The exhibit highlights the main business district in each of Linn County's existing communi- ties. The communities and the lives of individuals who called these places home, have all changed in a vast number of ways over the past 150 years. Fairfax's own Vernon Cerveny submitted items for the Fairfax display. Be sure you stop in to see our information as well the information from the other communities. This exhibit will be open 10:00 AM to 4:00 PM, Tuesday through Saturday until De- cember 31, 2011. Admission to the History Center is by donation. The Carl and Mary Koehler History Center is owned and operated by the Linn County Historical Society, a nonprofit corpo- ration. There are also other exhibits to view while you are at the History Center. They have information and displays on archaeology, Native Americans, farming, immigration, local indus- tries, and the people of Linn County. THINGS YOU MAY NOT KNOW St. Patrick Cemetery The 21-flag display at the St. Patrick Cemetery was assembled in memory of J. W. and Pat Lefebure through a memorial fund established by their family. The flag poles were installed at the cemetery by their sons: Don, Gary, Dean, and Dale as well as their grandsons: Mike, Bill, Lance, Jody, Aric, and Neil. The flags are flown each year on memorial Day, Independ- ence Day, and Veterans Day and are maintained by the sons and grandsons. Other members of the J. W. and Pat Lefebure family include Mary Ann Costigan and Marilyn Lefebure of Cedar Rapids and Raymond Lefebure of Fairfax. Fairfax Cemetery Thank you to the trustees of the John Krall Trust Fund for granting the funding for the 21-flag display at the Fairfax Cemetery. The volunteers of the Fairfax Fire and Rescue Department agreed to store and raise flags on special occasions. Our Legion Pekomy Post 9572 gave the project their guiding hand. This is a very nice tribute to our community, for both living and dead - veterans and non-veterans. THANK YOU, THANK YOU, THANK YOU! j QIP r � V. MAYOR'S MINUTE r/ The rain tried to put a damper on things during the USA Days, but before, during, and after a lot of fun Nvas had. I have to sav that those Nvere the best fireNvorks I have ever seen -good job to the Fairfax Fire Department for putting on such a good show. If you missed it, you Nvill have to check it out next Near. I also Nvant to thank the Fairfax State Sav- ings Bank and the other local businesses, individuals, and groups that put so much time, effort, and resources into mak- ing this such a fun Nveekend. It makes my head hurt to think of coordinating all of that so Nve can all come together as friends, neighbors and family to have a good time. When I first started as Mavor one of the Nvords that I Nvanted to direct my time here Nvas Unity. I see examples of this all the time in our growing tovm. Thanks to the effort of our city staff and council Nve are Nvorking quickly toNvards putting some physical practice to this Nvord. We have nearly gotten the details, financing and planning finished for two new baseball fields, a soccer field and a new concession/bathroom area along Nvith expanded parking. We are also looking to embark on some drainage improvements along Cemetery Rd and in conjunction Nvith that put in the often talked about trail that Neill truIv be a connection point between the two parts of tovm. We are also going to be putting in the final piece of new Nvater main to replace the old in the original part of tovm. It is my goal to have the financing in place and dirt turning by late fall if not early spring. So the next Near or two NN-ill see a lot of change and improvement that I believe Nvill make our toN-,n even better and unif-,T us even more as Nve have more places to connect togeth- er. There Neill be more exciting details coming as Nve go, Nve Nvill also be putting information up on our Nvebsite for you all to review and I Neill direct you to this at a later date. In subsequent Mayor's Minutes, as space allows, I Neill dig into the percentage of doN-,n payment, grants, and Nvhat type of financing Nve are going to use to do these improve- ments. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members pre- sent: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Cathy Bayne, Jeff Ammeter, Ron Dusil, and Lynn Miller. Motioned by Frieden, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to approve and place on file the City Council minutes from May 10, 2011. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Otto to place on file the Parks and Beautification minutes from April 21, 2011 and May 19, 2011 as well as the Library Board of Trustees minutes from May 3, 2011 and June 7, 2011. The Council reminded him of the USA Days celebration during the last weekend in June. Parking during ball games was discussed. Cathy Bayne stated that the library has been busy. Motioned by Otto, seconded by Frieden to accept the bid of $2,235.00 from Merta Con- crete Constriction Co. for concrete work in front of the library. Ayes: Beer, Frieden, Otto, Mag- ers, and Wainwright. Nays: None. Motion carried. Lynn Miller stated that the fire department has been busy preparing for USA Days. Mayor Rabe and Ron Dusil will be getting more information about asphalt repairs to some street areas. Bids from three different companies for work at the south entryway area were reviewed. Discussion was held about slight differences in the bids. Volunteers are lined up to maintain this area. Motioned by Frieden, seconded by Magers to approve up to $2,500.00 for this project. Lynn Miller is to review the bids and pick the best options. