Fairfax looked great! CHRISTMAS TREE PICKUP Johnson County Refuse will be doing one Christmas tree pickup this year. The date is: • Tuesday, January 10, 2012 Trees must be placed at your curb by 7:00 AM, be real trees, and have all of the decorations and stands removed. ' Flocked trees have to go with your regular garbage, but they do not require an extra tag. FAIRFAX LOCAL OPTION SALES TAX REPORT The City of Fairfax receives fiinding from the Local Option Sales Tax which was enacted in Linn County in 2008. The City began receiving funds in June of 2009 with the option to use the money for any legal purpose. The City has several goals related to the use of the fiinds. The first is that we would like to maintain a $100,000 reserve balance for an emergency. Secondly, we want to use it as a fiind- ing source with planned expenditures. You can sign up to have your water/sewer/solid waste bill automatically taken from your bank account each month. This service is convenient and free. This will eliminate any late fees. You will still receive your bill so you know the amount that will be deducted. The amount is taken out around the 10th of each month. If you sign up before month end, it will start with the next bill. Stop at the city clerk's office to fill out a form! o MAYOR'S MINUTE �J The years seem to be flying by faster all the time. My Grandpa used to tell me that the older you get the faster time goes - I think he was right. I hope everyone has a successful 2012. This time of year, as I have shared in the past, is when we start studying and setting the budget (our fiscal years start on July 1st) and reviewing our Capital Improvement Plan. As a city staff we also try to catch up on ordinance updates, plan projects for the coming year, and update/change various office and personnel policies. Being in a geographical location where the seasons limit when we can do most outside projects provides a perfect opportunity to work on these non-weather impacted projects. In 2010 we installed a central server at city hall and in 2011 we upgraded our city finan- cial software. These were computer enhancements that help us be more efficient. We have several spreadsheets, such as the Capital Improvement Plan, that help us review the City's posi- tion and plan for the future. We are in the process of having the city council run a more elec- tronic based meeting so that information is easily accessible, presentable and viewable during that meeting. In the next few months we hope to have these planning spreadsheets, maps, as well as the council packet information available on our website. This will put the information at our and your fingertips to access and review. The world has become so much more comput- er based over the last two decades and having a council/city hall that is more computer based will greatly enhance the knowledge and productivity of our city hall and our city council meet- ings. Knowledge and information is powerful and the more that we have readily accessible at our fingertips enables us to make better decisions. I look forward to working for the city again this year. D AND SURROUNDING There are over 8,000 people that visit hospital emergency rooms each holiday sea- son for injuries involving cuts, electric shocks, or falls that are related to decorations in their homes. I hope you have some time to read over the tips below to be sure your family and anyone who visits your home has a safe holiday! VisitorsNisiting Tips • Clean up after a party immediately if pets or children are around. This will re- duce the risk of a child or pet getting into anything they can choke on, get in- jured with, or drink that is not safe. • The Poison Hotline number is 1-800-222-1222. Keep this handy if you do have little children, to be sure if something is ingested you can get help immediately. Another suggestion is to keep this, along with the fire and police departments' numbers and 911, laminated on your refrigerator and in your wallet. • Keep hot foods away from edges of tables or counters where they could fall and injure you or a toddler nearby. • Food that needs to be thawed should not be on a countertop for thawing, but ra- ther in a refrigerator. Also, any food that needs to be refrigerated should not be left out for longer than two hours. • Be sure if you are drinking, that you have a designated driver. There are SO many families traveling around this time of year- the last thing we want to see is an accident involving your family or another due to drinking. With 