The building was located where the Waterworks now stands. Frank operated the meat market until 1922, when he sold it to Jerry Rygr. The building was razed when the City of Fairfax built the first fire station in 1937. Frank. married. Christie Petrick and they lived can Fast Main Street, later moving to the house pictured,below at the S.E. corner of kailroad and bark Streets. :His brother, Joe Boland, owned and operated the Star Hotel and Livery. 'rhe Boland family was involved in that opera- tion for 68 years. Frank sL ffered from poor health and died in 1940. Frank and Christie had no children. Christie, pictured above, was a school teacher prior to her marriage. She taught at Cloud School, Monroe Township, Johnson County. When she married it ended her teaching career. It was unheard of at that time for a teacher to be married. She held many jobs, includ- ing helping the doctor in the delivery of over 40 babies and staying with the mother and child. afterwards. Christie died December 14, 1981. I hope that everyone has a great time with friends and family; and most importantly remains safe during this time. Thank you for allowing me to be the Mayor of Fairfax for another two years. I look for- ward to the job of not only working for our city, but also working to improve myself as Mayor. Doing this job the last two years makes me thankful for those who have done the job before me and for those that will do it in the future after my time. Decently I have talked with several residents about our town and the growth we have ex- perienced over the last decade. According to the census we have grown nearly 138% - almost tripling in population during that time. I am originally from a small town in Minnesota that had just over 300 people and more recently lived in a town of 700 people. So, I guess now I live in the big city! A reason I enjoy Fairfax is that I can walk in my neighborhood or throughout town and see a friendly smile or a familiar face. I also enjoy the fact that we have growth and new people in town. Having grown up in a dying community and seeing first hand during a recent drive in western Iowa many communities withering on the vine, I see how sad this phenomena is and has become. It also made me thankful for what, we have here and work to ensure we balance the growth along with those small town attributes. HOLIDAY TIRE SAFETY Our fire fighters dont want to come to your house this holiday season. Well, at least not on a professional call. You can help to keep your family safe and avoid holiday fire damage if you follow these and other holiday fire safety tips: Install smoke detectors; & carbon monoxide detectors snaking sore batteries are flesh too. Never burn wrapping paper, boxes or other trash in your fireplace. Don't leave a fire in your fireplace unattended; put the fire out before you go to bed. ® Candles are beautiful, but make sure they are in stable and secure holders and keep thein away from combustible materials and small children. Never leave candles unattended. ® If you have a real Christmas tree, put it in a stable stand, and keep it fresh by checking the water level daily. A dried tree is more susceptible to fire. Keep the tree away from heat sources that could dry it out. Most trees dry out in two weeks, so don't leave your tree up long past the holidays. Check holiday lights for cracked or broken bulbs, frayed wires and loose plugs. Don't use :Lights that aren't safe. Use lights that have been, approved.by testing labs like Under- writers Laboratory (I1:L or Factory :Mutual (FM). Use lights only in. their designated areas; never use "indoor only" lights outdoors. If your smoke, fire, or carbon monoxide detectors go off, get everyone outside and call 911. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson and Dave Yanecek. Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None, Motion carried. Motioned by Frieden, seconded by Otto to approve and place on file the City Council minutes ftoni October 11, 2011 and October 25, 2011. Ayes: :Deer, .Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Otto to place on file the Library Board minutes from October 4, 2011 and November 1, 2011, the Planning & Zoning Commission minutes dated October 18, 2011, the Parks and Beautification minutes dated August 18, 2011 and September 15, 2011, as well as the Parks Pro- ject Task Force minutes dated October 24, 2011. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Deputy Pavelka presented the list of calls from the Linn County Sheriff s Office. Jason Evans, from the Cedar Rapids Linn County Solid Waste Agency, gave a short presentation on the Community Partnership Grant program. Fire Chief Mike Sankot reported that the fire department has purchased two new thermal imaging cam- eras and that they have some new members. Discussion was held about the fire department members' pay rates. The council reviewed the proposed rate changes. Checks are issued in December for the service from December 1 through November 30. These proposed changes are to be made effective for the paychecks issued next month. Motioned by Frieden, seconded by Otto to approve RESOLUTION NO. 2011-76, A RESOLUTION APPROVING WAGES FOR FAIRFAX FIRE .AND RESCUE DEPARTMENT MEMBERS, Rall call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Abstain: Magers. Marc Magers ab- stained because of a conflict of interest,he is a member of the Fairfax Fire and Rescue Department. Motion carried. Mayor Rabe declared RESOLUTION 2011-76 duly adopted. Dave Yanecek gave the maintenance department report. They have been checking with area businesses to try and determine how mop heads are getting into the sewer system. An article was placed in the FACT'S about this problem, The work on the lagoon should happen within a weep. They have been preparing for snow removal. We need to follow-up on street repair and as built drawings from the Phase 2 Water Main Project. Dave also:mentioned the water usage for the fiber optics project. JoAnn.Beer stated that the base of the sign is up at Hawks Ridge,Park. The Parks Project Task Force is making progress. The next Parrs and Beautification meeting is November 17 and the ncxt task force meet- ing is November 21. Motioned by Beer, seconded by Frieden to approve the financial reports. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Marc Magers asked about the progress with the tiling repair. Mayor Rabe reported the City has been working on this topic. Bernie Frieden asked about the lagoon repairs. He wanted to make sure our staff has the ability to monitor any needed repairs and determine if the problems are corrected so that the facility can function properly. Motioned by Beer, seconded by Magers to approve RESOLUTION NO. 2011-77, A RESOLUTION TO APPROVE NAMING DEPOSITORIES. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright, Nays: None. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2011-78, A RESOLUTION AUTHORIZING TIIE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT INTEREST AND FEES DUE DECEMBER 1, 2011. Roll call vote: Ayes: Beer,Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2011-78 duly adopted. CITY COUNCIL MINUTES NOVEMBER 8, 2011 CONTINUED Shane Wicks reported that, the Water Main, Phase M Project is completed. The contractor seeded the areas, although it was past the recommended seeding date. So, Hall.and Hall Engineers, Inc. is recommending full payment of the contract,except for$5,000.00 that will be held until we see if the seeding takes in the spring. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2011-79, A RESOLUTION TO IS- SUE PARTIAL PAYMENT #2 TO DAVE SCHMITT CONSTRUCTION CO. FOR THE WATER MAIN REPLACEMENT PROGRAM, PHASE III IMPROVEMENTS. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Abstain: Wainwright. Marianne Wainwright abstained because of a conflict of interest,the company she works for was a subcontractor for a small portion of the work. Motion carried. Mayor Rabe declared RESOLUTION 2011-79 duly adopted. Discussion was held about the requirements of the SRF Sewer Revenue bond, The rates are-required to generate 110% of the amount needed for principle and interest each year. This is regardless of a beginning cash balance. The city clerk/treasurer is to look into options and present an ordinance proposal at a later meeting, Mayor Rabe gave an update concerning the storm sewer re-alignment on lots 105 and 106 of Prairie View Heights, Phase 2. It was verified that the City has paid and will only pay the amount previously agreed to towards this project. Motioned by Frieden, seconded Magers to accept the storm sewer re-alignment improvements on lots 105 and 106 of Prairie View Heights, Phase 2. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe and Shane Wicks discussed the input they received from the TTAC. The committee does not seem as supportive of the project as it was in 2005. We will present our information about the specifies at their January meeting. Extensive discussion was held about the drainage in the area near the city hall property and behind the properties along Church Street. One of the residents has placed some fill and other residents are questioning the effect of this fill on their properties. A fill permit was not required from the City of Fairfax because of the size of the lot. Shane Wicks showed some exhibits of the area and discussed a proposed storm sewer. Discussion was held regarding a commercial building permit application from Melody Vance for 51 Williams 'Boulevard. Shane Wicks has not received all. of the required information, so he does not have his reconmiendation ready for council review. Some outstanding issues on the property from the first building permit were discussed. Melody feels they have all been addressed. Shane will review the first building permit paperwork and await further information regarding this new application from Melody's engineer. Information about a dog attacking another dog was reviewed. The city clerk/treasurer stated that a motion is needed to clarify the amount approved for the city hall/fire station roofing project. The amount stated in the July minutes appears to have been incorrect. Motioned by Magers, seconded by Frieden to approve the amount of$19,190 to be paid to Eastern Iowa Build- ings for the city hall/fire station roofing project. Ayes: Beer, Frieden, Otto, and Magers. Nays: None, Abstain: Wainwright. Marianne Wainwright abstained because of a,conflict of interest. Motion carried, The city clerk/treasurer made a correction to the claims list. Motioned by Magers, seconded by Frieden to approve the claims list dated November 8, 2011, as amended. Ayes: Beer,Frieden,Otto,Magers, and Wainwright. Nays: None. Motion carried. Bernie Frieden asked that Hall and Hall Engineers communicate with staff when they are in town to help avoid multiple trips and improve efficiency. Cynthia Stimson stated that she will be on vacation from Thanksgiving until December 12 and reminded the council that the recently sold bond will be funded on Thursday. Marc Magers brought his IPAD with some of the council documents loaded. During his test he found that the council packet as one file is too large to email. We will look into web based options for access to the documents. Motioned by Magers, seconded by Otto to adjourn. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. BOARD OF ADJ STMEN'T MINUTES OCT, 11 , 2411 Chairman Balog called the meeting to order at 5:57 PM. Bryan Balog, Brad Werni- mont, Gib Boxa, Tom Hill, and Ray Zarnastil were present. .Also attending were: City Clerk Cynthia Stimson, Al and Catherine Soukup, and Virginia Soukup. Al Soukup showed a drawing of his project and discussed the need. He is requesting a variance to add a 24' x 24' addition to an existing non-conforming detached garage in an 9 RS District. The current garage is non-conforming because it sits seven feet from the westerly property line and the minimum side yard set-back requirement is eight feet; and it sits 4.5 feet. from the rear lot line and the minimum rear yard setback requirement is ten feet. He wants to continue the westerly wall's placement, putting .it: seven feet from the side property line, which requires a one foot variance of the eight foot requirement. The design will match the house. if the variance is granted,he will start the project within two weeks. Bryan Balog discussed the fact that many buildings in the older section of town are set according to older codes with smaller setbacks. Al stated that the existing fence will come down and sonic concrete will come out. Gib Boxa stated that the Planning and Zoning Commission has been discussing and working on core district regulations that will help these types of projects in the older part of Fairfax. Bryan stated that old surveying results could be different, depending on where the sur- veyor started. Motioned by bill, seconded by Zwnastil to approve the one foot variance as requested for the placement of a 24' x 24' addition to an existing non-conforming detached garage at 203 Church Street in Fairfax. Ayes: Balog, Wernimont, Boxa, Hill, and Zamastil. Motion carried. The building permit process was discussed. Motioned by Zamastil, seconded by Boxa to adjourn the meeting. Staff present: Cynthia Stimson and Jason Rabe. Also present were Cory Stockton, along with his father and contractor. Motioned by Hill, seconded by Boxa to approve the minutes from October 11, 2011. Ayes: Balog,Hill,Boxa, and Wernimont. Nays: none. Absent: Zamastil. Motion carried. Chairman Balog opened the public hearing regarding Cory and Stacy Stockton's variance request submittal for 429 Front Street, in Fairfax. Cory Stockton explained his plans for a detached 26' x 26' garage. .Ile is requesting vari- ances to be able to place it in the side yard and within 14' l" from