This will be the last newsletter before you receive your 2010 Cen-
sus form. Please take 10 minutes and answer the 10 questions. Then be
sure to snail it back in the postage paid envelope!
Census information affects the numbers of seats our state occu-
pies in the U.S. House of Representatives and how districts are divided
for our representation at the state and county level, People from many
walks of life use census data to advocate for causes, provide needed so-
cial services, prevent diseases, research markets, locate pools of skilled.
workers.and more.
When you do the math, it's easy to see what an accurate count of
' residents can do for Fairfax. The information the census collects helps to
determine how more than $400 billion dollars of federal funding each
year is spent on infrastructure and services like:

i ,lob training centers
Schools
Senior centers
O Bridges, tunnels and other-public works projects
o Emergency services
RECOLLECTIONS OF THE PAST
HISTORY OF THE CENSUS
The first census began more than a year after the inauguration of
President Washington and shortly before the second session of the first Con-
gress ended. Congress assigned responsibility for the 1790 Census to the
marshals of the U.S. judicial districts. The U.S. Constitution empowers the
Congress to carry out the census in "such manner as they shall by Law di-
rect" (Article 1, Section 2). The Founders of our fledgling nation had a bold
and ambitious plan, to empower the people over their new government. The
plan was to count every person living in, the newly created United States of
America, and to use that count to determine representation in the Congress.
Enshrining this invention in our Constitution marked a turning point ...............
in world history. Previously censuses had been used mainly to tax or confiscate property or to
conscript youth into military service. The genius of the Founders was taking a tool of govern-
ment and making it a tool of political empowerment for the governed over their government.
The First Federal Congress established a special committee to prepare the questions to
be included in the first census. The suggestions were likely debated in the House, and according
to a report in a Boston newspaper, Virginia Representative James Madison recommended at
least five of the initial six questions. The six inquiries in 1790 called for questions on gender,
race, relationship to the head of household, name of the head of household, and the number of
slaves, if any. Marshals in some states went beyond these questions and collected data on occu-
pation and the number of dwellings in a city or town.
The first census in 1790 was managed under the direction of Thomas
Jefferson, the Secretary of State. Marshals took the census in the original 13
states plus the districts of Kentucky, Maine, and Vermont, and the South-
west Territory (Tennessee), This first American Census Day was August 2,
1790.
It is constitutional to include questions in the decennial census be-
yond those concerning a simple count of the number of people because, on
numerous occasions, the courts have said the Constitution gives Congress
the authority to collect statistics in the census. As early as 1870, the Su-
preme Court characterized as 'unquestionable the power of Congress to re-
quire both an enumeration and the collection of statistics in the census. In 2000, another Dis-
trict Court agreed and found that it there is no constitutional limit on collecting additional data,
when necessary for governance,. That court also said responses, to census questions are not a
violation of a citizen's right to privacy or speech.
The 2010 questionnaire is one of the shortest in history, and comes very close to the
length and scope of inquiries asked in 1790, Everyone in the: household answers seven ques-
tions: name, gender, race, ethnicity, and whether they sometimes live somewhere else. The head
of household answers how many people live in the residence, whether it is a house, apartment,
or mobile home, and provides a telephone number for Census workers to follow up if any infor-
mation is incomplete or missing

