy Scholer, Simmons & Perrine, PLC, led a discussion on a proposed amendment to the Zoning Code regarding the City's procedure for annexing property. Staff was instructed to proceed with this ordinance amendment. A discussion was held in regard to updating the current Zoning Code. The City's engineer, legal counsel and staff were instructed to proceed with this matter and bring the amendments back to the table for further discussion. Council reviewed the proposed Water Tower Lease Agreement with Linn County for the transmission and reception of radio communication signals. It was the consensus of Council that the agreement was in order with the exception of the rent to be paid on a yearly basis. Mages introduced the following Resolution and moved its adoption, seconded by Frieden. Roll call, vote: Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-16 entitled, "RESOLUTION SETTING A PUBLIC HEARING AND PRESCRIBING NOTICE OF DISPOSAL OF AN INTEREST IN REAL ESTATE BY GIFT". Passed and approved this 14'h day of April, 2009. Wainwright moved to approve Randy Scholer, Simmons Terrine, PLC, to proceed with abating the nuisance located at 510 Church Street, seconded by Magers. Roll call vote: Ayes: Frieden, Rabe, Magers, Wainwright. Nays: Beer. Motion carried. A discussion was held in regard to citizens operating dirt bikes within the city limits. Legal counsel will pursue this matter, Dick Ranson & Shane Wicks, Hall &Hall Engineers, Inc., updated Council on the SRF Draft Stimulus Intended Use Plans application and the status of the IDOT trail project. They also led a discussion on establishing a Storm Water Management ordinance. Steve Smith, Johnson County Refuse, discussed the renewal of the waste hauling contract. He requested that the requirement for the Performance Bond be removed 'from the contract and stated that the rate would increase from. $9.75 to $10.75 per household, Wainwright moved to accept Johnson County Refuse's contract for waste hauling, as per the above amendments, effective July 1, 2009, seconded by Magers. Roll call vote: Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays: None. Motion carried. Council reviewed and approved the insurance coverage for 20109. Due to Council wanting more specifies on the scope of work, no action was taken on accepting Central Tank Coatings quote for exterior work on the water tower. Frieden introduced the following Resolution and moved its adoption, seconded by Magers.- Roll call vote: Ayes: Beer, Frieden, Rabe, Magers, Wainwright. Nays: None. Motion carried. Whereupon the Mayor declared the following duly adopted: Resolution 2009-17 entitled, "R11,'SOLUTION ACCEPTING WARRANTY DEED FOR EAST DRAINAGE WAY PROSECT ON EAST CEMETERY ROAD — HAROLD & JEANEA TTE MCCO'KMICK11. Passed and approved this 14'h day of April, 2009. Mayor Voss reported on the improvements needed at the parks. Due to budget restraints, no final decisions were made at this time. A discussion was held on how to proceed with the hiring process of a clerk. Rabe moved to approve the claims list dated April 14, 2009, seconded by Frieden. Roll call vote: Ayes: Beer, Friedert,Rabe, Magers, Wainwright.Nays:None. Motion carried. Reports and other items of discussion: Maintenance—Dusil reported that they had put mulch on the trees at Hawk's Ridge park, repaired culverts on Church St., and have been working on patching holes. Zamastil discussed the new rules &requirements for the type of mulch that can be used,under playground equipment and submitted a quote for a trench box for council review. Library — Cathy- '.Bayne stated that they have been doing inventory and wanted to know when the slab behind the library was going to be repaired. Maintenance will be taking care of the latter. Parks — Jo Aim Beer reported on their plans for a campaign for playground equipment at Hawk's Ridge Park. She stated that the committee would like to proceed with holding public forums for input on plans & ideas. Visioning— Jo Ann Beer reported that the committee would like to pursue an idea to implement a railroad viewing park with a sheltered picnic area. Council directed her to contact Union Pacific Railroad to see if this would be permitted. There being no further business,Mayor Voss adjourned the meeting at 9:35 PM. Along with the joys of spring comes the time to plan for storm season. It is important for you and your f<unily to be aware of what your plan is when a dangerous storm comes our way. You should designate a spot in your house to take shelter during tornado warnings & other storms_. usually, this spot would be in a basement