RECOLLECTIONS OF THE PAST
HISTORY OF FAIRFAX, IOWA
This is taken ftoin the front page of'the 1936 City of Fairfax ininute book.
Early in May, 1936 about 26 citizens of the village of Fairfax, Iowa met in the American
Legion Hall of Pekorny Post 9572, Fairfax, Iowa for the purpose of discussing the advisability
and possibility of incorporating the town of Fairfax,
After a long friendly discussion upon the subject of incorporating, and the possible
benefits and/or disadvantages, to an incorporated town such as Fairfax a vote was taken on
whether or not an attempt should be made to incorporate and the result was that 25 of the 26
citizens were in favor of incorporating and one was non-commital.
A cominittee consisting of James Yaneeek, John Wavra and John,, L. Krall was ap-
pointed to consult with Wayne C. Boland, Attorney, Cedar Rapids, Iowa relative to preparing
the necessary petition to the HON. DISTRICT COURT OF FINN COUNTY, IOWA, which
petition was to be signed by the required number of qualified electors of the proposed incorpo-
ration, asking said court to approve the incorporation and appoint five commissioners to hold an
election. This petition was signed by approximately 55 qualified electors and submitted to the
Court, together with photostatic copy of the official plat to be embraced in said Town of Fair-
fax.
The court appointed C. J. Knickerbocker, Win, Behle, Chas J. Dvorak, John Wavra and
Frank J. Moynihan commissioners to hold an election upon the question of whether or not to
incorporate and to do such other duties as prescribed by law.
The Commissioners filed proper notice of the election to be held on Monday, July 20th,
1936 at the public school in the village of Fair.rax.
The election was held on the date scheduled at which there were 129 ballots cast; 105
being in favor of and 24 opposed to incorporating. The result of the election was submitted to
the court whereupon the court approved the incorporation and ordered said commissioners to
hold an election for the purpose of electing officers of the town.
On August 10, 1936 a caucus was held in the American Legion Hall at Fairfax for the
purpose of nominating officers. Nominations made at this caucus at which John L. Krall acted
as Chairman and Chas J. Knickerbocker acted as Secretary were as follows:
For Mayor, Win. Behle; For Treasurer, E. F. Listebarger; For Assessor, James Yanecek
and for Councilmen; C. J. Knickerbocker, Chas J. Dvorak, C. E. Heaton, John Wavra and Frank
Moynihan.
The election, for the purpose of election of town officers, was held August 24, 1936 re-
sulting in the election of the above nominated officers, which officers were to serve 'until the
next regular election which is to be held in March, 193 8.
The Newly elected council met on the first Monday after election, August 31, 1936, at
12 o'clock noon to organize from which time the Town of Fairfax, Iowa (Incorporated) really
existed.

MAYOR'S MINUTE
Just today I had the opportunity to sit down with our maintenance staff and review our list of things we
need to accomplish for this year. It is an extensive list that ranges from firrther park enhancements, street re-
pair, street sign upgrades, and drainage improvements to water/sewer system maintenance. As well as, ac-
tively managing our next round of water main replacements, this should be a busy summer in our growing
community.
It is already that time of year where as a.council, staff, and other various members of our, community such
as Planning R Zoning, the'Fire :Department and the Library Department get together to review and adjust our
5 and 10 year Capital Improvement Plan. My goal is to get this into a publishable form so that you can see
this `living"plan, which will also highlight prior year accomplishments. As a direct part of this plan, we will j
also be looking at how to properly use the 52 acres the city owns as it relates to sports complexes, a commu-
nity center, a city building, etc.
As many of you probably have already seen, our new 2010 Census population is 2,123. This is a 138%
increase over the last decade. This is an exciting number, which positively impacts us in several key areas.
First, our road use funds that we receive from the state will increase from $153,735 to $199,562. This fund
helps with road repair, snow removal,personnel, and equipment. It will also directly affect the portion of the
local option tax that we receive. we don't necessarily have a number for that; it just means we will be get-
ting a larger portion.

Do you like snaking all of your payments online? If so, you can now pay your
City of Fairfax utility bill online using your checking account or your credit card.
Debit cards can be used if they are able to be used as a credit card.
There is a $3.95 convenience fee for each transaction made through this ser-
vice. This fee is not charged by the City of Fairfax or Fairfax State Savings Bank,
who has arranged for this service to be available. This is a fee that the processing
company charges to provide the service and they keep the entire $3.95.
You can pay your bill by going to the City of Fairfax's website at:
www.fairfaxia.com and following the link that is right on the front page. You
will have to have your City of Fairfax account number, amount due, name and
contact information, as well as your banking or credit card information..