Soonthe snow will be melting and the winter wardrobe will be packed away. Spring is almost here!
It its also the time where you start planning those spring and summer projects that are difficult to do in
the wintertime. This is also what we are doing on a city level as well.
This last month was the wrap up of our budget process. [luring this time,the council and I meet
several times to review last year's performance and to plan for the coming year. As a growing commu-
nity,we have an advantage in the fact that our total property valuation keeps rising because of all the
new construction going on. This makes it all the more necessary for us to not only budget well, but
also plan well.
To this end we have begun anew with a Capital Improvement/Strategic Planning Committee,which
will include two members of council,city employees,acquire some citizens from Fairfax and myself.
The ultimate goal is that we can develop a vision for our town that aligns with our budget so that we
effectively spend the revenue that we receive. This will be an ongoing entity that will meet on a regular
basis,which will give council great information to make informed decisions.
Last, our newest project,which will greatly enhance the convenience of our water system, is under-
way as I type. l appreciate your patience as we invade a small amount of your time to install the remote
read water meter system. Once the system Is completely Installed, no longer will you have to chase
after that reading. it will also Improve the city's ability to track water usage of our system so that we
know that we are running it as efficiently as possible.This translates to keeping casts down for you.
I would also like to report that I have represented our community at the Linn County Conference
Board,Corridor MPO and the Connections 2040 meetings this past month. I enjoy advocating for and

Anytime you plan to excavate, including digging, you should call Iowa One Call,
Whether it's a small or a large construction project or a homeowner project, call Iowa One Call
at least 48 hours prior to excavating(excluding weekends andfor holidays).
Iowa One Call will notify the owners/operators of underground facilities who participate
in Iowa One Call, The various underground facility operators will dispatch "locate" personnel
to the area to mark the underground facility locations with flags and paint markings, showing
where underground facilities are located. This is so the excavator can avoid damaging the fa-
cilities once the project begins.
Iowa law applies to professional contractors as well as homeowners and encompasses a.
wide array of outdoor projects including: installing a fence, planting trees or shrubs, digging
for any type of structure, putting in a patio or driveway, installing a septic or water system, ter-
racing, and landscaping.

FREQUENTLY ASKED QUESTIONS ABOUT THE 2010 CENSUS
What if I don_7 receive the form?
If you do not receive a form, call the Telephone Questionnaire Assistance center at 1-866-872-
6868. (If you prefer a Spanish-speaking operator, then dial 1-866-928-2010.) The lines will be:
open from 8 a.m. to 9 p.m. (your local time) seven days a week from February 25, 2010 through
July 30, 2010. For the hearing-impaired, TDD 1-866-783-2010(during the times noted above).
What ifI don't have a Permanent address?
You should be counted where you live and sleep most of the time. These residence rules serve
as the guiding principle for the census, whether you are living with relatives because of a natu-
ral disaster or foreclosure, or are a college student living away from home, or a soldier living on
a military base.
What V don't have a home?
At the Census Bureau we understand that these can be challenging times for many people. Be-
cause of this, we created the Service Based Enumeration (SBE) operation. The SBE is designed
to provide an opportunity for people experiencing some form of displacement or lack of perma-
nent address to be included in the census, by counting them at service-based locations, such as
homeless shelters, soup kitchens, etc. The Be Counted form is another way people can take part
in the census. Be Counted forms are census forms that are available at various community loca-
tions for use by people who either did not receive a census form in the mail or who believe they
were not otherwise included on any other census form.
lIow do I"e a form in a different language?
The forms are available in six languages: English, Spanish, Chinese (simplified), Korean, Rus-
sian and Vietnamese. English/Spanish bi-lingual forms will be mailed to areas with large num-
bers of Spanish-only households. You will be able to request a form in one of the five non-
English languages via toll-free numbers that will be available closer to Census Day. However,
Language Assistance Guides are available in 59 different languages to help people fill out the
English version of the census form. You may also access large print and Braille guides and a
language reference dictionary
Is there another war to get the form other than the mail?
Be Counted forms are census forms that are available at various community locations for use by
people who either did not receive a form in the mail or whose information was not collected on
any other form. Be Counted forms are available in English, Spanish, Chinese, Korean, Viet-
namese and Russian. These forms can be picked tip in various community locations and mailed
back in the attached postage-paid envelope.

the U.S. Census Bureau and as OFFICIAL BUSINESS of the United States. Before your household

Securj&: Who sees mr information?
By law, the Census Bureau cannot share respondents' answers with anyone, including the IRS, FBI,
CIA or any other government agency. All Census Bureau employees take the oath of nondisclosure and
are sworn for life to protect the confidentiality of the data. The penalty for unlawful disclosure is a fine
of up to $250,000 or imprisonment of up to 5 years, or both.
Can my neighbor see my information?
No. It is unlawful for the Census Bureau to give personally identifiable information about an individual
to any other individual or agency until 72 years after it is collected for the decennial census, Addition-
ally every Census Bureau employee has taken an oath to protect your information and is subject to a
jail term, a fine---or both—if he or she discloses ANY information that could identify you or your
household.

