All of the planned water main installation is completed and the addresses along this line are now hooked up and using the new main. This is a major service line improvement for the City of Fairfax's water system. Thank you for your patience if you were one of the addresses affected by this project. It was necessary to shut off the water for short periods of time while they were making all of the connections. Also, access to your properly may have been limited for a short time while they were digging. After the work, you may have experienced rusty water, air in your lines, or milky looking water. These are normal things that happen, Hopefully, by running your water until it is clear you got rid of the rusty water. The air should have come out of the lines once you used them, The milky looking water takes longer to get rid of. In fact, the water at city hall is still milky. This is caused by the process to disinfect the main. The water is safe and does not con- tain any type of harmful substance. Rathje Construction was not able to complete the final street patching, seal coating, and seeding due to the winter temperatures. They will be back in the;spring to complete this work. Winter is definitely here. Did you enjoy a white Christmas? It is pretty, but it can also cause problems. There are many issues to remember concerning snow. Be sure to drive and walk carefully. Slick conditions are beyond our control and can set in very fast. If you don't have to be out during a storm,please stay in and stay safe. Remove all vehicles from the street parking areas during a winter storm. Don't place them back on the street until the snow has stopped and the street has been plowed. The snow plows are much. move effective when they can,pass through the street easily and straight along the side of the road. Vehicles on the street must be moved every 24 hours. It is the responsibility of the abutting property owners to remove snow, ice, and accumu- lations promptly from sidewalks. If a property owner does not remove snow, ice or ac- cumulations within a reasonable time, the City may do so and assess the costs against the property owner for collection in the same manner as a property tax. Be kind to walkers and help make their pathway clear. The snow plows deposit the snow along the side of the road. This means that you will have snow placed in the area of your driveway, mailbox, and sidewalk. The post office will not deliver your mail unless the driver can access the mailbox. The City may make multiple passes to keep the street area clear. This may require you to clean these areas more than once for each storm. There is no way to avoid this snow placement. When you remove the snow, do not place it back in the street or on someone else's property. You are liable for the snow at the front of your property. Volunteers are essential to small communities. Recently,the City has had some changes. During the city Council meeting on :December 15, the Fairfax City Council appointed both Dennis Kunze and Jamie Meyers to the Fairfax Planning and Zoning Commission. Thank you to Dennis and Jamie for their willingness to serve. Mayor Voss appointed Lori Renner to the Library Board of Trustees during the city council meeting on December 15. Thank you Lori for your willingness to serve. Jason Rabe resigned from his city council seat effective December 31, 2009, due to be- ing elected as Fairfax's new mayor. The Fairfax City Council intends to fill this vacancy by appointment. If you are interested in serving on the Fairfax City Council, you must be an eligi- ble elector and submit your name in writing to the city clerk"s office by 4:00 PM, Thursday, January 7, 2010. NOTICE OF INTENT TO FILL CITY COUNCIL VACANCY BY APPOINTMENT The City of Fairfax, Linn County, Iowa, will have a vacancy on the city council as of January 1, 2010, due to the resignation of Jason Rabe. Jason has been elected as mayor and he will begin serving in that capacity on January 1, 2010. Pursuant to Section 372.13, (2), (a) of the Code of Iowa, notice is hereby given that the City Council of Fairfax, Lhin County, Iowa, intends to fill this va- cancy by appointment during their next regular city council meeting that will be held at Fairfax city hall at 7:00 PM on Tuesday, January 12, 2010. However, the electors of the City of Fairfax have the right to file a petition requiring that the va- cancy be filled by a special election. Mayor Voss called the meeting to order at 5:30 PM. Council members present: JoAnn Beer, Bernie Frieden, Jason Rabe, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson and Dave Yanecek. Also present were: City Engineer, Shane Wicks as well as Tim.Williams and Loren Hartelt from Rathje Construction. Motioned by Magers, seconded by Beer to approve the agenda. Ayes. Beer,Frieden, Rabe, Magers, and Wainwright. Motion,carried. Extensive discussion was held concerning the water main replacement project. The streets will not be completed as required by the specifications of the project. This is due to the outside temperature. The City Council stated the following concern's about this