2012 beginning, I want to take a moment to thank everyone who works for the City of Fairfax or Walford. Our town would not be a town without the people that keep up on our day to day tasks, nor would we even be able to function without our different committees, city council, clerical staff, and the mayor. Our town has made so many improvements throughout this past year & thanks to the citizens that serve in these positions listed above, we will see many great changes in the future. Being a firefighter's wife, I would like to take a moment to truly thank our fire de- partment. Our fire department gives our town a sense of "safeness", one that makes many of us want to live in Fairfax for years down the road. The men & women of the fire department see many different types of calls every year. To others, the calls may seem unbearable and yet to these men & women, it is just their duty to report to the station with the sound of their pager. So, again, thank you for serving our great town. Mayor Jason Rabe called the meeting to order at 5:30 PM. Council members pre- sent: JoAnn Beer, Travis Otto, and Marianne Wainwright. Bernie Frieden and Marc Magers were absent. Shane Wicks entered the meeting at 5:34 PM. Other city staff present: Kathy Everett. Residents in attendance: Cory Stockton and Gary Stockton. Motioned by Beer, seconded by Otto to approve the agenda. Ayes: Beer, Otto, and Wain- wright. Nays: None. Absent: Frieden and Magers. Motion carried. Mayor Rabe stated that the Board of Adjustment approved a variance to allow Cory Stock- ton to build a 26'x26' detached garage in a side yard, and five feet from an existing stricture at 429 Front Street. The placement of the garage will result in an encroachment into the existing sewer easement, and council action is needed to allow the garage to be built as planned. Motioned by Otto, seconded by Beer to approve RESOLUTION NO. 2011-80, A RESO- LUTION APPROVING A BUILDING ENCROACHMENT INTO A SANITARY SEWER EASEMENT, LOCATED ON LOT 5, SELZER'S LAKESIDE ADDITION TO FAIRFAX. Ayes: Beer, Otto, and Wainwright. Nays: None. Absent: Frieden and Magers. Motion carried. Mayor Rabe declared RESOLUTION 2011-80 duly adopted. The city engineer has determined the sewer line located on Lot 5, Selzer's Lakeside Addi- tion to Fairfax, is not centered in the existing sewer easement and that changing the location of the easement would be beneficial to the city and the homeowner. The City would vacate the existing sewer easement, and require the homeowner to dedicate a portion of Lot 5 to a new sanitary sewer easement. In order to consider vacating a sanitary sewer easement, a public hearing must be held. Motioned by Beer, seconded by Wainwright to approve RESOLUTION NO. 2011- 81, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING CONCERN- ING VACATING A SANITARY SEWER EASEMENT. CITY COUNCIL MINUTES DECEMBER 13, 2011 REGULAR CITY COUNCIL MEETING DECEMBER 13, 2011 The regular meeting of the Fairfax City Council was held Tuesday, December 13, 2011 at Fairfax City Hall. Mayor Jason Rabe called the meeting to order at 7:00 PM. Council members present: Bernie Frieden, Marianne Wainwright, Travis Otto, and Marc Magers. JoAnn Beer was absent. Other city staff present: Cynthia Stimson and Dave Yanecek. Motioned by Magers, seconded by Frieden to approve the agenda. Ayes: Frieden, Wainwright, Ot- to, and Magers. Nays: None. Absent: Beer. Motion carried. Motioned by Otto, seconded by Magers to approve and place on file the City Council minutes from November 8, 2011 and December 2, 2011. Ayes: Frieden, Wainwright, Otto, and Magers. Marc Magers reported that the fire department is looking into purchasing a new rescue trick. Dave Yanecek stated that the maintenance department has been preparing for winter. The utility reports and annual report were reviewed. The other financial reports are not ready due to the city clerk/treasurer being on vacation until yesterday. Shane Wicks reported that the diffuser at the sewer plant has been adjusted. The plant is working as it should be, except we are still adjusting a gauge. A tear was caused during the repair. Discussion was held concerning the contract with the Linn County Sheriffs Department for police protection services. Mayor Rabe will contact Linn County about possible changes in their reporting of in- formation about the calls. Motioned by Frieden, seconded by Magers to approve RESOLUTION NO. 2011-82, A RESOLU- TION APPROVING THE CONTRACT FOR LAW ENFORCEMENT SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF'S DEPARTMENT FOR FISCAL YEAR 2012-2013 BUDGET. Roll call vote: Ayes: Frieden, Wainwright, Otto, and Magers. Nays: None. Absent: Beer. Motion carried. Mayor Rabe declared RESOLUTION 2011-82 duly adopted. An amended tree policy was discussed. Changes are to be made to address trees on commercial property and more discussion is needed concerning the residential options. The city clerk/treasurer informed in the city council that the Linn County Board of Supervisors has called for a LOSST election on March 6, 2012. They require the ballot language by January 3. Discussion was held about the use of LOSST fiinds and the sunset date. Motioned by Magers, seconded by Frieden to approve RESOLUTION NO. 2011-83, A RESOLU- TION CALLING FOR A PUBLIC REFERENDUM TO AUTHORIZE THE IMPOSITION OF A LOCAL SALES AND SERVICE TAX IN THE CITY OF FAIRFAX, IOWA, AT THE RATE OF 1%. The mayor and clerk were directed to check on specifics about coverage and other re- newal options. Mayor Rabe opened the public hearing concerning vacation of a sanitary sewer easement and dedication of a new sanitary sewer easement on Lot 5 of Selzer's Lakeside Addition at 8:22 PM. The city clerk's office has not received any input other than from the address owner, Cory Stockton. Cory was present to discuss the easement placement. Shane Wicks presented exhibits showing the old and new easement placements. Mayor Rabe closed the public hearing at 8:27 PM. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2011-88, A RESOLU- TION VACATING A SANITARY SEWER EASEMENT AND DEDICATION OF A NEW SANI- TARY SEWER EASEMENT. Discussion was held concerning the commercial building permit application from Melody Vance for 51 Williams Boulevard. Shane Wicks discussed his recommendation's conditions. Motioned by Frieden, seconded by Magers to approve the commercial building permit applica- tion from Melody Vance for 51 Williams Boulevard per Hall and Hall Engineer's recommendation and to not issue any occupancy permit until the property is in compliance with the City of Fairfax code and all conditions as stated in the engineer's recommendation. Ayes: Frieden, Wainwright, Otto, and Mag- ers. Nays: None. Absent: Beer. Motion carried. Mayor Rabe read his oath of office for mayor. Marc Magers read his oath of office for city council member. It was noted that Travis Otto already gave his oath of office due to the fact that he started serving his new term as soon as the vote was certified. CITY COUNCIL MINUTES DECEMBER 13, 2011 CONTINUED A notice of voluntary annexation into the City of Cedar Rapids was reviewed. The city clerk asked who would be doing the holiday decoration contest judging. Marc Magers and Marianne Wainwright will serve as the judges. Marc Magers asked about the status of designating a core district. Shane Wicks is working on the project and the Planning and Zoning are aware it will be back on their agenda soon. Bernie Frieden stated he attended a legislative meeting recently. He encouraged the council and staff to keep informed about the property tax reform debate and any possible changes to TIF regulations. He stated that the City of Fairfax's position may or may not the Iowa League of Cities' position. Motioned by Frieden, seconded by Magers to adjourn. Ayes: Frieden, Wainwright, Otto, and Magers. Chairman Balog opened the public hearing regarding Cory and Stacy Stockton's variance re- quest for constriction of a 26'x26'detached garage at 429 Front Street, noting the new drawing submit- ted and the information received by email from City Engineer Shane Wicks. Cory discussed the new proposed layout. Changes have been made based on suggestions of- fered at the November 16"' meeting. The front of the garage is moved back to meet the 25 ft. front yard setback requirement. The proposed distance between the garage and the existing stricture is 5 ft., and additional fire wall materials will be used in constriction of the garage. Hall & Hall has marked the sewer line. Chairman Balog asked if there were any further questions. There were no questions. Balog called for a motion to approve the variance request. Hill motioned to approve the variance as requested to place a 26'x26' detached garage in a side yard and five feet from the house. Zamastil seconded. Ayes: Balog, Hill, Wernimont, and Zamastil. Members Present- Boxa, Soukup, Nurre, Kunze, Sobaski, Meyers. No members were absent. First item was to review the minutes from the October 18, 2011, meeting. Nurre motioned to approve, seconded