Orrie Waychoff, Char- lie and Mary Waychoff 's son, related that when they were young his brother, Fletcher Waychoff, would sit in front by the sheels. Qrrie would sit in front of his father. Their mother,,, Mary, would sit behind Charlie holding Verna. They would all go to visit Aunt Fanny using this handcar. MAYOR'S MINUTE ig At the time of this writing the heat is blistering out there, in the event we have extreme heat like we have had in July- please feel free to visit our City Hall or Public Library during regular business hours to take advantage of some air conditioning if you do not have access to it at your home. By the time of this publishing we hope to be wrapping up the water main replacement program for the year- thank you to the patience and understanding of ora°neighbors along Main Street and Losey as they have been impacted by this project. Our contractor has done a good job of staying on schedule and finishing on time. We will be undertaking another future phase next year and will publish when and where the project will be taking place- this should basically wrap up our water main replacement in the original part of town. Also, by the time of publishing the RR crossing on Vanderbilt will be revamped and some street repairs will be accomplished to make this a much smoother and safer crossing. Like many of you, 1 was disappointed by the condition of the crossing after the last repair in February/March which was done by the Union Pacific- after several meetings with the regional Union Pacific representative, and undertaking some improvements to our street, hopefully we will have a greatly improved product. Last, the Hawks Ridge pavilion pad, bath- rooms and parking lot will hopefully be going in during the month of August. As I shared in my last mayor minute, we have a large slate of projects that we are planning for, saving for, and financing for all at the same time. This will provide a great efficiency of resources and cost. As we con- tinue to put the finishing touches on these projects, I hope to have information posted to our website and in the Fah-fax Facts to better educate, explain, and showcase what these improvements are and how they benefit our city. To refresh, we are looking to, over the course of the next two years, do the following projects: 1. Build a new sports/ recreation complex which will have two baseball fields with lighting, concession stand, parking for approximately 250 cars, a one mile paved trail which will hook into the current portion of the Linn Street trail we have started, two soccer fields, activity/playground facilities, batting cages, and space for a future splash pad. 2. Improve the drainage capability of the East Cemetery Road area, This will include repairing and improv- ing existing drainage ways, and installing additional drainage capability. 3, Install the trail that will connect our two parts of town. This will start from East Cemetery Road, go across Prairie Creek, and come into town near Vanderbilt Street. This will be something that will help us bet- ter unify our community, has been one of the most requested items of our citizens, and will be a great benefit to our town. 4. Replace the last portion of our water mins in the original part of Fairfax. This will finish replacing the 80 year old existing cast main and make it so our system is fully looped, more reliable, and has a higher ca- pacity for emergencies such as fire. From this point we will be able to expand or extend as future growth al- lows or to serve existing housing/commercial areas that don't currently have service. Once the final plans are set and we have some drawings, I will get them published. This park is located at 388 West Prairie Drive, The City already has already installed a walking trail, two playground systems, and swings. Eastern. Iowa Buildings, Inc. donated the material and installation of a new park pavilion. The Parks and Beautification Committee has been advertis- ing a program for sponsorship of the concrete pad under this new pavilion. That concrete pad should be poured very soon. Not that I am complaining because before we know it, it seems we'll see cooler temperatures and have to pull out those sweaters again, BUT it still is VERY hot! Manny people forget the importance of staying hydrated ... with water ... and can find themselves in a scary situation. You should drink at least S glasses of water a day. If you are working up a sweat, you should be sure to drink more than that. I actually just read an article that says you should take your weight, di- vide it by 2, and that's how many ounces of water you need at a minimum every day. So, if you are ISO pounds, you need to drink 75 ounces in a normal day. If you are sweating and out in hotter tem- peratures, you.need to up these ounces accordingly. If you are witness to someone going into heat exhaustion or even heat stroke, it is VERY important you get them cooled as quickly as possible. By packing ice under the arms, in the groin area, and be- hind the neck, you will lower one's body temperature the quickest. Heat exhaustion or heat stroke are not to be taken lightly, as it is even more dangerous than hypothermia that we hear about in the winter. If you feel faint, be sure to take shade & cool off. In addition to staying hydrated, please be sure to wear the proper sunscreen & be sure your kids are wearing sun screen as well. The W rays have been stronger this year than in past years. CITY COUNCIL MINUTES JUNE 27, 20 1.1 CITY OF FAIRFAX SPECIAL CITY COUNCIL MEETING JUNE 