Quality checks are used to assure our procedures are working and that our staff is doing the job they
were assigned to do. These checks require that some households be visited more than once. Addition-
ally, if you returned your form late, your response might not be logged before a census taker is sent out,

Census takers visit local homes tip to three times to record resident information for 2010 Census. The
census taker leaves a door hanger, -featuring a phone number, each time, if the residents they're trying
to reach aren't home. Residents can then call the number to schedule the visit. In addition, quality
checks to ensure that census procedures are working and census staff is doing their job will require that
some households be visited more than once.

REGULAR CITY COUNCIL MEETING
FEBRUARY 9, 2010
The regular meeting of the Fairfax City Council was held Tuesday,February 9, 2010, at Fairfax City Ha11.
Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer,Bernie Frieden,Marc
Magers and Marianne Wainwright. One seat is vacant. Other city staff present: Cynthia Stimson, Lynn Miller,
Dave Yanecek, and Cathy Bayne,
Four residents submitted their name as persons interested in being appointed to the City Council. The
Council thanked them for their interest and stated that having four qualified and willing residents was a good prob-
lem to have. The three that will not be selected will be asked to participate on other city boards and committees
and encouraged to run on the next regular ballot.
Motioned by Frieden, seconded by Magers to approve RESOLUTION 2010-07, A RESOLUTION
MAKING AN APPOINTMENT TO FILL A CITY COUNCIL VACANCY by appointing Travis Otto to the
city council. Roll call vote: Ayes: Beer,Frieden, Magers, and Wainwright. One seat is vacant. Motion carried.
Mayor Rabe declared RESOLUTION NO.2010-07 duly adopted.
Travis Otto stated his oath of office and began serving on the City Council immediately.

Linn,County Deputy Sheriff Humphrey distributed the list of calls,
Cathy Bayne stated that everything was fine at the library..
Lynn Miller reported that the fire department is proceeding with getting information about a new truck.
The current set of jaws of life is a low pressure system that needs some repair. They are looking at making these
repairs and also purchasing a high pressure system. Each fire station would then have a set.
Dave Yanecek showed the City Council a piece of well casing that was almost rusted through. Northway
Well and Pump stated that the casing should be checked every 5-7 years. The sewer plant still has one pump
down.
JoAnn Beer showed a draft of a parks brochure. Printing quantities and costs were discussed. A color
brochure will be printed for the n inimuin needed with the costs being paid out of the general administration
budget.
The Visioning Committee has seen a decline in participation. The members are suggesting that they com-
bine with the Parks Committee to form. a new group. The Visioning funds would be transferred to the Parks ac-
counts. A resolution will be drafted to make this combination for the next meeting.
Joe Kell was present to give a report about the Fairfax Youth Sports Association. He stated that they will
have the Pancake Breakfast on April 11,2010, He requested that the City of Fairfax copy,fold, and mail their reg-
istration form to the entire Fairfax community on February 23, 2010 and place information on our website. The
clerk will place the information submitted on the website as soon as possible.
Motioned by Frieden, seconded by Beer to process and mail the Fairfax Youth Sports Association's regis-
tration form. Ayes: Beer,Frieden,Otto,Magers, and Wainwright. Motion carried.
Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2010-08, A RESOLUTION
APPROVING CHANGE ORDER NO. 7 FOR THE WATER MAIN REPLACEMENT PROGRAM,
PRASE I IMPROVEMENTS. Roll call vote: Ayes: Beer,Frieden, Otto,Magers and Wainwright. Motion car-
ried. Mayor Rabe declared RESOLUTION NO.2010-08 duly adopted.
Discussion was held about the wording of labor hours on Change Order No. 8 from Rathje Construction.
Shane Wicks is to get clarification on this issue.