FAIRFAX FIRE AND RESCUE
February was a busy month for all of us here on the Fairfax Fire Department! First, we
would like to congratulate EJ &Trish Brink on the birth of their,baby boy, Porter. Also, Der-
rick& Sam Sexton welcomed their baby boy, Beckett, at the end of February! We had a few
certifications occur this month also. Derrick Miller, as well as, Derrick Sexton, completed their
EMT B classes and the whole fire department went through their HAZMAT (hazardous materi-
als),recertification.
We had ataste of some nice weather in our towns this month which hit many of us with
Spring Fever! Please be aware When you are driving at dusk or dawn, as well as the rest of the
day, we are going to see more walkers and kids riding their bikes. We would highly recom-
mend to anyone that is going to be on our streets to purchase reflective gear. They have reflec-
tive shoes,pants, dog collars, and many other items that can help to keep our active town mem-
bers safe when out and about! If you are driving and see something reflective, please use cau-
tion, as it may be a neighbor.
From all of us at the fire department have a great March—winter is FINALLY almost
over!

BOARD CHANGES
The City Council has appointed Annie Sobasi to the Fairfax Planning and
Zoning Commission. Thank you,Annie, for your willingness to serve.
The City Council made another appointment during their meeting on February
8, 2011. They appointed Gib Boxa to the Board of Adjustment. Gib already serves
on the Fairfax Planning and Zoning Commission. This crossover of a member will
help give each board an added perspective while discussing issues. Thank you Gib
for being willing to serve on two boards.