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Fourteen sponsors for the concrete pad have been received. Ron Dusil asked about the timing of the needed la- goon work. Hall and Hall Engineers needs to meet with EDI and work out the details. This will happen soon. Some areas are shallow because we dug out the ditches and the main was placed at the same elevation as the old main. The engineer is recommending that we seed the areas for now and check again during the sec- ond part of this project. Motioned by Magers, seconded by Frieden to approve the site plan and building permit application for a new building at 70 Williams Blvd., owners Michael and Deanna Heintz. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Abstain: Wainwright. Marianne Wain- wright abstained because the owners are her parents. Motion carried. Motioned by Otto, seconded by Magers to approve the site plan and building permit ap- plication for a storage building and awning at 522 Williams Blvd., owner Jay Hopkins. Shane Wicks stated that the storm sewer re-alignment work along Ridge Drive has been completed, but it is fidl of sediment. Gordon Sevig needs to get this cleaned out and then we can check for flow before we accept the storm sewer. An email from IDOT about fiiture bridge work along Highway 151 was reviewed and discussed. Motioned by Frieden, seconded by Magers to approve RESOLUTION NO. 2011-39 A RESOLUTION APPROVING AN IDOT AGREEMENT FOR MAINTENANCE AND REPAIR OF PRIMARY ROADS. Mayor Rabe gave a presentation on project planning and financial issues. The City Council would like to move forward with these projects. A special meeting is scheduled for Monday, June 27, 2011, at 6:00 PM to discuss the project details and review revised financial information. Mayor Rabe announced that the property owners have agreed to the main points of Op- tion 4 for the trail placement and drainage improvements. A draft of a golf cart ordinance was reviewed. Revisions will be made and this ordi- nance will be placed on the next agenda. Mayor Rabe has completed the annual employee reviews for the maintenance depart- ment and the city clerk's office. The reviews and recommended payroll changes were dis- cussed. The Library Board has already made their decisions for payroll changes for the library staff for FY2012. Motioned by Magers, seconded by Frieden to approve RESOLUTION NO. 2011-41 A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes: Beer, Frieden, Otto, Magers and Wainwright. CITY COUNCIL MINUTES JUNE 14, 2011 CONTINUED Motioned by Frieden, seconded by Beer to approve RESOLUTION NO. 2011-42 A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE LIBRARY AND FIRE DEPARTMENT 2010-2011 FISCAL YEAR END BALANCES. Roll call vote: Ayes: Beer, Frieden, Otto, Magers and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2011-42 duly adopted. Cathy Krouse asked about the status of the South Slope grant for the pavilion pad pro- ject. She also discussed a grant through Linn County Solid Waste for receptacles. An educa- tional forum will be required as part of the process. Jerry Frey, of 61 E Cemetery Road, stated that he has septic problems. He was instruct- ed to talk to Linn County Public Health. The city clerk informed the city council that there is not anything the City needs to do for the redistricting project through Linn County. Because Fairfax will be only one precinct, the Redistricting Committee will do all of the necessary paperwork. The City received an annexation notification from the City of Cedar Rapids for property on the north side of Highway 30. Motioned by Frieden, seconded by Beer to adjourn the meeting. CITY NEWS QUICKIES • Remember to keep your grass/weeds mowed. The City adopted a mowing ordinance in 2010 which sets height limits and mowing time frames as well as fines. • School is out. This means more children out and about. Drive carefully. • Water/Sewer/Solid Waste bills are due by the 15th of the month. If you have a second water meter it is now active, but it has been combined with your main meter bill. So you will receive only one bill, instead of two. You are still only being charged water for the usage on that second meter. • Be sure to keep your animals on your property and under your control. No one wants mess- es in their yard from a neighbor's animal. • If you have a digging project, be sure to call Iowa One Call at 1-800-292-8989 before you dig. They will notify the utilities to mark all lines. Stay safe when you dig. • Contact the city clerk's office to find out about building permit requirements for any building project you have planned. Building permits are not required for roofing and siding projects. • If you will be moving, contact the city clerk's office. We need to know your forwarding address and when you will be moving. • SD on your water bill stands for sewer debt. A 6 AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA ' I 9 PHASE 2 OF THE WATER MAIN REPLACEMENT PROGRAM Schrader excavating has completed the first stage of the Phase Two Water Main Project