Shane Wicks gave a short overview of the status of the trail and bridge project. The cost estimate is now$300,000
higher, due to bridge requirements. The City has submitted this project for consideration of additional stimulus
funding available through the MPO and ECICOG, Shane is recommending that we proceed with the design be-
cause the City has already obtained a 8'011i'o grant for this work. if the additional funds are received,the project is
slated to begin in May of 2011, Shane will check with the IDOT about their bridge plans,
Discussion was held about the current per foot charge for hooking up to an existing mainfor new water or

A report about costs for the box culvert project under East Cemetery Road was reviewed. Steve Gannon,
at Linn County Secondary Road Department,is to be sent a bili for part of the cost.
Jason Rabe informed the City Council that he has made the decision that he will be able to handle the
farm management responsibilities as the previous mayor did. He has talked to the farmer and now feels informed
enough to make this decision. He thanks Bill Voss for his willingness to continue helping the City, but Mayor
Rabe feels that this being handled by the mayor is the best option for both Bill and the City of Fairfax. Marc Mag-
ers stated that the fire department would like to be considered to do the farming a year from now. They are pro-
posing that the fire department members who are farmers would use their equipment and knowledge with the fire
department receiving the usual fees for doing the custom farming.
Three different bids were reviewed about networking our computer system and purchasing a flew com-
puter for the maintenance department. Mayor Rabe will develop a RFP that we will send out to receive similar
bids for exactly the kind of system the City wishes to install.
Hills Bank's Link2Gov program was discussed, The clerk was directed to look into these types of possi-
bilities and check on interest on the accounts.
A report about a public access cable channel was reviewed.
The proposed draft of an Electric Transmission Franchise Agreement with ITC Midwest was reviewed.
The clerk is to contact them about their continued interest.
The current definition of family in the zoning code was discussed. No further changes will be made at
this time.

A resident expressed her concern about a vehicle that is speeding on Church and Fairfax Road. She has
contacted the Linn County Sheriff's Department,but they have just missed the person. The City Council directed
her to contact the proper authority.
Mayor Rabe stated that he has contacted Dave Zinser about the 510 Church Street project. He made a
compromise that the City will pay an additional $500.00 on this bill with the understanding that both parties in-
volved will do better in the future in communicating expectations.
Mayor Rabe, Bernie Frieden, and Marc Magers will serve on the capital improvement committee along
with the needed staff. Citizen input will be requested.
Shane Wicks discussed the need to talk to property owners about right-of-way for the trail. Mayor Rabe
and Marc Magers will also participate.
Shane Wicks distributed information about the next phase of the water improvements. This work will be
discussed during the capital improvement committee meeting and be on the March Council agenda.
Motioned by Wainwright, seconded by Magers to actjourn the meeting. Ayes: Beer,Frieden, Otto, Mag-
ers,and Wainwright. Motion carried.