27, 2011 The special meeting of the Fairfax City Council was held Monday, June 27, 2011 at Fair- fax City Hall. Mayor Jason Rabe called the meeting to order at 6:00 PM. Council members pre- sent: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None, Motion carried. City Engineer Shane Wicks presented information about several different projects. There were cost estimates for two drainage projects, a trail, Phase 3 of the Water Main Replacement Pro- gram, and the development of the farm ground south of Linn Street. Proposed layouts and project options were discussed for the farm ground. Determination was made on which of the options the city council would like to include in the first phase of the development, which of those should be bonded for, and which might be paid for with Local Op- tion Sales Tax money. Mayor Rabe worked with a financial spreadsheet to review projected payments and TIF District impacts. Financing options were reviewed. A, twelve year bond seems to be the best op- tion. Timing of the TIF Districts was discussed and it was decided to proceed, with this project to maximize our use of the TIF Districts. Motioned by Magers, seconded by Beer to proceed with the engineering and at-ranging the financing for the following list of projects: two drainage projects along East Cemetery Road, Phase 3 of the Water Main Replacement Program, the trail linking the two sections of Fairfax, and Phase I of the farm ground development with the options as discussed. Ayes: Beer, Frieden, Otto,Magers, and Wainwright. Motion carried. The maintenance department has informed staff that the holiday decorations are in bad shape. The city clerk prepared a list of cost quotes for new decorations. These are on sale through the end of June. Motioned by Magers, seconded by Wainwright to purchase 18 new holiday decorations with LED lights and in the design selections as listed, for a total of$7,018.UO plus shipping. Ayes: Beer, Frieden, Otto, Magers, and Wainwright, Motion carried. John Berns informed the city council that there is a sample of the pffitted concrete pad out- side of the office. He asked everyone to view the section and give their input. Roof drainage and the size of the sections were discussed. The extra row of bricks is to be eliminated. John also talked about the placement of restrooms at Hawks Ridge Park, The best area seems to be between the parking lot and the pavilion. John suggested the City pave the trail head in this area. This area gets some water runoff and paving this trail area would make access easier. Motioned by Otto, seconded by Magers to adjourn the meeting. Ayes: Beer, Frieden, Otto,Magers, and Wainwright. Mayor Rabe will coordinate the Union Pacific's work to even out the rail crossings at the same time our work is being done so the crossing is only closed once. CITY COUNCIL MINUTES ,DULY 12 � 2011 CONTINUED Mayor Rabe opened the public hearing concerning the application of Gordon Sevig, owner of Lot 148, Prairie View Estates Part 2,Fairfax, Linn County Iowa,to change the zoning from 9 RS: Sin- gle Family Residential to C2: Highway Commercial at 7:39 PM. Several area residents were present to give input. Topics discussed were: quality of life for the area residents, traffic safety, current traffic problems in this area, costs and decisions about road upgrades,private well safety, the decision to mare this area residential at the time of platting, the large number of area residents opposed to this rezoning request, first view of Fairfax, use of transition areas between commercial and single family residential areas,peace and tranquility, lack of specifics about the rest of the property, plans for the current Casey's stare, the fact that the IDNR regulates underground storage tanks and private well regulations, the need for a traffic study, property values, a.school bus stop in the area, and the Planning and Zoning's recom- mendation to deny this request. Gordon Sevig stated ii'this is approved,he plans to sell a portion of the lot to Casey's for a store and donate the rest of the lot to the City of Fairfax. He would be willing to sign a document stating this. Mayor Rabe stated that as a condition of the rezoning, conditions can be set to address concerns. The public hearing was closed at 7:53 PM. Mayor Rabe gave an overview of the issues involved with this rezoning request. City council members discussed the rezoning,request. Topics discussed were: use of the water detention basin, com- prehensive plan, the fact that Casey's is a community asset, this governmental process and how it is working well,the fact that no residential development has been made on this property,the need for more answers to many issues, timing of the traffic study, and the Planning and Zoning Commission's motion to deny this request. Present-Nurre, Kunze, Sobaski, Boxa,Meyers, Soukup, and Kell. Absent-None. The first order of business was the approval of the minutes from June 22, 2011, meet- ing. Boxa motioned and Nurre seconded. All ayes. Motion carried. Presentation of additional information concerning rezoning request from Gordon Sevig and Casey's General Stores opened up. Gordon said he would like us to consider rezoning the whole parcel and give him six months to a year for the reception hall facts to be put in place. He stated that if he decided not to build the reception hall., he would donate the land to the City of Fair- fax. The commission didn't know if we could put a condition on a recommendation, or not and said that could be an option for hien. The