away from windows, under a sturdy object, such as a staircase or table. At a recent meeting, the firefighters of Parkersburg spoke on the importance of going to your designated safe spot instead of putting yourself at risk and observing the storms outside of your home. if you hear the sirens go off in Fairfax/Walford, this means there is an immediate threat to our neighborhood & your family should take shelter as soon as possible. When storms are approaching the Fairfax Fire Dept goes out on "storm watch" to spot any threats moving towards our communities. After a severe storm, if you observe any damage to homes, buildings, or other structures, please contact the fire department immediately, as we have to report the damage to the emergency management. Please do not attempt to assess damage yourself, as we do not want to see any unnecessary injuries. We hope you all have a safe & sunny spring! Here are the answers to the questions from last month! They are located at 1.954 County Home Road in Marion and operate Monday through Friday 7:00 a.m. through 4:30 p.m. and Saturday 8:00 a.m. through 3:00 p.m. Again,you do need to call ahead, as you can only bring chemicals in by appointment. How much does a volunteer firefighter make on a call? We are paid$2 per call. We are only paid for calls we go on and no other duties. Sponsored by the Fairfax Parks Committee i i i MEMORIAL DAY HISTORY Memorial Day, originally called Decoration Day, is a day of remembrance for those who have died in our nation's service, There are many stories as to its actual beginnings, with over two dozen cities and towns laying claim to being the birthplace of Memorial day. There is also evidence that organized women's groups in the South were decorating graves before the end of the Civil War, Waterloo, N.Y. was officially declared the birthplace of Memorial Day by President Lyndon Johnson in May 1966. It is difficult to prove conclusively the origins of the day. It is more likely that it had many separate beginnings; each of those towns and every planned or spontaneous gathering of the people to honor the war dead in the 1.860's tapped into the general human ,need to honor our dead, each contributed honorably to the growing movement that culminated in General Logan giving his official proclamation in 1868. It is not important who was the very first, what is important is that. Memorial Day was established. Memorial Day is not about division; it is about reconciliation, and it is about coming together to honor those who gave their all. Memorial Day was officially proclaimed on May 5, 1868 by General John Logan, National Commander of the Grand Army of the Republic, in his General Order No. I1, and was first observed on may 30, 1868, when flowers were placed on the graves of Union and Confederate soldiers at Arlington National Cemetery. In 1915, inspired by the poem "In Flanders Fields." Monica Michael replied with her own poem: We cherish too, the,Poppy red That grows on fields where valor led, It seems to signal to the skies That blood of heroes never dies. She then conceived of an idea to wear red poppies on Memorial Day in honor of those who died serving the nation during war. She was the first to wear one, and sold poppies to her friends and co-workers with the money going to benefit the servicemen in need. Later Madam Guerin from France was visiting the United States and learned of this new custom started by Ms. Michael and, when she returned to France, made artificial red poppies to raise money for war orphaned children and widowed women. This 'tradition spread to other countries. In 1921,. the Franco-American Children's League sold poppies nationally to benefit war orphans of France and Belgium. The league disbanded a year later and Madam Guerin approached the VFW for help. Shortly before Memorial Day in 1922, the VFW became the first veteran's organization to nationally sell poppies. Two years later their "Buddy" Poppy program was selling artificial poppies made by disabled veterans. 11948, the U.S. Post Office honored Ms. Michael for her role in founding the National Poppy movement by issuing a red 3 cent postage stamp with her likeness on it. Traditional observance of Memorial Day has diminished over the years. Many Americans nowadays have forgotten the meaning and traditions of Memorial Day. As the VFW stated in its 2002 Memorial Day address; "Changing the date merely to create three-day weekends has undermined the very meaning of the day. No doubt, this has contributed greatly to the general public's nonchalant observance of Memorial Day." ,.