PLANNING AND ZONING COMMISSION MINUTES
FEBRUARY 16, 2010
Chairman Kell called the meeting to order at 7:00 pm, Present were commissioners Kell, Hill,
Nurre,Meyers,and Kunze. Absent were Soukup and one temporarily empty position.
The minutes of the January 19, 2010 meeting were approved by motion from Kunze, seconded by
Meyers,all ayes,no nays. Motion carried,
Recommendation 2010-01, amending the ordinance pertaining to the bulk regulation graphs, was
moved to approval by Nurse, seconded by Hill, All ayes,nays none. Motion carried. Chairman Kell signed
the recommendation.
Recommendation 2010-02,amending the ordinance pertaining to definitions,was moved to approval
by Nurre, seconded by Meyers. All ayes, no nays. Motion carried. Chairman Kell signed the recommenda-
tion.
Reading and discussion of agenda item 5 regarding the definition of Visibility at Intersection resulted
in further refinement of the definition. While the previously suggested addition(more than 30 percent solid)
was accepted, later portions of the original sentence brought confusion. The fallowing was proposed; elimi-
nate the phrase'the right-of-way lines as such corner and'. This results in the sentence reading,from triangu-
lar, 'area formed by a straight line joining right-of-way lines at points which are fifty (50) feet distant from
the intersection of said lines and measured along said lines.
Reading and discussion of agenda item 6 regarding the definition of Fences also resulted in further
refinement of the definition. Since the addition of text from Visibility at. Intersection was added from the
previous meeting to align these two definitions, the same text correction is needed. The removal of the
phrase 'the right-of-way lines as such corner and' with the addition, after triangular area formed, of'by a
straight line joining right-of-way lines at points which are'fifty (50)feet distant from the intersection of said
lines and measured along said lines' completes the sentence. The following sentence regarding fences or
hedges less than four feet high remains unchanged. The last sentence needs refinement to answer the original
question that brought about the visibility and fence discussion. It was proposed that the last sentence should
read;'Fences or hedges less than seven feet high may be erected only in rear yards or interior side yards.' It is
the commission's thought this will prohibit these fences in front yards and corner side yards. This approach
utilizes the recently clarified definitions of yards. The rationale behind restricting the taller fences from cor-
nor side yards was both aesthetic and safety related. Since the adoption of the new minimum corner side yard
regulations to closely match minimum front yard setbacks,houses will be more aligned along streets aestheti-
cally. Also, taller privacy fences in a corner side yard, adjacent to a neighboring front yard, have the poten-
tial of restricting visibility not only at the intersection (addressed by the opening sentence of the paragraph),
'but along the street from neighboring driveways which could present a safety concern.
Though many of the previously discussed interpretation issues may be solved by the above edits,
new concerns arose regarding 30 percent solid text in both the Visibility at Intersection and Fences defini-
tions. It was the commission's decision to request the above changes for review at the next meeting while
asking city engineering for a clarification of 30 percent solid or three feet high. What is the history of the 30
percent restriction? May a fence or hedge in the triangular visibility area that is Iess than 3 feet high be solid?
If so,could the definition be simplified?
A reminder for commissioners to review personal schedules for their ability to attend the extension
workshop on April 7 was expressed. Time remains since the March 24 enrollment deadline occurs after the
next scheduled planning and zoning meeting of March 16.
After tabling further discussion, it was moved by Meyers and seconded by Kunze to adjourn at 8:57

REMOTE METER. READING PROJECT
Midwest Testing has begun installation of the equipment for the remote me-
ter reading project. They hope to have 90% of the city completed by Friday,
March 5.
They are going around, and knocking on doors. If no one is home, they are
leaving a door hanger. The door hanger has a contact number to call them, back to
set up an appointment if needed.
The installation is quick and easy. Some people are receiving a new meter
and the remote reading equipment, some just need the new equipment added to
their existing meter. For, those properties that currently use a digital readout, you
will no longer be able to use this device. Midwest Testing will disconnect those
wires. Until the remote reading project is up and running, you will need to take
your monthly reading right off the meter.

netINS 2010 College Scholarship Program. The aim of the annual program is to
help further higher education opportunities among high school students. South
Slope and Swisher Telephone strongly supports the youth of our communities and
are eager to support yet another valuable program.
As in the past, the program will award I up to five $1,000 cash scholarships to
youth across the State of Iowa.Applicants must be a resident of Iowa or attend
and graduate from an Iowa High School. They must be a citizen or permanent
resident of the United States or one of its official territories. Applicants must
graduate or have graduated from high school between January 1, 2010 and July 1,
2010. They must live in the trade area of South Slope Cooperative or Swisher

write a 300 word essay on "The Internet Generation: Discuss the role of the Inter-
net in your future life and career."