by Kunze. All ayes. Motion carried. We went over the implementation schedule on the comprehensive plan. We are making a list of recommendations to review and possibly move up some of the events in the years we'd like to see them completed. One of the key points discussed was to be sure we are plan- ning enough park space for our growing town. A sign has now been put up by parks and recreation for our new Fairfax complex that is going up along Linn Street. Chairman Kell will be submitting a list of changes for the implementation schedule. Motion to adjourn by Meyers at 8:15 and seconded by Sobaski. All ayes. Motion carried. Even though it doesn't look like it yet, winter is definitely here. There are many issues to re- member concerning snow. Be sure to drive and walls carefiilly. Slick conditions are beyond our control and can set in very fast. If you don't have to be out during a storm, please stay in and stay safe. Remove all vehicles from the street parking areas during a winter storm. Don't place them back on the street until the snow has stopped and the street has been plowed. The snow plows are much more effective when they can pass through the street easily and straight along the side of the road. Vehicles on the street must be moved every 24 hours, regardless of weather conditions. It is the responsibility of the abutting property owners to remove snow, ice, and accumulations promptly from sidewalks. If a property owner does not remove snow, ice or accumulations within a rea- sonable time, the City may do so and assess the costs against the property owner for collection in the same manner as a property tax. Be kind to walkers and help make their pathway clear. The snow plows deposit the snow along the side of the road. This means that you will have snow placed in the area of your driveway, mailbox, and sidewalk. The post office will not deliver your mail unless the driver can access the mailbox. The City may make multiple passes to keep the street area clear. This may require you to clean these areas more than once for each storm. There is no way to avoid this snow placement. When you remove the snow, do not place it back in the street or on some- one else's property. You are liable for the snow at the front of your property. Make sure there is proper visibility for vehicles on the street and pulling out onto the street. Please be sure to tell your children to stay away from the snow plows. These are large pieces of equipment and visibility is sometimes hard. No one wants a child injured. Children should not be al- lowed to play in the snow in the area between the sidewalk and the curb; and certainly not in the street. Thank you for your help with these snow issues. Library Board Minutes December 6, 2011 Board Members present: Mary Rita Meyers, Jim Stallman, Bernie Kleppe, David Lees , Dot Pospischil, Brenda Haendler, and Linda Pribyl . Board Members ex- cused: Kelly Giese and Linda Balog Staff Present: Cathy Bayne and Beth Wilz Pospischil called the meeting to order at 7:00 pm. The board reviewed the minutes, and Meyers made a motion to approve them. Kleppe seconded. Motion carried 7-0. The board reviewed and discussed the financial reports. Stallman noted that we are within our budget at this time. Stallman made a motion to approve reports, Haendler seconded. Motion Carried 7-0. The board discussed the current bills. Kleppe made a motion to approve the bills, Haendler seconded. Motion carried 7-0. The board reviewed the circulation reports. The number of patrons using NEI- BORS is increasing. Soon a computer set up will be available to more easily download books. The library staff will add the directions and agenda to our web- site. Outside lighting at the library was discussed. The librarian will discuss with the city staff improving the lighting in the entrance area. Circulation Policy was then read for the second and final time. Meyers made a motion to approve, seconded by Kleppe. Motion carried 7-0. Computer Policy was read for the second and final time. Meyers made a motion to approve, seconded by Pribyl. Motion carried 7-0. The Gift Policy was reviewed, and action on this policy was tabled until further research can be completed. Stallman will bring the Boy Scout gift policy, and the librarian will contact other libraries for examples. The next library board meeting will be scheduled for Thursday, January 5th due to the conflict with caucus night which is scheduled for January 3, 2012. Stallman made a motion to adjourn at 8:12 pm.