discussion started between comixaittee members and it was noted that we could accept or deny any input at our discretion from public input, but it was not a public hearing. Chairman Kell thanked everyone for all of the overwhelming information and it was decided there were three main questions we needed answered- Why is commercial the best use? What does it do to our flood plain? What will this do to the traffic concerns? Sobaski brought up the flood plain and asked what would happen if 10+ houses or a Casey's gets put up to the flood plain- would that make a difference? Shane Wicks, city engineer, said the flood plain, has been mapped but a fl.00dway has not been determined. He can tell a part of Casey's area would cross into the flood plain. Building in a lloodway is usually not allowed. He: also said if it was commercial or residential, it shouldn't make a difference. Shane didn't think the IDNR would require a study on such a small parcel of land. This area was just recently in- cluded in the flood plain. This was because the guidelines were changed that determined a flood plain. Nurre brought up concerns with the existing Casey's and why the option to explore remodel- ing that area hasn't been looked into more in depth by Casey's. He felt it would naturally bring down traffic but understands that he has to do what shareholders say. He doesn't want an empty gas station sitting in the middle of Fairfax. It was determined that approximately 25% of the property tax from Casey's goes to Fairfax. The total levy is about $30.00. The City of Fairfax levy is currently $8.10 per 1,000 of taxable valuation. Soukup brought up the empty tanks sitting in the existing Casey's. She asked about what would happen to those, should it close. Casey's attorney, Krall said that IDNR mandates when tanks have to be removed, which is after the property has been sitting unused for a year. Typi- dally, Casey's will pull the tanks within 90 days to get the lot up for sale, but she stressed there were no immediate plans to close the existing Casey's. Meyers brought up traffic studies and if additional turn lanes need to be enforced before a Ca- sey's can be built, who pays for this improvement. Cynthia Stimson, city clerk/treasurer, said it is typically up to the land owner/developer to pay these costs. Sometimes they will work out deals with a city to use TIF money or other sources to help split the cost, if it is proven there would be a benefit to the city fear such,improvements or the project itself. Kunze brought up a concern with the turn. laves and how you get property owners to agree to put a turn lane on their property. Also, brought up that the north side of road is county and the south side is Fairfax. P&Z MINUTES CONTINUED JULY 69 2011 Discussion was held about the building permit process. It was explained by Cynthia if the rezoning request would be approved, that all commercial building permits must go through City Council for approval, Many of the site plan details would be worked out at that time, Sobaski asked if an option "Pas out there to rezone a portion of the parcel. It was discussed that since the request was not filed that way, we cannot treat it that way, but was clarified that if the rezoning was brought up again, it could be brought up to rezone the lot two different ways if that is what the land owner would choose to request. It was asked of Mr, Sevig why he feels commercial is the best use and why, based on that Jot, he could not make up the costs of the roads, water, and sewer to make that parcel profitable on a residential basis. It was discussed that he could put up to approximately 12 houses in that lot, Boxa referred to the comprehensive plan of Fairfax saying that we encourage Hwy 151 businesses to develop. Nurre also discussed that the area in discussion is not listed in the com- prehensive plan as moving to residential. At Sankot had said if there was another business in there with less night traffic and light pollution and less early morning traffic,he wouldn't mind a commercial business. Melody Vance said her main concerns were for the diesel trucks and the high traffic (her house is right across the street). It was asked if there a way to make it work. Lighting shouldn't be an issue with the tech- nology we have today. Jane Sankot brought up the issue of the concern of the late night traffic and people if an event center did in fact go in there in addition to Casey's. Another citizen brought up snowmo- biters in the winter driving to Casey's and cutting through yards to do so. The citizen stated that snowmobilers currently cross their property during the winter season. The proposed Casey's has eight pumps, enough to support 16 vehicles getting gas at one time. Chairman Kell said that in other towns larger than ours have 3 pumps to support their town, so we should consider the traffic Casey's could be projecting to go in there. The Casey's representatives stated that those other Casey's were older stores and this design is their new de- sign and yes it is based on the traffic projections. They pointed out that they want enough pumps that people shouldn't have to wait, No diesel pumps are recommended for this Casey's at the moment. All commission members went through and shared their thoughts of pros and cons before the vote. All agree that Casey's has been outstanding for the community surrounding Fairfax and would hate to have the opportunity pass us by for a newer and better store, but they all need to make sure that location is the best spot for