situation: Rathje Construction waited eight weeks after the late start date before they began any work on the project, snow removal on substandard streets will be difficult,the city staff'does not have time to maintain the potholes that will form in these areas during the win- ter,and that the intersections as well as the business,church,and fire station areas are the critical needs areas. Tim Williams stated that the Metro Specifications would not have allowed seal coating during the time of the projected completion date, he was unaware of the seal coating temperature constraints, he feels inches of cold mix is more than the seal coating but in the cold temperatures it would be viewed as a temporary fix, and that Rathje Construction, Inc. does not want to maintain the cold mix areas. The City of Fairfax is proposing these two options to address the issue of the streets: 1. Cold mix is to be placed in the crossings, on Church Street from Vanderbilt Street to the east side of Reynolds Street,and in the fire station area. Rathje Construction,Inc.,will maintain all non-completed street areas during the winter and come back and do the required street work as needed in the spring. These conditions would not apply to the area added to the project in Change Order i#2. 2. If Rathje Construction, Inc., does not agree to option ##1, then the City of Fairfax will contract with another business to complete the listed work and bill all costs to Rathje Construction,Inc. as liquidated expenses. If Rathje Construction,Inc. agrees to option##1,then a change order will be prepared for the next regular city council meeting to extend the completion date for the project. Tim Williams stated that he will have to take this information back to the office and their staff will dis- cuss these issues tomorrow morning. Discussion was held on the need for another city council meeting to finish the current agenda items. This meeting is being cut short because of the severe winter storm. The Planning and Zoning Commission can use the upstairs if the city council meeting runs past their start time of 7:00 PM. CITY COUNCIL MINUTES PAGE 4 SPECIAL CITY COUNCIL MEETING DECEMBER 15,2009 The special meeting of the Fairfax City Council was held Tuesday,December 15,2009,at Fairfax City Hall. Mayor Voss called the meeting to order at 6:00 PM. Council members present: JoAnn Beer,Bernie Frieden,Jason Rabe,Marc Magers,and Marianne Wainwright. Other city staff present: Cynthia Stimson,Nancy Flickinger,Mike Sankot, and Ron Dusil. City Engineer, Shane Wicks was also present. Motioned by Frieden,seconded by Magers to approve the agenda. Ayes: Beer,Frieden,Rabe,Magers, and Wainwright. Motion carried. Motioned by Beer,seconded by Frieden to approve and place on file the city council minutes from De- cember 8,2009. Ayes; Beer,Frieden,Rabe,Magers,and Wainwright. Motion carried.. Motioned by Wainwright,seconded by Frieden to approve the Fairfax Fire and Rescue's election of Mike Sankot as fire chief. Ayes: Beer,Frieden,Rabe,Magers, and Wainwright. Motion carried. Motioned by Beer,seconded by Magers to approve four new members for the Fairfax Fire and Rescue Department. They are: Eric Bradshaw,E. J.Brink, Jim Bullock, and Derek Miller. Ayes: Beer,Frieden,Rabe, Magers,and Wainwright. Motion carried. Fire Chief Mike Sankot stated the oath of office for his new term.. Discussion was held about the proposed 28E agreement with Linn County for road maintenance. Maps showing the streets were reviewed. Ron Dusil is to make a list of suggested modifications to the agreement and a. report of road maintenance costs paid by the City of Fairfax in these areas. Jeff Then was present to discuss the drainage swale along the east side of Prairie Creek Estates. He will complete his work as soon as possible in the spring. The work is to be done no later than June 1,2010. Jeff will make a list of addresses that have a drainage tile going into this area. Options for these drainage tiles will be re- viewed. The:Bast Cemetery road and 80�h Street Drainage Basin Report from Shane Wicks was reviewed. Joe Blood was given a copy of the report. He discussed the water issues in this area and asked about the City's plans.. This report will be given to the Capital Improvements Committee for consideration. Motioned by Magers,seconded by Frieden to approve the Class C'Liquor License(LC)(Commercial) Renewal Application from the American Legion Pokorny Post#572. Ayes: Beer,Frieden,Rabe,Magers,and Wainwright. Motion carried. Parker Krouse was not present. The employee health insurance package was discussed. Wellmark's quote is 4.58%less than last year. Information was reviewed from United Health Care. More research is to be done on the options and a decision must be made at the January meeting,before the February I"renewal date.. Jason Rabe submitted his resignation from the city council effective December 31,2009,due to his elec- tion as mayor. Discussion was held about the process to appoint someone to fill the vacancy. A notice of this in- tent is to be published. Motioned by Beer, seconded by Rabe to approve the