the front property .Line, He would like to see quick action by the City of Fairfax in order to get the concrete poured yet this fall. Bryan Balog stated that he met with the city maintenance personnel and determined the placement of the sewer line is just under the proposed garage's front corner, Cory stated that he did call Iowa One Call and talked to city staff about the water and sewer line placement. Cory made his map based on the information from the City of Fairfax. Gib Boxa asked if Cory had thought of attaching the garage. Cory stated that would be difficult considering the retaining wall behind the house and the proposed garage. Mayor Rabe said he talked to the city engineer and discussed possible encroachment into the sewer easement. i Toni Hill stated that he doesn't lake the idea of this large of a. front yard setback variance request. The retaining wall is now about seven feet from the rear of the proposed garage placement. Beyond the wall is the water from Twin Oaks Lake. Bryan Balog stated he isn't in favor of encroaching into the sewer easement. He suggested the meeting be recessed until a later date when more information and possibly another layout could be reviewed. Gib Boxa discussed options that Cory may want to discuss with the building inspector,. Sometimes a detached garage can be moved closer to another structure than allowed in a zoning ordinance if additional fire wall protections are put in place. He stated he feels that this lot has unique circumstances with the retaining wall,the slope of'the lot, and that fact that the back yard is I a lake. Cory Stockton stated he talked to most of his neighbors and they expressed to hien they don't have a problem with the proposed garage and obviously they have not come to this meeting to voice any concerns. Motioned by Boxa, seconded by Wernimont to recess the meeting until a future date when more information can be gathered. Ayes: Balog, Hill, Boxa, and Wernimont. Nays: None, Ab- sent: Zamastil. ELECTION RESULTS A regular municipal election as well as a state senate special 47- election were held on Tuesday, November 8. 31.92% of the regis- tered voters from the Fairfax area voted. Here are the results: For Fairfax Mayor - Jason Rabe was elected for another 2-year term. Jason received 589 votes or 96.08% of the vote. Twenty four write- . in votes were cast. .:a. Lor Fairfax {�i��ouncj�l - ;Marc Magers and 'Travis Otto were both elected to 4-year terms. Marc received 301 votes or 29.19% of the vote. Travis received 261 votes or 25.32% of the vote. Charlie Fisher received 234 votes and Kenneth Selzer received 221 votes. For State Senate District 18 - Liz Mathis was elected to the State Senate with 13,324 votes or 55.97% of the vote. Congratulations to the winners. Thank you to everyone who placed their name on a ballot. And most important,thank you to everyone who voted! October's minutes were reviewed. Giese made a motion to approve them; Kleppe seconded. Motion carried 7-0. Circulation Reports were reviewed. A. request was made to separate the preschool story time numbers from the library story time numbers. The librarians also noted that many magazines subscriptions are available at the library and are frequently checked out. Pending bills were discussed. Many DVDs were added to the library's collection. A new large print book company is now being used. Two new computer monitors have arrived; computers to follow. Meyers made a motion to approve the bills, seconded by Pribly. Motion carried 7-0. As per contract, Orkin will continue pest control through December. A Certified Pest and Ter- mite Control will start in January. The librarian noted that the carpet cleaning was completed on October 315#. Window Cleaning was discussed and delayed until Spring pending Rinds available. Overdue Policy was reviewed. The librarian will follow state guidelines to acquire long overdue items. Circulation Policy was reviewed. Changes were made to reflect the current fines and time lim- its. Kleppe made a motion to approve the amended policy. Balog seconded motion. Motion carried 7-0. A second reading of this policy is scheduled for next month, Computer Policy was reviewed and amended. Meyers made a motion to approve the first read- ing of this amended,policy. Seconded by Giese. Motion carried 7-0. The librarian's evaluation was completed by the evaluation team. The librarian will discuss with the Mayor and/or city clerk the correct method of ordering mate- rials and the possible use of the city's credit card. On future agendas, the next meeting's date will be listed at the bottom.