it. K'rall stated that it was passed down to her that it was either the new Casey's store of the existing store would stay the same. They do not have any current plans to remodel the old store. Because there are so many variables that go into a remodel of a gas station. Chairman Kell said we have three options to vote- Recommend Rezoning to Commercial to the City Council Recommend to Deny Rezoning Request to Commercial to the City Council Recommend the Rezoning to Commercial with conditions. Kunze motioned to deny the:rezoning request. Nurre followed with a second. Ayes: Nurre, Kunze, Soukup, and Meyers. Nays: Sobaski and Kell. Abstain: Boxa. MUNICIPAL ELECTION - NOVEMBER 8, 201 There will be a municipal election on Tuesday, November 8, 2011. Two city council positions will be on the ballot as well as the mayor's position. The city coun- cil positions are four year terms. The mayor's position has a two year term. Marc Magers and Travis Otto currently serve in these city council positions,. Jason Rabe is the current mayor of Fairfax. The highest vote getter for a city council position will start serving their term right after the vote is certified, in November of 2011. This is because Travis Otto was appointed to fill a vacancy. The other city council person elected and the person elected as mayor will start serving their terms as of January 1, 2012. Candidates must be an eligible elector of Fairfax. This means you must meet the same qualifications required to vote and be a resident of the City of Fairfax. The Financial Report was reviewed noting that on page four$6779 was transferred and we only have $2000 left in savings. The bills were discussed and no one is sure about what happened to the Baker and Taylor outstanding bill and the letter we had typed and forwarded to the Mayor. Cathy assumes that it hasn't been sent since she received an e -mail from the mayor today about snaking some changes. Originally it was agreed that we would type the letter and then the Mayor would have it printed on city letterhead, making any changes to it as he needed. The board is still in agreement that we want this letter on city letterhead so Mary Rita will call the Mayor tomorrow to snake sure this gets done. When asked about the South Slope bill, Cathy said those always go through the city first to be paid on time. Bernie made a motion to approve the bills as submitted, Kelly seconded. Motion carried. Circulation and Statistic reports were reviewed. Attendance is up and so is computer usage. Budget report- Jim will get it done for next month. He stated that it is tight with the money we have. Cathy also stated that we need to add hours for story time and Mondays for someone like Tanner to work to keep up with putting things away. We are also thankful for the many volunteers we have had so far this month. Cathy would like to use the Ely rotary money on a digital camera so we can take photos of activities that would help promote the library. Dot made a motion to purchase a camera and Linda P. seconded. Motion Carried. Dot then discussed that we should have the wish list that is on the computer available when we get more dona- tions for a faster decision. Cathy has not heard about the decision with the South Slope grant. Then everyone dis- cussed that we should write thank you notes to everyone that donates money to the library,no matter the amount.. Cathy will make sure that gets done. The board discussed that Library Board member Anthony Nederhoff has resigned. He stated in his letter that he has too many work conflicts. Brenda is going to ask someone she knows is interested to see if he would like the position. Cathy will have him introduced at the city council meeting on July 12,if he is willing to take the position that will expire on July 1,2016. The Summer Reading Program is,going well. 106 children have signed up. The card catalog computer is dying. This is a computer that just needs internet access. Dot and Brenda are go- ing to look at their old computers at home for a possible donation. Cathy discussed that our current computer re- pair men think we need to straighten out cords under the computer desk in the computer room. Since the estimate was for over$1000 and our budget is tight,Cathy will get a second estimate before this is done. We need to make sure the comparisons are for the exact same job, including a sonic wall. This will be discussed at the next board meeting. The board then discussed the pest control bill. Linda Pribyl will get Cathy some names to get some new bids on thatjob. Last Wednesday, the window in the community room was accidentally broken by some kids playing ball, We- ber Glass came in with a$208 estimate. Cynthia reported it to the insurance company. The board discussed and is not sure who is responsible for this building and if the windows are going to be replaced. Weber Glass said they can do the bottom sashes and with labor and parts will be roughly $4,000. Cathy assumes that the money to fix that window and all the windows to be repaired will come out of the$5000 set aside for the building. Linda Pribyl will get Cathy the number for Daryl Julich for an estimate for the window repairs. Cathy will need to find out if we are supposed to set this up or the city. Cathy also made the comment that this happened during story hours on Wednesday and the city repair men were saying several inappropriate words with children present about the broken window. They also told her we need to monitor the kids playing outside in neighboring yards. The board said no.