along Main Street and Siepman Road. Soukup, and Boxa. The Planning and Zoning Commission reviewed the minutes from the March 15, 2011 meet- ing. Motion to approve the minutes came from Gib Boxa and was seconded by Dennis Kunze. All ayes. Motion carried. The next item on the agenda was the presentation of the rezoning of the lot on the SW corner of Hwy 151 and Beverly Road from 9RS-Single Family Residential to C-2-Highway Commercial. JoAnn Dyar of Ankeny, Iowa spoke on behalf of Casey's General Stores. In 2006, the gas station in town was purchased by Casey's with plans to expand or rebuild with more updates, such as a frilly operating kitchen. The biggest issue is there was no sewer or eater and they are currently on septic, which would be an excessive cost to Casey's to rebuild. They wish to put a second location on the lot owned by Gordon Sevig and not replace the current Casey's. Gordon Sevig sent out a flyer asking the public to send in a response card on the citizens' opinions of a Casey's going on the lot. He sent out 1,100, received 157 cards saying yes to Casey's and 37 back saying no for Casey's. Of the cards he re- ceived back, 80%were positive feedback and 20%were negative. LeAnne Krell, the legal counsel for Casey's. had the opportunity to speak. She stated putting a Casey's on that property mould be consistent with the current use along Hwy 151. Pictures were presented on what the new Casey"s mould look like. Bob Monk, Gordon Sevig's realtor spoke and said he felt there mould be no negative effects on the surrounding property values if a Casey's were to go up there. Ms. Krell spoke about a commercial realtor/appraiser and said they've dealt with a similar issue on numerous occasions and they have not seen properties negatively affected and in some cases it has raised surrounding property values. Other points brought up were Casey's engineer sees no issues in general on rezoning this property to commer- cial. It was $228,000 to bring in mater to the site where Casey's location currently is and it will cost about $1.6 million to build a new Casey's in the proposed location. Chairman Kell requested to look at the November 2010 minutes so the board could be refreshed on all that was talked about when this was discussed in the previous meet- ing. Gordon Sevig had the opportunity to speak and restated that he wished to rezone the property to commercial. The public hearing began, under the direction of Chairman Kell. Name and address needed to be stated by each person speaking and their comments were to be held to 90 seconds. Becky Kramer- 404 Sunset Drive- Only `yes' answers were options on the flyer. Beverly Road residents didn't receive the flyers Gordon Sevig mailed out. Melody Vance- 6500 Beverly Rd- She stated that she is the property closest to the proposed Casey's enhance and she did not receive a flyer. Owns storage facilities in Fairfax,next to the existing Casey's and said the water/server would be an expensive option but believes it would be well worth the investment to revamp the current Casey's and not build the 2nd location across from her house. Beverly Suthers- 6409 Beverly Rd- Stated there was a 30' easement between their property and the lot on discus- sion and there has not been a suivey done on their property yet. She is not for the rezoning. Don Grisham-6031 Beverly Rd-Did not receive a flyer. Wondering how it affects his property value. Discussed his concerns about how the enhance would be so close to the crave and also wanted to know a traffic count as to what Casey's would bring as far as increased traffic goes. Devin Pipkin-6000 Beverly Rd-Had a whole list of issues-disappointed in Casey's lack of preparation, no docu- mentation,have not been consistent with the facts that should be presented about that location, concerned about his property value and how to be sure his property will not be negatively affected, no idea of traffic counts, wants to know the criteria the suiveyors used when looking at the lot. LeAnne spoke to answer Devin's questions. She said the commercial realtor/appraiser she talked to was in the Iowa City area, Mike Esker, and he said he believed it would be the highest and best use of the lot- #1 use being commercial and #2 use would be high density hous- ing. Traffic counts are unknown.but believes it would be minimally impacted, since not many travel a long ways out of the way to go to a gas station. With a new location,may have high traffic counts at first, and then will slow down. Once the lot is rezoned, then Casey's works on the site plan that would take into consideration turn radius of tracks/clearance/pedestrian traffic. LeAnne again spoke of it being consistent with use of Hwy 151 and corridor traffic-like the vet clinic and bank. Buffers and things like that would be brought into the site plan. James Foth- 474 Sunset Dr- Of the four corners surrounding Hwy 151 and Beverly Rd, three of the four corners are residential and it should stay-residential. John Welton- 6400 Beverly Rd- Questioned the amount of dirt being poured into the lot in discussion and he did not receive a flier. Scott Sellner- 460 Sunset Drive- Asked the Planning and Zoning Commission to remain consistent on our voting, as we have in the past. Al Sankot-468 Sunset Drive- Said a Linn Co Road Engineer he approached