REGULAR CITY COUNCIL MEETING
FEBRUARY 8, 2011
The regular meeting of the Fairfax City Council was held Tuesday, February 8, 2011 at Fairfax City Hall.
Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden,
Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Ron Dusil, and
Cathy Bayne.
Motioned by Wainwright, seconded by Frieden to approve the agenda, Ayes: Beer, Frieden, Otto, Magers,,
and Wainwright. Motion carried.
Motioned by Frieden, seconded by Magers to approve and place on file the City Council minutes from Janu-
ary U,2011 and January 25,2011, Ayes, Beer,Frieden,Otto,Magers, and Wainwright. Motion carried.,
Motioned by Beer, seconded by Magers to place on file the Planning and Zoning Commission minutes from
January 18,2011 and January 24,2011. Ayes: Beer,Frieden,Otto, Magers, and Wainwright. Motion carried.
Linn County Deputy Sheriff Pavelka presented the list of calls.
Cathy Bayne stated that the library's roof is leaking,they have a now computer server, and that she is work-
ing on a grant.
Ron Dusil stated the maintenance department has been busy plowing snow. He and Lynn Miller made a trip
to Des Moines to look at the new truck and to view a used truck at Clive. The new truck looked good and should be
ready soon. They are not interested in the used truck. The well casing is in but Northway is waiting for warmer
weather to grout.
JoAnn Beer announced that the next Parks and Beautification meeting is February 17 and that they need more
active members. Mayor Rabe distributed a drawing of the proposed donated pavilion. Shane Wicks will chock on the:
size of the level area for the pavilion.
Motioned by Beer,seconded by Frieden to approve the-financial reports. Ayes: Beer,Frieden,Otto, Magers,
and Wainwright. Motion carried.
Shane Wicks informed the City Council that be will talk to the[DOT about the trail progress.
Elizabeth Cwik made a presentation about Greater Cedar Rapids Community Foundation grant opportunities
from the Linn County Fund. This is redistributed gambling money that the State of Iowa gives to the counties. The
large metropolitan areas cannot apply,
Parker Krouse made a presentation about the need for more baseball/softball diamonds in Fairfax. He sug-
gested using a portion of the farm ground south of Linn Street.
Joe Kell gave the city council an update about Fairfax Youth Sports Association, They had over 235 children
participate in 2010. They expect an increase,have plans to add two more Little League teams, and to start a fall Pee-
Wee Soccer League. He also stated that in 2010 they had over 70 regular season baseball/softball games in Fairfax as
well as some tournaments. He presented a layout of a baseball/softball diamond complex to use about 10 acres of the
farm ground south of Linn Street He asked the City Council to look at ways to make this project happen within the
next i-woyears. Planning would need to begin soon. foe requested that FYSA be allowed.to have an announcement
line set up through South Slope and associated with one of our existing telephone numbers. There is a small setup fee
and a monthly fee of$4.00. He also asked that FYSA be allowed to do two mailings through city hall. One will be
for the baseball/softball sip-up and the other for soccer sign-up.
Magers asked about the start-up costs for two additional Little League teams and the new soccer league.
Motioned by Magers, seconded by Beer for the City of Fairfax to give Fairfax Youth Sports Association
$2,000.00 from the Local Option Sales Tax Fund,this fiscal year,to help cover their additional costs associated with
expanding their activities and the anticipated increase in participation. Ayes: Beer,Frieden,Otto,Magers, and Wain-
wright. Motion carried.
Wainwright introduced ORDINANCE NO. 115, AN ORDINANCE AMENDING THE FAIRFAX
CODE OF ORDINANCES OF 2007, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING PROVISIONS
PERTAINING TO SEWER SERVICE CHARGES.
Motioned by Magers,seconded by Frieden to suspend the,rule requiring that an ordinance be voted on for
passage at two council meetings prior to this meeting with respect to ORDINANCE NO. 115, Roll call vote: Ayes:
Beer,Frieden,Otto,Magers,and Wainwright, Nays: None, Motion carried.
CITY OF FA FAX UTILITY BILLING INSERT
The City of Fairfax bills residents for water, sewer, and garbage services.
This insert will give you an overview of our process and let you know about a few
changes we are making. If you have any questions after reviewing this
information, please contact the city clerk's office at 319--846-2204. Feel free to
keep this insert for future reference.
The city clerk's office is located at 525 Vanderbilt Street. There are two
drop boxes available 24/7 at the city clerk's office. One is a standalone drive-up
box and the other is a drop slot through the side of the building, located near the
door to the city clerk's office. Our mailing address is, PO Box 337, Fairfax, IA
52228. Regular office hours are 7:30 AM— 4:00 PM, Monday—Friday.
You can sign up to have your bill automatically deducted, from your
checking or savings account. This is a free service. Accounts are debited on the
10th of the month. You can find the form to sign up on the City's website at:
www.fairfaxia.com (you will find the form on the documents page) or stop at the
city clerk's office. You will need to bring your banking information and be an
authorized signer on the bank account.
You can also pay your bill online. There is a $3.95 convenience fee to
process each payment. This is a fee the processing company keeps. The City of
Fairfax is not charging for this service. You can choose to have the bill deducted
from your checking account or use your credit card. You can find the link to make
an online payment on the City's website at: www.fairfaxia.com . There is a link
right on the home page.
There will be a few changes in the appearance of your utility bill over the:
next couple of months. The first change will be that we will separate out the sewer
debt service charge on its own line. This is a flat amount that has been a part of
your sewer charge amount for a few years. This debt service charge is the amount
the City of Fairfax needs to collect to make the debt payments on the loan for the
sewer treatment facility. You will now have one line of sewer charges for the:
amount due based on.your usage and another for this sewer debt service amount.
The City Council reviews the amount needed, to collect for all utilities on an
annual basis. They do this to ensure the utility systems can meet all of their
obligations. During their annual review in January, they determined that the sewer
debt service amount needs to be raised from $13.00 per month to $15.00 per
month. This charge pays for the new Sewer Treatment Facility the City was
required to install by the DNR. No other rate increases were needed at this time.,
During their meeting on February 8, they passed an ordinance raising this sewer,
debt service amount to $15.00 per sewer account, per month, effective February
19, 2011. So, your next bill will include the $2.00 increase in the sewer debt
service charge amount.
The next change in the appearance of your utility bill will be when we
activate the outside meters. Many homes have two water meters. One for the
water usage inside the house and another for the water usage outside. Sewer
charges are not collected on this outside water usage. Also, these outside meters
are not billed during the cold winter months. Previously, you received two
different bills for these meters. We will be combining the two accounts for these
addresses. When the outside water meters are made active, you will receive only
one bill. The outside meter will be listed as another water service on your bill.
You will be able to see the separate charges. These changes to the appearance of
the bill are being made to make the billing system more efficient.
The city clerk's office issues utility bills on a monthly basis. Meters are read
using the new remote meter reading system on the 20"' of the month. If the 20'h
falls on a weekend, meters will be read the first business day after the 20th. The
information is then inputted into the system and the bills are mailed the last
business day of the month. These bills are due by the 15'h of the following month.
A late fee of$15.00 is added to each account that has an outstanding balance due
of $5.00 or more. The City Council has enacted a policy that will give each
account a one-time waiver of this $15.00 late fee. A delinquent notice is mailed on
the 16'h of the month to all residents who still have an amount due. Service will be
disconnected if payment is not received by the 25th ofthe month. If these due dates
fall on a weekend or holiday, the due dates will move to the next regular business
day.
CURRENT RATES:
Water and sewer services are billed based on your water usage.
Water:
First 1,1500 Gallons $6.00 (Minimum)
1,501 to 25,000 Gallons $6.00 plus $3.50 per 1,000 gallons
over 1,500 gal.
Usage over 25,000 Gallons $88.25 Plus $2.34 per 1,000 gallons
over 25,000 gal.
Sewer:
First 1,500 Gallons $6.90 (Minimum)
1,501 to 25,000 Gallons $6.90 plus $4.00 per 1,000 gallons
over 1,500 gal.
Usage over 25:,000 Gallons $100.90 plus $2.18 per 1,000 gallons
over 25,000 gal.
Sewer Debt Charge:
Every sewer customer is billed $15.00 per month
Garbage:
Single Family Residences are billed $11.00 per month

Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2011-11 duly adopted.
Mayor Rabe gave an overview of the issues involved with the proposed LOSST vote scheduled for May 3.
Our city attorney and Mayor Rabe are recommending that Fairfax vote as a block with Cedar Rapids.