recommendation from Mayor Voss to accept the six month employee performance evaluation of City Clerk Cynthia Stimson and to increase her hourly wage by 60 cents. Motion carried„ Mayor Voss reported that Dave°Yanecek is in the hospital. The current maintenance staff can handle the regular daily duties,but they may need additional help if we receive a large snowfall. Ron Dusil discussed two bills for repair work. The bill for the work at the address that contacted the City to investigate the problem will be forwarded to Rathj e Construction for payment. The other bill will not be for- warded. Nancy Flickinger discussed additional costs for the water main project that cannot be included in the pro- ject loan. They include the third party interface,a computer,networking the computers,and the possible wand replacement. The City will need to cover these expenses through our regular budget, An invoice from D. W. Zinser Company,Inc. was reviewed. A representative from Zinser will attend the next council meeting to discuss this issue. A letter from a resident concerning snow removal was reviewed. Mayor Voss listed some of the different meetings he attends as mayor and the organizations that will need contact information,from the neer mayor. Marianne Wainwright„Bernie Frieden,and JoAnn Beer stated their oaths of office for their new city council terms. Bernie Frieden thanked Mayor Voss for his ten years of service to the City of Fairfax. As mayor,Bill has given a large amount of time and effort to help see that Fairfax ran smoothly. Motioned by Wainwright,seconded by Rabe to adjourn the meeting. Commission members re- sent: Joe Kell, Tom Nurre, Travis Otto, Jack Rowray, and Doug Smith. Absent: John Hill and Virginia Soukup. Also present: City Clerk Cynthia Stimson and City Engineer Shane Wicks. Motioned by Smith, seconded by Nurre to approve the minutes from October 20, 2009. Ayes: Kell,Nurre, Otto, Rowray, and Smith. Nays: none. Motion carried. Extensive discussion was held about conger side yards, visibility requirements at inter- sections, and :fence placement. Shane Wicks and Cynthia Stimson are to get examples of these types of codes from other cities for the Commission's review. The Commission members are to drive around and view current placements of buildings and fences. Cynthia Stimson informed the Planning and Zoning Coirimission that the City Council did adopt the revision of the zoning code's definition of family., as revised by the attorney. A councilmember is going to work on a possible further revision. If one is developed, this will be placed before the Planning and Zoning Commission. Discussion was held about the current Planning and Zoning Commission's terms. Doug Smith and Jack Rowray stated that they are not interested in serving another 5-year term. They will be resigning effective the end of 2009. Motioned by Rowray, seconded by Otto to recommend that the City Council adopt the following schedule of term expiration dates. This should snake the terms follow the require- ments in Chapter 22 of the Code of Ordinances. Ayes: Kell, Nurre, Otto, Rowray, and Smith. Nays: none. Motion carried.. Joe Krell announced that earlier this evening the city council did approve the terms for the Planning and Zoning Comrnission members as suggested. They also appointed Jamie Meyers and Dennis Kunze to replace Doug Smith and Jack Rowray. Extensive discussion was held about possible revisions to the zoning code. These dis- cussions covered the topics of definitions, yard requirements, intersection visibility, and fence placement. The city clerk was directed to draft the following revisions: • Revise the side lot line definition to make two definitions, One will be for the interior side lot line and the other for the corner side lot line. • Revise the yard— ,side definition make two definitions, One will be for the interior side yard and the other for the corner side yard. Revise the bulk requirement graphs in. each zoning district to include a box to establish the corner side yard requirements separate f..roxn the interior side yard requirements. Each zoning district's bulk requirements graph was reviewed to determine what the cor- ner side yard requirements should be. These revisions will be sent to the Planning and Zoning Commission for action at their January meeting. After reviewing these revisions, the Commission will discuss how fence placement will be incorporated into these new yard requirements. The Commission reviewed a suggested revision to the newly revised definition of fam- ily. City Councilmember Bernie Frieden wished to try and revise the definition to be more in- clusive. The Planning and Zoning Commission chose not to take any action on this suggested revision. They stated that they feel they have already .reviewed this definition, made their rec- ommendation, and after the attorney slightly revised that recommendation, the city council adopted the change. They do not believe any further action is required. Motioned by Hill, seconded by Otto to adjourn the meeting. Ayes: Kell, Nurre, Otto, Hill,and Soukup. Nays: none. Motion carried.