would not permit a Casey's enhance/ exit in the proposed area. Chairman Kell asked whose jurisdiction is the road there. Shane Wicks with Hall and Hall, city engineer, said it is a Type C enhance and would need to be moved up to a B or possibly an A. based on what a traffic study would show and that is all controlled by the IDOT. Linda DeSotel-416 W.Prairie Drive-Concerned of appraisal value of her home/property,feels the Casey's is too close to the intersection,there has been no mention of the rec center that was proposed by Gordon Sevig on the fl-er. Concerned about the noise,trucks,lights,fuel trucks and is for improving the old Casey's, not building a MAY. Jon Hill- 155 Bluff Drive-Voiced he does not want us to discourage commercial businesses from coming into Fairfax,but there is a potential for spot zoning and on the comprehensive plan, shoes this lot left as residential. C-nthia Stimson, city clerk/treasurer, said regardless if the Planning and Zoning Commission recommends to ap- prove or den-the rezoning,it would not go to the Board of Adjustment. Safety would be controlled and there would probably be more controlled traffic if a Ca- sev"s went in there. LeeAnn, Casey's Legal Council, said tax base on an annual basis,the Casey's would bring about$68,480,which is the equivalent to 17'/z homes. Patty Soukup-209 Church St-Drives Hwy 151 twice a day and is concerned about the back up of traffic for re- modeling the current Casey's. LeeAnn voiced again,it would be a 2nd location,not a replacement. There are many examples of stores that are in close quarters, some instances three stores in a one mile radius and based on traffic patterns,all are able to stay in business. The current location will not ftrlflll its function. Me-ers asked the question on if there were two stores close like these proposed stores would be, one with a functioning kitchen and one without that are still able to stay in business. The question was not answered directly,but restated that there are many locations within a one mile radius that have functioning kitchens in both that are able to sta-in business. It is up to the shareholders of Ca- se-'s and the-will determine how long the old gas station would stay open. Case-'s wants to work with the Fairfax community to deal with the community requests, such as buffers,berms, landscaping, etc It was asked of LeeAnn what the issues were on remodeling or building a new Casey's and Lee- Ann answered just the cost of the eater and sewer and also that the board said no. Chairman Kell asked what needed to be done to rebuild on the current site and Casey's replied eater and sewer. Ma-or Rabe stated that fourteen months ago the City of Fairfax worked to bring eater and sewer to the property lot line of Casev"s which would have been about$125k in costs for Casei's. Cit-v did not receive word back. Ma-or Rabe asked all of the citizens to consider what is best for Fairfax. Also asked if Fairfax gets a plan, could we reach an agreement? He doesn't want our town to miss out on a great opportunity if we can make it work for all. P&Z MINUTES CONTINUED JUNE 22, 2011 Chairman Kell asked if there is room for compromise. Arlene Schaufenbuel-406 Sunset Drive- She built a nice house in this neighborhood because no commercial was promised and now is very leery to trust Gordon Sevig again. Melody Vance voiced concern of garbage as she already picks up so much from the current Casey's when it blows onto her storage properties. LeAmre Krell told her to call Casey's and complain. Cory Fabert-6713 Coneflower-He was told ten-twelve houses would be put up in that land. Worried his house will move into the flood zone,as he already had to go through suixeyors to get his removed from the flood zone. Was told the water flood zone will be determined by how much concrete is put in that lot. Currently,his property is out of the flood zone bi-inches. Chairman Kell closed the public hearing,but voiced the concern to make sure the citizens both for and against the rezoning request follow the process and it isn't over. Chairman Kell stated our board had three options,move to approve the request to rezone the property with a second,move to deny the request with a second, or move to table the request,review the notes,vote at a later date,with a second. Sobaski motioned to table, seconded by Nurse. Ayes: Sobaski,Meyers,Kunze,Kell,and Soukup. Gib Boxa stated he was advised not to vote because of a possible conflict of interest since he does business with Gordon Sevig. Motion carried. Library Board Minutes June 7, 2011 Board Members present: Many Rita Meyers, Jim Stallman, Bernie Kleppe, Linda Balog, Brenda Haendler, Dot Pospischil, Kelly Giese, and Linda PribvI. Board Members excused: Tony Nederhoff. Staff Present: Cathv Bavne, and Beth Wilz. Also present Nyas Mayor Jason Rabe. Mani Rita Mevers called the meeting to order at 7:00 pm. Mavor Rabe attended this meeting to make the final decisions on the Balser & Taylor outstanding invoices. Even-one Nyas in agreement that it has been too long, too old, no one gets a response from them but Nye Neill pay the invoices from 2010. Linda B. made a motion to not pay anything past our fiscal Near because of budget constraints. Dot seconded. Motion carried. The city has spent too many hours and time on this bill.