ING FOR A PUBLIC REFERENDUM TO AUTHORIZE THE IMPOSITION OF A LOCAL SALES AND
SERVICE TAX IN THE CITY OF FAIRFAX, IOWA, AT THE RATE OF 1%. Roll call vote: Ayes: Beer,
Frieden,Otto,Magers, and Wainwright. Nays; None. Motion carried. Mayor Rabe declared RESOLUTION 201.1-
12 duly adopted.
Discussion was held about Kathy Everett's initial progress report.
Motioned by Wainwright, seconded by Frieden to approve a raise of 50 cents per hour for Kathy Everett ef-
fective as of the date 90 days after the date she started full-time at the city clerk's office and also to approve RESO-
LUTION 2011.-13, A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll Gall vote: Ayes:
Beer,Frieden, Otto, Magers, and Wainwright. Nays; None. Motion carried. Mayor Rabe declared RESOLUTION
2011-13 duly adopted.

Parker Krouse volunteered to help the Parks and Beautification Committee and with the FYSA's mailing.
Mayor Rabe announced that. May 14, 2011 will be the date of the city-wide clean-up day and that Lunn
County Solid Waste Agency will be on hand with their mobile Hazardous Material.Unit.
Discussion was held about establishing a committee to work on a plan for the use of the farm ground south of
Linn Street. It was decided that the entire City Council would like to participate,so a special council meeting will be
held on February 22 or 23.
Motioned by Frieden, seconded by Magers to adjourn the meeting. Ayes: Beer, Frieden, Otto,Magers, and
Wainwright. Motion carried.

February 15"', 2011
Chairman Kell called the meeting to order at 7:00 p.m. Members present., Boxa,Kell,Kunze,Meyers,Nurre,
Sobaski, and Soukup . We went through an introduction of all of our existing members and also the introduction
of our new member,Annie Sobaski.
Motion to approve minutes from January 25, 2011 was given by Virginia Soukup and seconded by Dennis
Kunze. All ayes. Motion carried.
Motion to approve the minutes from January 18, 2011 was given by Dennis Kunze and a seconded by Jamie
Meyers. All ayes. Motion carried.
Shane Wicks,our city engineer,presented the old zoning map and displayed the issues of the old zoning map,such
as some zoning codes that are no longer valid, as well as many other discrepancies. Nine revisions were reviewed
that would help to improve the quality of our zoning map. We made a lot of progress to clean up our zoning map
and next month the map should be;in the final stages.
Discussion of setting up an open house for citizens to review the changes was brought up and once we are in the
final stages,we hope to set this up.
It was announced that Gib Boxa is now on the Board of Adjustment and will be a great attribute to tine board.
No other citizens were present.
Motion to adjourn the meeting was given by Gib Boxa and seconded by Tom Nurre. All ayes. Motion carried.

TO BE CONTIGUOUS OR NOT TOBE...
The above question was posed to the City, of 'Fairfax recently by the Linn
County Board of Supervisors in regards to Fairfax and. Cedar Rapids concerning
the issue of Local Option Sales and Services Tax vote. If we chose contiguous we
would vote with the block of Cedar Rapids, Marion, Hiawatha, and Robins. If we
chose not to be contiguous we would vote on our own.
We chose to be contiguous with Cedar Rapids. We felt this was the best option
as it would have us go along with where we all spent the majority of our money
and it wouldn't put Fairfax at a disadvantage with the other communities. If we
weren't considered contiguous and voted separately, we could choose to adopt the
tax or not. However, if we passed the tax and the "block" didn't, we would be
subjected to it and put our businesses at a comparative disadvantage with little
benefit. If we happened to not pass the tax and the "block" did, we would not
have it in our community, but where we spend the bulk of our dollars we would be
forced to pay the tax with no benefit to our community (which in the last year has
provided nearly $250,000 as has been detailed in our published LOST report).
While there is no clear cut best answer, it was our goal to make sure that we
weren't at a disadvantage with the rest of the surrounding communities if it didn't
pass and that we still received our portion if it did pass. Linn County has taken
action to set the date for this LOST vote as Tuesday, May 3, 2011.
